1. PLEASE NOTE: All bidders and others attending this auction online agree that they have read and fully understand these terms and agree to be bound thereby.
2. PAYMENT FOR PURCHASES MUST BE MADE ON DATE OF AUCTION. PAYMENT WITH CREDIT CARD THROUGH HIBID ACCOUNT WILL BE THE ONLY FORM OF PAYMENT ACCEPTED.
3. TERMS: Payment for purchases may be made by credit card only through Hibid. Sales tax will be charged in instances where the law requires and a 10% BUYERS PREMIUM will also be added to final total.
4. SETTLEMENT: Must be made at conclusion of auction. Nothing to be removed until settled for. The merchandise becomes the full responsiblilty of Buyer at time of purchase, and Buyer assumes all risk of loss and damage to property.
5. DISPUTES BETWEEN BIDDERS: The Auctioneer shall designate the Purchaser after each item of merchandise is auctioned. If a dispute arises between two or more bidders, the Auctioneer reserves the right to re-open bidding. The Auctioneer's designation of a buyer shall be final.
6. NO WARRANTY: The descriptions of items appearing in advertising prior to this auction are believed to be correct. Nevertheless neighter those descriptions nor any oral statement made by Owner, its Officers, Agents and Employees of Auctioneers concerning any item shall be construed as a warranty, either express or implied. ITEMS ARE SOLD AS IS - WHERE IS.
7. INJURY AND DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage casue by bidder of his Agent, and further agrees to hold Auctioneers, Owners, its Officers, or Employees harmless for any personal injury to himself or his Agents and any personal damage incurred on auction premises.
8. Owner has the right to reject bid unless otherwise stated.
9. ABANDONMENT POLICY: A successful buyer is obligated to remove the item(s) from the auction site within a timely manner upon payment. Seller may levy storage fees beginning 10 days following auction close. Midwest Exchange may deem buyer's failure to remove equipment within 60 days following auction close as evidence of buyer's intention to abandon the property. In these instances, the Company may take action that is adverse to the buyer's interest in the property, including, but not limited to steps to dispose of the property.
10. At the sole discretion of the Auctioneer, the auction may be suspended, postponed or cancelled, if internet service is unstable or disrupts the online portion of any event which is simulcast as an Internet Auction.
