Firearm & Ammo Purchases - New Regulations:
NYS Firearm Background Check: Effective September 13, 2023, a background check is required for all firearm, rifle, shotgun, muzzle loaders, and ammunition purchases in New York State.$9.00 fee per firearm transaction $2.50 fee per ammunition transaction. Total fee for a firearm and ammunition on the same invoice will be $11.50.
NYS NICS Fee:These fees will be added as a line item to your invoice and charged when we run your credit card.
Out-of-state buyers picking up firearms or ammo must pay these fees in cash.
Shipping Ammunition (NYS Buyers): Ammunition can be shipped only to an FFL.
Out-of-state buyers: Ammunition will be shipped via UPS (due to USPS restrictions), and there will be a $5.00 handling fee per package.

Firearm Purchases:Firearm purchases require an appointment. A link to schedule an appointment will be sent with your invoice.If you live in a county that requires special paperwork (e.g., Monroe County), you must request the required pistol paperwork by email at least 24 hours before your appointment.
Important Notes for Firearm Buyers:Firearms must be picked up by the registered purchaser (no third-party pickups).If purchasing a handgun, contact your county for instructions on adding it to your pistol permit.
Monroe County Buyers: Extra paperwork is required. Email your request at least 24 hours in advance to ensure we can assist you.
Ammo & Accessories:Ammo and accessories can be picked up during scheduled pickup times without an appointment.
Loading Items:Bring assistance if you are purchasing large or heavy items such as generators, gun safes, or other bulky items.Special equipment may be necessary for safe handling (e.g., for gun safes).
Shipping Information:
Shipping Options:After the auction ends, you will be contacted via Shipping Saint to choose between "Shipping" or "Pickup".Once your items are in the shipping area, you will receive an update with the cost of shipping and tracking information.All shipping costs are the responsibility of the buyer.
Handling Fees: Each package will have a $5 to $10 handling fee depending on size. USPS Priority Mail boxes incur a $5 flat handling fee.
Shipping Process:Please allow up to 2 weeks for shipping. We have a small staff but will make every effort to ship items promptly.
Firearm shipments will begin on Thursday following the auction.We do not ship internationally (except to Canada), and we cannot ship primers, powder, or mounts.
Firearm Shipping:
FFL Requirements: For firearm shipping, please have your FFL email us a copy of their license along with the buyers name. If you are a C&R license holder, please provide your C&R license.A $10 handling fee will be applied to each firearm shipment. All shipping costs, including postage and insurance, are the buyer’s responsibility.
Ammunition Shipping:NYS residents: Ammunition must be shipped to an FFL.For out-of-state buyers, we will follow federal shipping regulations, and ammunition will be shipped via UPS.A $5 handling fee will apply per ammunition shipment.

NYS Background Check (NY NICS):All firearm purchases require a NY NICS background check unless the buyer has a Federal Firearms License (FFL).Handguns require a NYS Pistol Permit (unless the buyer has a Federal Firearms License).Some firearms may not be NYS compliant. Before placing your first bid, you must read and agree to the following Terms and Conditions. By checking the box to register and placing your first bid, you confirm that you accept and agree to these terms.
General Auction Terms:
Acceptance of Terms- By registering for and placing bids in this online auction, you agree to be bound by these Terms and Conditions. If you do not agree with any of these terms, please do not participate in the auction.
Auction Overview: The auction will begin closing on Saturday, December 14, 2024, starting at 10:00 AM EST. The closing of each lot will be staggered with 20 seconds between lots. If a bid is placed within the last 3 minutes of an item’s closing, that lot will automatically extend for an additional 2 minutes.
Previewing Items
In-person preview: Friday, December 13, 2024, from 2:00 PM to 5:00 PM at Hessney Auction Center, 2741 Rt. 14 N, Geneva, NY 14456.
Bidders are encouraged to inspect items in person prior to bidding. Questions about items or additional photos may be requested before the auction closes.
Bidding and Payment Terms:Bidding Requirements: You must be 18 years or older to participate in this auction. By registering, you confirm that you meet this age requirement. All bids are final and cannot be retracted or canceled once placed. By placing a bid, you agree to pay the full bid amount, plus applicable taxes, buyer’s premium, and shipping/handling fees.
Payment MethodsCredit Card: The credit card used for registration will be charged at the end of the auction.Other Payment Options: Cash, NYS check, certified check, or wire transfer may be requested, but you must notify us by 4:00 PM on Friday, December 13 if you wish to use any of these methods.

