Terms / Conditions
1. This is an online internet auction only, all buyer's must be registered to bid on auction lots and all bidding will be online only. This auction uses a soft close format. Lots will close every 15 seconds unless a bid is placed inside of the last minute of bidding. If a bid is placed within this time frame bidding will open for an additional minute. Bidding will close when no bids have been placed for one minute. A timer will be present for reference.
2. Not all items in this auction are selling without a reserve. Some items do have a set reserve, but reserves may be lowered depending on bids recieved. Some items do have starting bids, this is to eliminate individuals from bidding extremely low and unrealistic amounts on those items.
3. All items in this auction are being sold 'AS IS, WHERE IS WITH ANY AND ALL FAULTS'
4. Kevin Neal Auction Service LLC may reserve the right to reject any bid at our sole discretion
5. Auction items are located at various locations and some items may need a scheduled time to view items. It is the potential buyer's repsonsibility to be aware of location and whether a meeting time needs to be scheduled. To schedule a private viewing please call (814) 590-8231. If a private viewing is needed DO NOT show up at location unannounced, you will be asked to leave the property and will not be able to view item(s) at that time.
6. It is the responsibility of the potential buyer to inspect items of interest. Kevin Neal Auction Service LLC does not provide any guarantee or warranty for any item(s) in this auction. Items are being sold in their current state.
7. A buyer's premium will be charged to all purchases. We use a tiered buyer's premium scale.
Buyer's Premium Scale:
$100,000 or less - 10%
$100,001 - $250,000 - 6%
$250,001 - $500,000 - 4%
$500,001 - $1,000,000 - 3%
(Buyer's premium will be adjusted to exact amount on final invoice for payment)
8. Upon completion of auction Buyer will be sent unpaid invoices listing items won. It is the responsibility of the buyer to pay Kevin Neal Auction Service LLC. Payment must be recieved before or at time of pick up. If payment has not been recieved possession will remain with Seller until all accounts have been settled. Acceptable forms of payment are PA checks, credit card, cash or wire transfer. Any invoice over $2,500.00 MUST be paid with either cash or wire transfer. NO personal checks will be accepted for payments over $2,500.00. Credit cards may NOT be used to pay for any item that has a title or any amount over $2,500.00. Acceptable cards are Visa, MasterCard, Discover, American Express (A 3% credit card fee will be charged to all credit card purchases). Wire transfers must be completed within 3 business days of the close of the auction.
9. Items that require a private appointment to view also will require a scheduled time to pick up. Contact (814)590-8231 to schedule a pick up time.
10. Items will not be shipped directly by Kevin Neal Auciton Service LLC. It is the buyer's responsibility to make the necessary arrangements to have items shipped/hauled. Any costs relating to the shipping or removal of items from the properties is the sole responsibility of the buyer.
11. If items are not picked up at arranged time, and proper notices are not given Kevin Neal Auction Service LLC has the right to charge that buyer's credit card a $100.00 fee.
12. No items will be packed or prepared for pick up; buyer is responsible for any packing materials needed. It is the responsibility of the buyer to bring necessary equipment to load items. Neither Kevin Neal Auction Service LLC or the Sellers are responsible for any damages to personal property of the buyer caused by loading. Any damages causes to the properties or structures by buyers or individuals helping buyer's load will be the responsibility of buyer.
13. For items that possess titles, it is the responsibility of the Buyer to make arrangements with Seller to transfer titles (Vehicles will remain with Seller until titles are transferred)
14. Title transfer fees and taxes are the responsibility of the Buyer, titles will not be transfered until funds are cleared. If funds do not clear ownership of the item remains with Seller. (If funds do not clear a $100 processing fee will be charged to that Buyer with insufficent funds)
15. Potential buyers view, load and operate items at their own risk. Kevin Neal Auction Service LLC and the Sellers of items in this auction are not responsible for any injuries that may be sustained by buyers.
16. All sales are final, NO refunds will be given
17. Kevin Neal Auction Service LLC is working on behalf of the Sellers and has provided information that has been obtained from them (Sellers), and therefore is not responsible for any misleading or inaccuarte information.
