Terms / Conditions (Additional house terms are listed below general terms & conditions)
1. All bidders must be registered to bid on auction lots
2. All items are sold as is, where is and with any faults
3. A 10% Buyer’s Premium is applied to all purchases
4. This auction uses a soft close format, bidding will remain open for one minute past scheduled close time to accept any last bids. The bidder that has the final accepted bid is responsible for payment.
5. Kevin Neal Auction Service may reserve the right to reject any bid at its sole discretion
6. Payment is required before or at time of pick up, cash, check or credit cards are accepted, acceptable cards are Visa, MasterCard, Discover, American Express. Note: If paying with a personal check, and the amount is greater than $10,000.00 proof of sufficient funds is necessary.
7. If paying with a credit card a 4% service fee will be charged to all credit card purchases
8. A $50 fee will be charged to any individual whose check does not clear the bank.
9. Items that are not picked up at the provided time or agreed upon time will be charged to the credit card on file, and ownership of the item will revert back to seller
10. Shipping is only offered for Lenox figurines. Buyer pays exact shipping plus $10 handling fee
11. Items will be NOT be packed and prepared for pick up. Bring your own boxes, packing material, and help to load larger items.
12. By registering for this auction, you agree to all of the terms and conditions provided
13. If Buyer's credit card is denied that individual will be reported to HiBid, where appropriate actions will be taken
14. All sales are final, NO refunds will be given
15. Kevin Neal Auction Service does not issue or grant any warranty of any kind to any of the items sold through this auction, it is the potential Buyer's responsibility to inspect items before placing their bids

1. This IS an absolute auction, Real Estate sells to the highest bidder
2. This is an online auction only; all bids will be placed online only.
3. Registration & Bids will be done at kevinnealauctionservice.hibid.com
4. Real Estate is selling AS IS, WHERE IS with any and all faults
5. Inspections may be done by potential buyers before auction BUT any paid inspections must be paid by potential buyers
6. Neither Auctioneer nor Sellers / Owners are responsible for repairing any broken or not up to code items / issues with any of the structures located on the property.
7. To bid on Real Estate the individual(s) must be registered for the auction through Hibid.com
8. To receive bidder number individual(s) must complete required steps to register for auction
9. The auctioning of this Real Estate will be performed within an internet auction setting, no phone bidding or live bidding will occur
10. No reserve is set on this real estate; therefore it sells to highest bidder
11. Highest bid received will be the winning bid.
12. The individual whose name is associated with the winning account and bid will be responsible for that bid amount.
13. Once the auction closes it is the responsibility of the individual whose name and account is responsible for that winning bid to work with Auctioneer to make the necessary payments and complete the necessary paperwork.
14. Winning bidder will be contacted by Auctioneer immediately after the close of the bidding.
15. Within 24 hrs. of Real Estate bidding closing winning bidders are responsible to sign the necessary contracts / agreements and pay a NON REFUNDABLE balance of $10,000.00. This payment can be made in the form of cash, cashier’s check (Made payable to Kevin Neal Auction Service), or direct wire transfer NO personal checks or credit cards will be accepted. These arrangements will be made between Auctioneer and Buyer during the phone conversation after the close of bidding.
16. The close of the bidding will represent the beginning of the contractual agreement between Seller / Auctioneer & Buyer. If buyer does not perform their duties and responsibilities of meeting with Auctioneer, signing appropriate paperwork and making the non refundable deposit they will have to pay the sum of $2,500.00 to Auctioneer to cover costs and money lost.
17. All paperwork will be submitted to Falcon Settlement Inc. of Hawthorn who will handle the closing of the Real Estate. If buyer wishes to use a different closing agent they may do so but must inform Auctioneer.
18. Payment for all closing costs associated with the close of this real estate (Deed search, etc.) will be the financial responsibility of the buyer(s)
19. Taxes will be prorated to the time of close
20. Closing MUST BE completed within 45 days of the date the paperwork was submitted to Falcon Resources (Note: If unforeseen circumstances arise that are out of the Buyer’s control they may be taken in consideration and more time may be allowed)
21. Final balance minus the NON REFUNDABLE deposit will be due at time of closing
22. Potential buyers are responsible for their own finances and must have them in order before bidding on Real Estate (If non refundable deposit is not made immediately after bid is accepted that individual(s) forfeits their rights to Real Estate)
23. There are believed to be no liens on the property. If any liens were to be found, it would be the responsibility of the Sellers to financially satisfy those liens.
24. We encourage all prospective buyers to take the time to visit and inspect the land and structures in order to make a calculated final decision
25. All information provided for this auction has been obtained from the Sellers by the Auctioneer and is believed to be accurate
26. Auctioneer is working on behalf of the Sellers and is not responsible for any inaccurate information or misrepresentation of Real Estate
27. Auction day announcements supersede ANY announcements or information provided verbally, in writing or in any advertisements leading up to the auction
28. Neither the Auctioneer or Sellers are responsible for any injuries of any person(s)
29. By bidding on real estate potential buyer is aware their bid may be the highest bid received and therefore be responsible for maintaining their role and duties within the contractual agreement.