Payment is due immediately after the auction closes. Any Declined cards or Cash/ wire transfer requested buyers MUST make payment by next business day.
Requirement: First-time buyers, out-of-state, or out-of-country buyers spending over $1,000 are required to pay with certified funds only (wire transfer, certified bank check, or cashier's check).
Firearm and Ammunition Transfer (New York State Requirements):
Effective September 13, 2023: New York State law requires a background check for the transfer of firearms, rifles, shotguns, muzzle loaders and ammunition.$9.00 per firearm transaction, $2.50 per ammunition transaction. If you purchase both a firearm and ammunition on the same invoice, you will be charged $11.50 for the combined background check.
Muzzleloading Rifles and Shotguns: As per NYS law, muzzleloading rifles and shotguns now require a state background check. More further details are available in Lot 1AA of the auction.
Charges for NYS Buyers:These background check fees will be added to your invoice and processed when your payment is made.If you're an out-of-state buyer picking up a firearm or ammunition, you must pay the NYS background check fee in cash.
NYS Residents Requesting Shipping: If you are a NYS resident who requests shipping and have already paid the background check fee, it will be deducted from your shipping/handling costs. We must add these NY Fees to all buyers at check out and have over 600 winning bidders. Please be patient we can not know all buyers who would like shipping if they are NYS residents.
Pick-Up and Firearm Pickup Appointment:
Pick-Up Dates and Hours:Monday: 9:30 AM - 5:00 PM; Tuesday: 12:00 PM - 7:00 PM; Wednesday: 9:30 AM - 5:00 PM; and Friday 9:30AM - 5:00 PM.
Firearms and Ammunition: By appointment only. Appointment links will be sent with your invoice after the auction closes.
Accessories: No appointment required for pickup. Please come during pick up hours as listed above week following auction.
State Laws and Responsibility:
It is the buyer’s responsibility to comply with local and state laws.If you cannot legally possess a firearm or fail a background check, you will still be responsible for payment. You may opt to re-consign the item in a future auction, subject to a 25% consignment fee.
Semi-Auto Rifles:NYS Residents: A permit is required to purchase a semi-automatic rifle in NYS.Out-of-state buyers: We will ship to an FFL in your state. You cannot pick up a semi-auto rifle in NY without a permit.
Handgun Paperwork: If your county requires special pistol paperwork (e.g., Monroe County), email us 24 hours in advance to request the necessary forms.
Shipping and Handling:
Shipping Delays:Please be patient as USPS and UPS are experiencing delays. Expect shipping updates to take 10-15 business days (excluding weekends and holidays).
Shipping Insurance:We ship via USPS and UPS, with insurance on items over $100 through Shipping Saint. Claims for lost or damaged items must be reported to Hessney Auction Company within 30 days of shipment.
Insurance Coverage:
.Auctioneer’s Limitation of Liability:The auctioneer's liability ends when items are delivered to a secure location, and evidence of delivery is provided. Claims for damage or loss must be reported within 72 hours of delivery.
FFL/Ammo Shipping:All ammunition must be shipped to an FFL (for NYS residents) All firearms with paperwork Must be sent to your FFL.
No shipping for powder, primers, or mounts.
Shipping to Billing Address:Shipments must be sent to the billing address of the registered cardholder or to the FFL dealer address on file.
Auction Details:All Sales Are Final:Everything is sold as-is, where-is. There are no returns or refunds.You are encouraged to inspect all items before placing bids.
Condition Reports: Firearms marked "As New" are not brand new but are in like-new condition unless otherwise noted. Only firearms listed as "Unfired in box" are new, unfired firearms.
Ammo Box Lots: Lots 2500 + Box lots of ammunition are sold as-is and may contain mixed or partial boxes. We do not guarantee the count or contents in these lots. These items are not FACTORY full, they could be possible reloads, poor conditions or mixed brand, conditions, or types. Please review photos, inspect in person.
Buyer’s Premium and Chargebacks:
Buyer’s Premium:All purchases are subject to a 13% buyer’s premium, which will be added to your final bid amount.
No Chargebacks:By placing a bid, you agree that chargebacks will not be accepted.
It is the buyer’s responsibility to pick up or arrange for shipping of items after the auction.
Multiples in Lot Bidding:Some lots may include multiple items. The bid price is multiplied by the quantity of items in the lot. (Example: "$12.50 x 4" equals $50.00 total for the lot).
Legal Compliance:Background Checks for Firearms:All firearms purchases require a NY NICS background check before transfer for Pick up at Hessney Auction. The transfer of firearms, rifles, or shotguns without a completed background check is illegal in NYS.

