Ces frais sont applicables uniquement sur les articles gagnés. 6- Une fois qu'un lot est vendu, l'acheteur devient seul responsable. 7- Toute offre est considérée comme légale et irrévocable: aucune ne peut être annulée pour cause de mauvaise description, état, défectuosité ou pour toute autre raison. 8- (Encans Chabanel auctions) s'engage à ne pas surenchérir sur les lots proposés sauf en cas de ce dernier souhaitant acquérir le lot à titre personnel. Dans ce cas, les frais d'enchères applicables devrait être payé par ceux-ci. 9- Les vendeurs peuvent mettre un prix de réserve sur leurs lots. 10- (EncansChabanel auction) peut retirer, omettre ou ajouter un lot à vendre à tout moment. 11- Dans le cas où un vendeur utiliserait une pratique quelconque pour augmenter les enchères sur l'un de ses articles pour vente, il ou elle peut voir ses articles retirés de la vente aux enchères et faire face à une pénalité de 25%. Le vendeur se réserve le droit d'enchérir ou de mettre un prix de réserve sur ses articles uniquement s'il désir, lors de la vente aux enchères, de retirer l'objet de la vente. Dans ce cas, des frais de 25% sera appliquée et le vendeur sera facturé avec son article en plus de ses frais d'enchères applicables. 12- En cas de malentendu, (EncansChabanel auction) peut immédiatement réinitialiser tout lot (qui fait l'objet dudit mal compris). Dans le cas où l'acheteur se fonde sur le décision finale d'(EncansChabanel auction) 13- Ni le (EncansChabanel auction) ni les vendeurs ne sont responsables des erreurs ou omissions dans la description des articles. L'acheteur s'appuie sur ses connaissances, ses examen des éléments et son propre jugement. 14- Toute description de l'état, du bon fonctionnement ou de l'année de fabrication du chaque article ou lot n'est en aucun cas une garantie réelle ou implicite. Les marchandises sont vendues lot par lot, comme on le voit sur place, aux risques et périls de l'acheteur, sauf indication contraire. 15- Aucune réclamation ne peut être faite après la vente aux enchères d'un lot. Manutention, chargement, transport, le reconditionnement, l'utilisation, l'élimination, la possession et toute autre utilisation deviennent la seule et unique responsabilité de l'acheteur dès qu'un lot est levé. 16- Aucun acheteur ne peut récupérer qu'une partie de ses lots achetés, tous les articles achetés sont considéré comme un seul achat en gros et tous les dépôts sont applicables sur tous les achats en gros et pas sur un terrain particulier. 17- L'acheteur doit prendre possession de son bien à ses frais, risques et responsabilités Mardi à Vendredi : 9h à 15h (première semaine après la clôture de l'enchère) - Sans rendez-vous. Dimanche : Ouvert à partir de 10h pour l'événement Spin & Win et le shopping de notre liquidation. Samedis : Fermé, avec quelques exceptions et arrangements flexibles disponibles. Ramassage tardif : Si vous avez besoin de plus d'une semaine pour récupérer vos articles, veuillez nous en informer à l'avance pour arranger un horaire convenable. Le non-ramassage dans la semaine peut entraîner la perte de la chance de participer à l'événement Spin & Win, et des frais de stockage peuvent s'appliquer. Après la première semaine, vous devez appeler pour organiser un horaire de ramassage. Des pénalités peuvent s'appliquer pour les retards, comme indiqué sur chaque lot. 18- Tout acompte sera conservé ou saisi par l'(Encans Chabanel auctions) si le solde dû sur tous les achats n'est pas payé dans les deux (1) semaines après la vente. These costs are applicable only on the items won. 6- Once a lot is sold, the buyer becomes solely responsible. 7- Any bid is considered legal and irrevocable: none can be canceled for reason of bad description, condition, defectivity or for any other reason. 8- (Encans Chabanel auctions) agrees not to overbid on lots offered except in the case of the latter wishing to acquire the lot as personal. Failure to pick up within a week may result in losing the chance to participate in the Spin & Win event, and storage fees may apply. After the first week, you must call to arrange a time and date for pickup. Penalties may apply for late pickups, as noted on each lot. 18- Any deposit will be retained or seized by (Encans Chabanel auctions) if the balance due on all purchases is not paid within two (1) weeks after the sale. If the buyer, within the prescribed deadlines, refuses to take possession of the totality of its purchases, so further disclaiming any rights of ownership,(Encans Chabanel auctions) will retain the full right of ownership.(Encans Chabanel auctions) may at its discretion secure, store, dispose or resell these goods without notice to the buyer, the latter will be held responsible and shall, on request pay any deficit incurred without any loan and pay the interest, costs and damages as per the provisions of article 1765 of the Civil Code of Quebec. 19-In the event of the impossibility of delivering any lot due to fire, theft, links, seizures, mortgages, deeds of trust or any other reason resulting from this fortuitous case, the deposit given by the buyer will be refunded, and this, without any responsibility or other remedies against (Encans Chabanel auctions) or the sellers. 20-(Encans Chabanel auctions) may refuse to issue a buyer-bidder number to any person or may cancel it at any time. 21- The buyer who, due to an incident or accident, causes damage to his own property or to those of other parties, as well as buildings, facilities on-site, land or other dependencies, is responsible. 22- Sales prices are recorded for any reference. 23- (Encans Chabanel auctions) makes no warranties under the Act on Consumer Protection and the buyer agrees freely. 24- The buyer waives the seller’s legal warranty against hidden defects, and more specifically to the provisions of Articles 1726 and following of the Civil Code of Quebec. 25- Without restricting the above terms and conditions, (Encans Chabanel auctions). reserves all other remedies permitted by law.
