We consider all sales are final and all property is sold “As-is, Which means .” It is the bidder’s responsibility to examine the conditions and usefulness of all the items purchased. We put our entire attempt to describe all these items to the best of our ability and try to give you the best visual of the item you are bidding on. We portray them as accurately as possible and many times rely on information from the consignor that has made it available to us. If you are dubious about the condition of an item in our auction please do not hesitate to simply call us, we will answer your questions to the best of our ability. Buyers Premium
We have an 20% premium charge for buyers.
Bidding
We consider any bid valid by any person conclusive proof that the bidding person has made himself acquainted with these conditions of sale and has agreed to be bound by them. If payment is not made during posted pickup days, we reserve the right to charge the entire outstanding balance to the credit card provided during registration. Failure to fulfill your bid will result in losing bidding privileges.
Payment
EZ Rugs &Art accept pay-pal, Zelle, Venmo, VISA, Master Card, and American Express and Cash payments. We need an email to process Pay-Pal, Zelle, Venmo. We do not accept, checks, or cashier checks.
We believe authenticity is correct, neither auction house nor seller makes any warranties of any kind with respect to the property. Also, in any event we shall not be held responsible for having made or implied any warranty of description, genuineness, authenticity, attribution, provenance, period, culture, origin source, fitness for a particular purpose, condition and etc.
Auction
The Auction house owners, employees, and consignors reserve the right to bid on any items in the auction. Any person attending auction or preview during removal of goods assumes responsibility for damage or loss to person and property, therefore, release the auctioneer from any liability. Neither auctioneer nor his principal shall be liable by means for any defect in or condition of the premises on which the sale is held including but not limited to personal injury, fire or theft.in the event foregoing are not complied with, in addition to other remedies available to Auctioneer and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, auctioneer at his option can do the followings :
1) resell the property publicly or privately, with the purchaser being liable for the payment of any deficiency plus all costs incurred.
2) cancel the sale, retaining all liquidated damages on all payments made by the purchaser. Auctioneer commission and all other incidental damages will be charged. Auctioneer is acting as an agent and agent only and is not responsible for the acts of his or her principals.
Pickup Times
We are adamant about pick-up times, unless extenuating circumstances occur i.e., acts of nature, etc. All items must be picked up during the specified time. If you are unable to meet the deadline time, DO NOT BID. We can not store your items! If you do choose to bid and fail to pick up your items during the specified times, we will charge the credit card on your file and your items will be forfeited. Also, failure to abide by the pickup times may result in loss of bidding privileges.
Governing Law
The laws of the state of Texas govern this agreement. Any and all lawsuits must be filed in Dallas County courts and the Northern District of Texas.
Privacy Policy
Included in these terms and conditions is the privacy policy as outlined on the Ez Rugs and Art website.
Indemnification
Buyer shall indemnify Ez Rugs & Art against any claims, damages, or liability (including reasonable attorney’s fees) as a result of an injury or other harm suffered by any person and stemming from the sale, whether arising before, during, or after the sale. The buyer agrees to indemnify Ez Rugs and Art for any damages or losses. Buyer will not hold EZ Rugs Art, its owners, affiliates, or its employees, liable for accidents, injury, theft, or incidents related to this purchase.
Intellectual Property
By submitting any images to Ez Rugs & Art for the purpose of sale, marketing, or any use on our website, you grant Ez Rugs & Art worldwide non-exclusive license to use the image on any and all marketing collateral digital, printer, or otherwise.
Trademarks
All trademarks, service marks, and copyrights owned by Ez Rugs and Art shall not be used without written permission. This includes the name Ez Rugs & Art, Ez Rugs & Art Auction, any and all website URL addresses, and abbreviations of such.
AuctionFlex
AuctionFlex sets up each user on this website and collects all user information. EZ Rugs & Art do not have access to user names and passwords. AuctionFlex does provide Ez Rugs & Art with a user name, contact information, and credit card information provided during the registration processes. User information will not be sold to any third party advertisers by Ez Rugs and Art.

Also, pickup alternatives for on-site auctions: All the below handling fees apply to transport to Gallery (Forney, TX) for pickup. We will bring your winning small lot bids back to our Gallery in Forney and store until the next Gallery pickup. Pick up schedule - alternating Mondays 12:00 noon to 7:00 p.m. & Tuesdays 10:00 - 4:00 p.m.
The handling fee is applied to all shipping. Bring back Items not picked up at the designated Forney Gallery pickup following your sale purchase will be donated or possibly resold. We have limited storage space and can not hold on to these items any longer than two weeks. Possible suspension of bidding rights may occur at management discretion if items are stored and not retrieved.
