The property is sold "AS IS, WHERE IS" with all faults. The condition of the house is purported to be beyond repair and should be demolished; access into the house will not be permitted.
* DESCRIPTIONS & INFORMATION
All descriptions believed accurate but not warrantied. Bidder inspection is highly encouraged. By placing a bid, bidder signifies that they have examined/inspected the property to their satisfaction, or that they have chosen not to do so. Failing to inspect items prior to bidding is not grounds for disputing payment or refusing to take possession of purchased items. Further, the bidder is not relying upon any statement (verbal or written) made by the auctioneer, any representative of the auction company, listing broker or brokerage, or the seller as it relates to the condition of the property.
* BIDS
We reserve the right to reject any bid at our sole discretion. ALL BIDS ARE FINAL.
* NO RESERVE.
The Seller has elected to not place a reserve on the sale of the property.
* BUYER PREMIUM
A Buyer's premium of 10% will be charged to the winning bid and will be collected at closing and be paid to the Listing Brokerage.
* DOCUMENTS NEEDED PRIOR TO BIDDING
All bidders must complete the Real Estate Brokerage Disclosure, Estimated Buyer Cost Sheet, Lead Based Paint Disclosure, and Purchase Offer forms prior to submission of a bid. THESE DOCUMENTS WILL GOVERN/DICTATE THE TERMS OF THE SALE and supersede any element(s) within these Terms and Conditions.
* CUSTOMER RELATIONSHIP
All bidders will be treated as a Customer by the Listing Broker (RE/MAX The Group). The Listing Brokerage is a Seller's Agent (see Real Estate Brokerage Disclosure form for full details). The Auctioneer is not a licensed real estate brokerage; the Auctioneer is serving solely as a marketer/advertiser and is hired by the Listing Broker.
* EARNEST MONEY
Please see the purchase contract for terms and conditions.
* PROOF OF FUNDS
The winning bidder will have one business day after they have been notified of winning to provide Auctioneer with proof of funds.
* CLOSING
Closing is to be completed within two weeks of the closing of the auction. Buyer agrees to coordinate, in the best of their ability and in a timely manner with the listing broker and all other associated parties, to complete all necessary documents and close the sale within this timeframe. Closing will take place at First American Title in Casper, Wyoming. Remote closings are available upon request. The Seller will be providing a title commitment and a general warranty deed.
* NO FINANCING
Only cash or similar bids will be accepted; no mortgages will be accepted.
* FAILURE TO PAY/BUYER PAYMENT DEFAULT

* DISPUTE
A court of Natrona Co., Wyoming will be used for dispute resolution if the Seller, Auctioneer and Bidder are unable to resolve the dispute first through mediation.
* INDEMNITY - Big Wyoming Auctions, RE/MAX The Group and the Listing Broker (collectively known as Selling Agent). You, the Buyer, agree to indemnify and hold harmless Selling Agent, any subsidiaries thereof, and designated agents and partners against all damages, losses, liabilities, claims, or causes of action that may arise out of your use of our website, products, or services or your inability or violation of the terms or requirements contained in this agreement. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SELLING AGENT OR SELLER BE LIABLE FOR ANY SPECIAL, INDIRECT, PUNITIVE, COVER, INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED, WHETHER IN CONTRACT OR TORT OR UNDER ANY OTHER THEORY OF LIABILITY, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS OR SALES, ANY LOSS OF GOODWILL OR REPUTATION, OR THE COSTS OF SUBSTITUTE GOODS OR SERVICES, EVEN IF BIGIRON OR SELLER, OR AN AUTHORIZED REPRESENTATIVE THEREOF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Further, you waive and release Selling Agent from and against any liability, claim, demand, or expenses arising out of or related to any items, expressly including without limitation any assertions of misrepresentation, negligence, or breach of contract or warranty. You agree not to join in any legal action or proceeding arising directly or indirectly out of the condition of items or alleged representations thereto and further agree to approach Sellers with respect to items of this nature. If you fail to comply with this provision, you will be responsible for all costs, expenses, and fees, including attorney fees, Selling Agent incurs in defense of such claims.
