AUCTION TERMS AND CONDITIONS
There is a 10% buyer's premium up to $7500.00 per each individual item, buyer's premium over $7500.00 capped @ $750.00.
The buyer is responsible for the $75.00 documentation fee on -all "Titled items". Meridian Equipment performs "Title Purpose Only" transfers. The buyer is ultimately responsible for obtaining the proper registrations, licenses, etc.
All prospective buyers must be at least 18 years old and are required to register with Meridian Equipment Auction prior to bidding. By using the bid number, the bidder acknowledges they have received, read, and understands and agrees to be bound by the terms and conditions of the auction either on the bidder's agreement or posted at the auction facility.
ALL SALES ARE FINAL UPON AWARD OF ONLINE BID.
PAYMENT: FULL PAYMENT MUST BE MADE NO LATER THAN 5 PM, WEDNESDAY JANUARY 15, 2025. PAYMENT METHODS INCLUDE CASH, CHECK, WIRE TRANSFER (SUBJECT TO $35 FEE), CREDIT AND DEBIT CARDS (SUBJECT TO 4% SURCHAGE). AFTER THE AUCTION CLOSES YOU WILL RECEIVE AN EMAILED INVOICE IF YOU DO NOT RECEIVE INVOICE, PLEASE CONTACT OUR OFFICE ASAP. PAYMENT NOT RECEIVED BY THIS DATE WILL HAVE CREDIT CARDS ON FILE CHARGED SUBJECT TO ALL SURCHARGES
The auction will be conducted by offering the items by lot number, either single lots or groups. Please note some items are sold bid price x quantity for the total price. The bidder with the highest accepted bid price will be the purchaser subject to all additional fees and taxes. All bids are final and non-reversible. The purchaser accepts the lot when the online bid is placed. ALL SALES FINAL.
REMOVAL: ALL ITEMS MUST BE REMOVED NO LATER THAN 4:30 PM, WED JANUARY 22, 2025. REMOVAL HOURS: 8:00 AM TO 4:30 PM MONDAY THRU FRIDAY AND 8:00 AM TO 11:30 AM SATURDAY JANUARY 18th only. CLOSED SUNDAY.
Removal of all items shall be the sole responsibility of the purchaser. Loading assistance is provided as a courtesy; however, purchaser assumes all risk and responsibility for loading and removal of purchases. Auctioneer reserves the right to require proof of adequate insurance coverage from any purchaser items requiring dismantling, rigging or hot cutting. Purchaser agrees to indemnify and save harmless both, consignor and Auctioneer, its officers, directors, employees, agents, and attorneys against any damage caused by the acts of purchaser. All items must be removed from the auction facility within 7 days after the auction date. If for any reason purchaser fails to remove any purchase within the time specified, the purchase shall be deemed abandoned, and Auctioneer at its sole discretion may resell the items. Purchaser shall be liable for any rent incurred or damages suffered by Auctioneer because of purchaser's failure to remove any item. Failure to remove items will result in a rental / storage fee of not less than $25 per item per week
REMOVAL: No purchase may be removed until the conclusion of the auction. Following conclusion of the auction, merchandise purchased must be removed from the premises within the time limits provided. Any merchandise not removed within the time limit shall be deemed to have been abandoned by the purchaser and ownership thereof reverts to the seller.
WARRANTY DISCLAIMER: Everything will be sold on an as-basis without any warranty or representation whatsoever. This includes any and all faults as to the merchantability of fitness for a particular purpose. All sales are final. Purchaser agrees to pay all cost of removal and purchaser does hereby indemnify and hold harmless auctioneer and seller for any and all damages, claims or liability for injuries to persons or property caused by the removal of items purchased. The principle, the auctioneer, advertising coordinator or any of their agents make no express or implied warranties of any type.
ADVERTISING DISCLAIMER: All information obtained for items are deemed to be relievable and accurate however not all faults or errors may be known or listed. The principal Meridian Equipment Inc. the Advertising Coordinator, and All their Agents Shall not be responsible for any errors or omissions. IT IS HIGHLY RECOMMEND THAT ALL ITEMS BE THOROUGHLY INSPECTED BEFORE BIDDING.
ONLINE BIDS: Online bidders will not have any claim against Meridian Equipment Inc for any failure to award bids, failure to submit bids and any errors of the bidding platform. It may be possible that the bidding platform shows an item award to a customer: However, we reserve the right to make any corrected included withdrawing bids made in error.
No claim will be considered for allowance or adjustment or for the rescission of any sale based upon failure of the property to correspond with any standard expected.
While quantities, descriptions and capacities are believed to be correct there are no guarantees and the auctioneers, owners and advertising counsel will not be held responsible for any written or verbal discrepancies or inaccuracies whatsoever.
Overages or shortages above or below estimated counts will be adjusted. However, such adjustments must be made before removal of merchandise from the premises.
The Auction reserves the right to group lots, make lots smaller or to add or delete or to change numerical count.
Bidders with poor bidding history will not be allowed to place bids in the auction.
