Premier Auctions, a subsidiary of Wasatch Frontier Group LLC, herein referred to as Auctioneer, is conducting auctions on behalf of the property's seller. By placing a bid on auctioneers' online selling site or in person, the Buyer agrees to all terms and conditions stated henceforth or posted onsite or online. Auctioneer reserves its right to revise terms and conditions at any time. TERMS OF SALE: Everything will be sold "as-is, where is, with all faults known or unknown, seen or unseen". There is no warranty offered, expressed, or implied. The Buyer shall rely entirely on their own inspection and information. The bidder is responsible for knowing which item he/she is bidding on. If there is any doubt about the items in any lot, do not bid. Any information provided for the item is done to the best of our knowledge and may not be 100% accurate and thus not responsible for any inaccuracies. Once a Bidder places the winning bid and Auctioneer and HiBid/AuctionFlex software says sold, that Bidder is solely responsible for proper payment of any lot or lots won. Buyer’s Premium: A fee will be charged on all lots sold. 12% on each lot. Some lots may have a lower premium. Check the lot details for the exact premium amount prior to bidding. Some lots will have a reserve price that will need to be met in order to sell the item. The reserve price is not disclosed. HiBid will indicate if the reserve price is not met. The Auctioneer is not to be held liable for any inaccuracies being reported by HiBid relating to the reserve price. Wasatch Frontier Group LLC and its affiliates may bid using one or more bidder numbers to protect reserve pricing pursuant to Utah Code 70A-2-238. If you have any questions about this, please contact us prior to bidding. If Buyer is the winning bidder of a lot or lots, they are expected to pay for the item or items. A winning bid will be treated as a contract, regardless of any unexpected computer or clerical error after that point. The Auctioneer reserves the right to refuse a bid and/or reject bids not in the best interest of the Seller. The Auctioneer reserves the right to remove an item from an auction either live or online at any time and for any reason. Any invoice with a balance still owed after 5 business days following the auction is subject to a penalty fee of $10 per day and the maximum late fees allowed by the state of Utah. Auctioneers or owners make no warranties or guarantees as to genuineness, authenticity of, or defect in any lot and will not be held responsible for advertising discrepancies or inaccuracies. All sales are final when awarded to the successful bidder. The Buyer accepts full responsibility for all purchases made and holds the Auctioneer, owners, and property owners free of any liability in the event of theft or disappearance of any items purchased or consigned. Auctioneer is not responsible for any liability or damages that occur during or after the auction. Payment Options: Visa, MasterCard, Discover, American Express, Wire Transfer, Zelle, ACH, Cashier's Check, Debit Card, and Cash. Wire transfers, ACH, and Zelle bank deposits are free of charge. Instructions will be provided via email along with your invoice. Debit and credit cards accepted up to a max of $4,999 with a 3% convenience fee. For payments $5,000 and over, payment to be completed by cash, check, Zelle, or wire transfer. For payments over $10,000, payments must be completed by cash or wire transfer only. No refunds and credit card payments cannot be reversed. All payments are due within 5 days after the end of the auction, unless stated otherwise in the auction. Utah residents will be charged sales tax unless a valid resale certificate is provided prior to the closing of the auction. Sales tax will be applied to the invoice total and Buyer's transaction fee. The Buyer also agrees to pay any sales tax that may be assessed after any payment has been received. Any online credit card payment declined, or onsite payment not made when due, Auctioneer may at its discretion resell to another bidder at any time, and Bidder will be banned from any future auction, and the account will be reported to HiBid for nonpayment. Payments must be made when due. BUYER REGISTRATION: There is no fee to register. A $1 credit card authorization will occur to verify credit card information. This is not a payment. You must register for each auction to receive a bidder number. Online registration requires a valid debit/credit card for a payment method. The Buyer’s names are to remain confidential and not disclosed on the auction platform. The Auction company reserves the right to require a cash/credit card deposit if it believes it is in their best interest. Bids cannot be retracted and are a binding contract between the Bidder and Auctioneer/Seller. The Bidder is accountable for being informed about property and associated costs before bidding. A maximum bid can be placed on the lot and its contents and/or items. A maximum bid is confidential, and the Bidder authorizes the Auctioneer to place bids on the Bidder’s behalf up to the amount of the maximum bid. Upon the sale of such property, information and the purchase amount may be posted for a period of time on the HiBid website. All questions or disputes must be resolved immediately. No changes or adjustments will be made at a later date. The Auctioneer reserves the right to reopen bidding, and the Auctioneer's decisions will be final. Vehicle Titling Information: All vehicles listed for sale will have a clear title unless otherwise noted in the listing description. Premier Auctions will clearly indicate any title discrepancies, salvage titles, or other issues in the vehicle’s listing details. It is the Buyer's responsibility to review this information before placing a bid. Titles will be processed in the name registered with the auction, and no open titles will be given. Title Delay Notice: In the event a vehicle listing specifies a title delay, the Buyer acknowledges and agrees that there could be a 30-45 day delay in receiving the title. Premier Auctions will send the title as soon as it is received. Buyers should plan accordingly and bid with this understanding. Any title delay will be clearly noted in the vehicle listing, and Premier Auctions will communicate the status to the Buyer as updates become available. PICKUP / SHIPPING: Shipping services may be offered for some lots. Please check the lot details to verify if shipping is offered prior to bidding. There is a $10 service fee for shipping that is added to your invoice if shipping is requested. This fee covers packaging costs and will not matter based on quantity of items. For vehicles, we prefer that the Buyer pick up the vehicle. We can provide a quote for shipping through a third-party transportation company if requested. Please contact us for a quote prior to the close of the auction. Payment will still need to be completed in the specified time period before any items will be shipped or allowed for pick up. The Buyer is solely responsible for all costs incurred to remove items won. Local or Onsite Bidders must pick up their items won by the following Friday after the end of the auction at 5:00 PM MST. If items are not picked up by the specified time period, storage fees will apply, and after 30 days, items will be deemed abandoned and forfeited to be disposed of or resold per Utah state laws. Storage fees will be charged at the rate of $25 per day for vehicles and $10 for any non-vehicle items. Items not at Premier Auctions' facility yard, such as offsite business or universities, will have a limited time to remove before forfeited and disposed of. These lots will be specified in the listing description. Please note that with these lots, if you do not pick up within the schedule, you will lose it. We are willing to work with you to make sure this doesn't happen, but communication is very important to make sure we know how to help. The Buyer is responsible for contacting auction representatives and making other arrangements to pick up their items won if they think they will need additional time. We are happy to work with those needing shipping. No items are allowed to leave the auction site until all fees are paid in full. Buyer must present a PAID invoice before items can be removed. LOADING / UNLOADING POLICY: Auctioneer is not responsible for loading or unloading equipment or the securing of any loads. Auctioneer is not responsible for verifying that equipment being transported to/from the auction yard is properly secured or being carried in compliance with applicable transportation laws and regulations. Auctioneer will not load and/or unload self-propelled equipment under any circumstances. RISK OF INJURY: Bidder acknowledges that an auction site is a potentially dangerous place and shall be deemed to be there at his/her own risk. No person shall have any claim against the Auctioneer, owners, their agents, employees, or principals for any injuries sustained or for damages to or loss of property which may occur from any cause whatsoever. Bringing children is not advised and must be monitored by an adult. Premier Auctions and its parent company, Wasatch Frontier Group LLC, reserve the right to update or amend our "terms and conditions" without prior notice.
