2024 Auction Terms & Condition
All Bidders acknowledge to have read, comprehend, and agree to the following terms & conditions set forth by Jeff Boone Auction & Realty. ("Boone Auctions"). All bidders agree to be legally bound to these terms & conditions. All announcements made by the Auctioneer shall supersede any printed material.
Immediately when an item is Sold it becomes the property and responsibility of the Buyer. It is the buyers responsibility to insure purchases as needed immediately. All items sell “AS-IS” “Where-Is” with no warranties or guarantees by the Seller(s) or the Auction company. All sales are Final. The described condition or representation of hours, use, and miles is provided as a courtesy, and not guaranteed by the Seller(s) or the Auction company. The Bidder is responsible for determining his or her opinion of the condition, and authenticity of an item before purchasing the item, not after. It is the buyers responsibility to inspect the item of interest prior to bidding on it. After a bidder has won the bid, all risk of loss and damage passes to the bidder, even though the bidder may have not paid for the item yet. Buyers should guard their items accordingly. The Seller(s) and the Auction Company and all of its Associates are not responsible for loss, theft, damages, or accidents.
For Online Bidders: By placing bids you agree to follow all of the terms and conditions and make payment and take possession of purchased items. Although we strive to provide the best internet connections and software available, please understand that internet speeds and reliability will vary. The Auction company is not responsible for lost connection or software failures that result in lost or unaccepted bids. This will be a fast paced auction and quick bidding will be required.
All online bidders are responsible for complete control of their online bidding accounts. You are 100% responsible for every bid placed under your account, accidental and intentional. If your pet cat Toby decides to jump up on your table and hit the bid button, you have better teach Toby to be an excellent operator, because you are required to pay for your new excavator. Online bidding is a serious matter. You must understand exactly what you are doing at all times.
Boone Auctions reserves the right to deny and or terminate bidding privileges at any time.
Buyers: Once invoiced, you have 24 hours to contact Boone Auctions to notify of payment arrangements. Please email JeffBooneAuctions@gmail.com with invoice and or bidder number with payment arrangements.
All items must be paid for by Tuesday, December 10th @ 5 PM EST unless prior arrangements have been made. Any unpaid bills will result in revoked bidding privileges/immediate legal action. Credit cards on file for online bidders will be charged w/ a 3.99% fee if no contact has been made by this date. If mailing a check for payment, buyer must send priority mail with a tracking number.
Terms: Cash, Check, & Wire Transfer accepted. Credit Cards ( Master Card, Visa, or Discover) will be charged 3.99% in addition to the purchased amount. This applies to onsite and Internet bidders.
NO BUYERS PREMIUM FOR IN-PERSON BUYERS.
Buyers Premium for ONLINE bidders Only: BP Varies Per Bidding Platform:
Equipment Facts: 5% BP with a $1,000 cap per item
HiBid: 5% BP on first $20,000 & 2% on the balance capped at $4,000 per item
This BP will be added to your final invoice total.
7% Indiana State Sales Tax will be charged unless proof of exemption is provided. All titled items will be charged sales tax at the rate of where your vehicle will be titled up to a max of 7% unless purchased by a registered dealer. This applies to in state and out of state purchasers.
All bidders understand that they will be liable for payment of sales or use taxes which may become due for failure to comply with the provisions of federal, state, and local tax codes for any items sold as tax exempt or for resale. All bidders understand that it is a criminal offense to give an exemption certificate to the seller for taxable items that they know, at the time of purchase, will be used in a manner other than that expressed in this certificate and, depending on the amount of tax evaded, the offense may range from a class c misdemeanor to a felony of the second degree.
All items to be removed from the auction field by Friday, December 20th. All purchased items become the responsibility of the purchaser as soon as the item is sold. Any items not picked up by this date will be charged a storage fee of up to $100 per day. If not picked up by the next consignment Auction, the Auction company will sell your item at No-Reserve, and mail you a check for the remaining balance after all fees are applied. The Auction company is not responsible for lost, stolen, or damaged items. It is the buyers responsibility to insure purchases as needed immediately.
There will be a Titled Vehicle Entry Fee added to all Titled items $20 Paid by Seller & $40 Paid by the Buyer. Fee includes: Title processing (paperwork filled out and documents needed to take to your local BMV), and USPS Priority Mail (with tracking number) delivery, if applicable. Cash buyers on titled items may take the title upon payment if the title is present. Those paying with checks will receive title upon check clearing. For items noted “Title to Arrive”, titles may take up to 30 days to come in if obtaining from a lender, and or waiting to receive from the BMV. Boone Auctions will secure titles and distribute as soon as possible for each titled item.
All bidders agree to receive text, email, & or postage notifications about our upcoming events.
All auctions are considered to be with reserve unless specifically stated otherwise. Reserves, if any, are not disclosed.