This means that all purchases are final, and there are no returns or refunds.

Shipping / Pick Up
PLEASE READ REGARDING SHIPPING AND PICK UP:
PLEASE NOTE: All requested shipping items will be reviewed to determine if we can ship in house or if it must be taken to the UPS Store for shipment. If we take it to the UPS Store you will be notified and will need to contact them with your payment information.
SHIPPING: (BEGINS ON THURSDAY AFTER THE CLOSE OF THE AUCTION)
You will be emailed and/or texted a link from Shipping Saint and Hessney Auction Co., you are asked to choose "Shipping" or "Pick up' If you select shipping, our staff will gather your items once moved to our shipping area you will receive another notification, when the items are packed you will get a text and email again with the cost and have to pay for your label as well as a tracking number. Once paid we will print it out and mail it. Please be patient. We have 100's of packages to send out each week and a small staff, however we try our best to keep all costs low. Each package will have a 5-10 handling fee. All Priority boxes are $5 flat fee handling. Any new boxes depending on size can cost up to $10.00 * SHIPMENTS CAN range from 7-15 business days to be sent.
Costs to buyers for shipping is based on USPS or UPS and the above handling charge.
If you purchase ammo and our a NYS buyer, please see instructions below.
All shipping costs are the responsibility of the buyer.
Shipments will start on Thursday and could possibly take 1-2 weeks.
We will charge your registration credit card for your purchases. Once the shipping is calculated, we will charge your card for a second time. This process is much more convenient for us. Items typically ship within 2 weeks. We do our very best as we have a small staff, which also helps keep your costs down.
WE DO NOT SHIP INTERNATIONALLY.

Firearms Shipping: All postage, insurance and $10 handling fee will be added to EACH shipment. They must be sent to a FFL. When we receive the FFL we will then begin to pack your items.
Ammunition Shipping: All out of state buyers we will follow any federal regulations for shipping and Ammo is shipped via UPS due to restrictions with USPS. We do not ship powder or primers. There will be a $5 handling fee per package. NYS RESIDENTS: All ammunition must be shipped to an FFL.
Framed print Shipping: regardless of size of frame all framed prints will go to the UPS Store for shipping. The UPS Store will contact you for credit card information for payment of the shipping/gandling/insurance.
SHIPPING INSURANCE: Hessney Auction Company ships via USPS and UPS with Insurance on items over $100 at the cost of the buyer through the outside company Shipping Saint. If your item(s) are lost/damaged, all claims MUST be made through Hessney Auction Company within 30 days of shipment. If a claim is made independently of Hessney Auction Company, all insurance is voided, and we cannot make an additional claim on your behalf. If a claim must be made please email us and we will provide you with a detailed list of what must be included in order for us to submit it to our carrier/Insurance.
** If an item is damaged: please contact us and we will need pictures of the original box, ALL packing material inside box including paper, buble wrap and anything else inside the box, as well as clear pictures of the damage. If the item can be fixed we will need to submit an estimate for the repair and that is the amount you would receive.
**If a damage claim is submitted it will ONLY cover the hammer price of the item in the auction. It DOES NOT cover buyers premium, tax or shipping/handling.
PICK UP: Please be aware of pick up days and pick up at those times, we need items to be removed during these times so we can set up more auctions.
