Acceptance of Terms
By participating in the online auctions hosted by West Section Auction Services LLC ("WSAS"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please refrain from bidding.
Auction Details
Each lot listed in the auction will include an Information Lead that outlines what is being auctioned. The description explains what is included in each lot, and the photos are provided for reference only. Additional items may appear in the background of these photos. It is the bidder's responsibility to review the Information Lead and description carefully and contact WSAS with any questions before placing a bid.
Winning Bidders and Invoices
Notification: Winning bidders will receive an email with an attached invoice detailing the lots won and the balance owed. This email serves as your formal notification.
Bid Status: On HiBid, once a lot is sold, the status may read "You may have won or been outbid." In the event of a tie with maximum bids, the bidder who entered their maximum bid first (time-wise) will be the winning bidder.
Reserve Price and No Sale
WSAS reserves the right to declare an item as a no sale if the reserve price is not met. If the reserve is not met, you are not the winning bidder.
Reserve Price Disclosure: Anyone has the right to call and ask for the reserve price of any item in the sale.
Payment and Pickup
Forms of Payment:
For amounts under $15,000, accepted payment methods include cash, cashier's check, or wire transfer. All items must be paid for within 2 business days to avoid a finance charge. No items are allowed to be removed until paid in full. Failure to comply with the terms and conditions may result in being banned from future auctions and be subject to legal action.
For amounts over $15,000, wire transfer is the only accepted payment method. WSAS does not charge fees for wire transfers; however, your bank may impose its own fees.
Pickup Deadline: All items must be picked up within 14 days from the auction closing date. A storage fee of $25 per day will be charged for each additional day beyond the initial 14 days, unless other arrangements are made. After 30 days from the auction closing date, if the item is not picked up or no arrangements are made, the item will be considered forfeited and become property of WSAS, regardless of payment status.
Sellers with No Sale Items: If an item is not sold in the auction, the seller will not receive a check via mail. The check will be held at our office until the unsold items are picked up.
Shipping and Certificates of Title
Shipping: Shipping is available at the buyer’s expense and at the sole discretion of West Section Auction Services. Buyers are responsible for all shipping costs and must arrange for pickup or shipping directly with WSAS if needed. WSAS reserves the right to refuse or limit shipping requests at its discretion.
Certificates of Title: Certificates of title will be mailed within 10-20 business days upon clearance of payment into our account, regardless of the payment method used. Buyers are responsible for any back registration.
Titled Items: There is a $50 title fee for selling vehicles. Sellers must bring the title and seller’s permit with them when delivering their items. You must obtain the seller’s permit yourself from the Treasurer's Office or the DMV website—WSAS cannot do this for you.
Item Inspection and Condition
Inspection: All descriptions and conditions are deemed reliable but not guaranteed. It is the buyer’s responsibility to inspect the property before purchasing. If the lot is not on the auction lot, arrangements can be made to view the items.
Condition: All items are sold "as is" and "where is," with no warranties or guarantees expressed or implied. We list the odometer readings but do not guarantee the functionality of any items.
Liability and Responsibility
Security and Damage: As the highest bidder, you assume full responsibility for the item(s) purchased from the time of sale. WSAS is not responsible for damage, loss, or theft of items, and there will be no refunds for stolen or missing items. WSAS is also not responsible for the acts or representations of sellers.
Indemnification: You release and indemnify WSAS, its employees, agents, and assigns from any liability or causes of action.
Insurance
Insurance: It is your responsibility to obtain insurance for the items being sold. Your items are not covered by WSAS insurance while they are on our lot. The seller is responsible for ensuring their own property until it is sold.
Bidding and Contractual Obligations
Bidding Age: All bidders must be at least 18 years old.
Binding Contract: Bids cannot be retracted and represent a binding contract between the bidder and WSAS.
No Refunds or Exchanges: All sales are final. No refunds, exchanges, or refusals are allowed.
Loading Services
WSAS offers loading services to buyers at no charge. Buyers must bring appropriate trailers or equipment for loading. WSAS reserves the right to refuse loading if deemed unsafe. Buyers are responsible for any damage to themselves, the property being loaded, or the property onto which their purchases are being loaded.
Technical Problems
Technical Issues: In the event of technical problems with the auction software or server, WSAS reserves the right to extend bidding, continue bidding, or close bidding. WSAS and the sellers are not responsible for missed bids due to technical issues. Registered bidders will receive emails with any relevant information.
Public Auction
Eligibility: This is a public auction. All qualified bidders may participate, including WSAS, its owners, family members, and employees. WSAS may bid on behalf of the seller up to the reserve price, whether or not the reserve is published.
Sales Tax
A State sales tax of 4.2% and 2% City of Avon Sales Tax will be charged according to the law.
Payment Issues
Stopping Payment: Stopping payment on checks is considered an intent to defraud.
Bidder Responsibilities
Property Information: It is the bidder's responsibility to be informed about the property and associated costs before bidding. Bids are binding contracts between the bidder and WSAS.
Purchase Money Security Interest / UCC Filing
Lien Disclosure: Please inform us of any lien or security interest you have against any items being sold. This includes any outstanding purchase money security interest or UCC filing.
Reserve Pricing
Reserve Pricing: Reserve pricing is allowed on items. The reserve must be disclosed at the time the item is delivered to the lot.
Reserve Price Disclosure: Anyone has the right to call and ask for the reserve price of any item in the sale.
Seller Commission
Sellers will be charged a commission on the final sale price of their items as follows:
Up to $1500: 18% commission
$1501 - $25,000: 10% commission
$25,000 and over: 7% commission
Removal of Items from Consignment
No Removal from Sale: Once an item is listed for sale in the auction, it cannot be removed from consignment.
No Buyer’s Premium
There will be no buyer's premium added to the final hammer price of any items sold in the auction.
