The terms and conditions apply to any purchase made from Global Tech Equipment LLC (GTE) or in a transaction where GTE serves as an auctioneer or agent for a third-party owner (Consignor). BUYER’S AGREEMENT: By participating in the auction, the buyer agrees to be bound by the terms and conditions set by GTE. AUCTION PROCESS: The auction is conducted by GTE, and the highest bidder is deemed the buyer. GTE has the right to reject any bid and may determine the winning bid at its discretion. INSPECTION OF GOODS: Buyers are encouraged to inspect the goods before placing a bid and should rely on their own investigation and inspection. The goods are sold on an "as is" basis, and neither GTE nor the seller guarantees the condition, authenticity, or completeness of the goods and without rights or licenses to software. GTE does not warrant merchantability or fitness for any particular purpose and lots are sold with all faults. Buyer waives any remedy against seller in regards to condition of the assets. INFORMATION SUBJECT TO ERROR: The information provided by GTE or the seller, including advertising and catalogs, may contain errors and can be changed without notice. Buyers should rely on their own inspection prior to bidding. PAYMENT: Payments are due within 48 hours of sale ending. Buyers are required to pay the full purchase price and any applicable taxes. Payment methods include certified check or federal wire transfer. GTE may charge a buyer's premium, which is an additional percentage added to the final purchase price. Please check each auction for specific buyer's premium charged. REMOVAL OF GOODS: Buyers are responsible for removing the purchased goods by the specified removal date. Failure to remove the goods by that date will result in the goods being deemed abandoned, and GTE will have no further obligation to the buyer. Buyers must arrange their own removal services and may need to provide proof of payment and authorization for third-party contractors. Once the Buyer has made full payment to GTE for all sums owed in relation to the Goods, the risk of loss for those Goods will be transferred to the Buyer. RESPONSIBILITY FOR REMOVAL: Buyers are responsible for the safe and proper removal of the goods. They must also restore any damage caused during the removal process. Buyers should disconnect utilities and properly handle fluids, oils, and hazardous chemicals. They indemnify GTE, the seller, and the premises owner from any claims, damages, or losses related to their actions or presence on the premises. MISSING OR LOST ITEMS: GTE is not responsible for any missing or lost hand-carry items that haven't been retrieved within 72 hours after the auction. ADJUSTMENTS: Any requests for adjustments or accommodations must be made in writing to GTE before the goods are removed from the auction premises. After items are removed from site, GTE shall have no obligation to make adjustment for any reason. DAMAGES: Except for cases of willful misconduct, neither the seller nor GTE is responsible for any damages, loss, or theft of goods. They are not liable for damages caused by strikes, civil disorders, or acts of God. AGENCY RELATIONSHIP: When GTE sells goods on behalf of the seller, it acts as an agent and is not liable for the owner's actions. CHANGES: GTE reserves the right to withdraw or sell any assets before or during the auction period. They may also extend the auction period without notification. In the event that GTE is unable to deliver any purchased Goods to the Buyer for any reason, both GTE and the Seller will only be liable to refund all payments made by the Buyer to GTE for those Goods. RESERVE PRICE: GTE may establish a reserve or minimum price for goods without notifying bidders. They can confirm or reject the final bid and may bid on behalf of a third party. RIGHT TO REFUSE BIDS: GTE reserves the right to refuse bids from any person and deny access to its services and websites without notification. EXPORT LAW COMPLIANCE: Buyers must comply with U.S. export control laws and agree not to export goods to embargoed countries. GTE and the seller are not responsible for determining which items may be subject to export restrictions. AUCTION SITES: Buyers acknowledge the potential hazards of the auction site and assume all risks associated with attending the auction. GTE RIGHTS AND REMEDIES: If a buyer fails to comply with the terms, GTE and the seller have rights and remedies available to them, including retaining deposits, reselling goods, and recovering costs, losses, and damages incurred. NO COLLUSION: Buyers are prohibited from engaging in bidding practices to manipulate the auction and must not use false names or information. INDEMNIFICATION: Buyer does hereby indemnify and hold harmless Global Tech Equipment LLC (GTE), its employees, and hired agents from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney fees) arising out of or related to Buyer's participation in any auction, purchase of goods, and presence on the auction premises. This indemnification includes, but is not limited to, any injuries to persons or property, environmental violations or contamination, and any actions or actions with respect to the goods purchased. Risk of loss on any goods passes to the Buyer upon full payment to GTE. WEBSITE USAGE: Specific rules apply to accessing and using GTE's websites, including maintaining the confidentiality of user credentials and prohibiting disruptive or unauthorized activities. LIMITATION OF LIABILITY: Except for cases of gross negligence or intentional misconduct, the aggregate liability of the seller and GTE is limited to the purchase price paid for the goods. They are not liable for lost profits or consequential, indirect, punitive, exemplary, or special damages. RIGHT TO AMEND TERMS AND CONDITIONS: GTE can amend the terms and conditions without notification, and it is the buyer's responsibility to review them for each sale. GOVERNING LAW: The interpretation of these terms and conditions and all transactions are governed by the laws of the state of Washington. Any disputes arising from these terms and conditions fall under the jurisdiction of the state or federal courts located in King County, Washington.
