Terms & Conditions for Statesman's Estate: The Distinguished Furniture & Collectibles Auction All items are sold “as is, where is” with no guarantees expressed or implied. Once an item is announced as SOLD, the bidder is responsible for it. Buyers are responsible, at their own expense, for the removal of all purchased items from the auction site. It is the buyer’s responsibility to inspect all items prior to bidding. All sales are FINAL. 1889 Auctions, sellers, and service providers are not responsible for lost or insufficient internet or telephone service that may limit the buyer’s ability to participate in the auction. All purchases must be paid in full in U.S. funds at the conclusion of the auction and prior to the removal of any items. We are not responsible for errors or omissions in any listings, whether online or in print. A 15% buyer’s premium will be added to the final bid amount. 1889 Auctions shall not be responsible for any damages caused during packing, loading, or transporting of items once purchased by the buyer. Decisions made by the auctioneer are final. All onsite auctions require a valid ID for registration. Payments made by credit card will incur a 5% processing fee added to the final price. Payments accepted must be cash or credit—no personal checks will be accepted. Announcements made on the day of the auction or at the time of sale take precedence over any other advertising or representations. Some items may be subject to a reserve or minimum price. Sales tax of 6.2% will be collected where applicable. By registering for this auction, the buyer agrees to be bound by all terms and conditions. In the event of non-payment, the buyer agrees to reimburse 1889 Auctions or the seller for collection and court costs, including attorney fees. Interest will accrue on the unpaid balance at 21% annually. Any legal disputes shall be settled in the appropriate South Dakota court pursuant to South Dakota law.
