AUCTION TERMS & CONDITIONS BIDDING: • All items are sold As Is, Where Is with no exceptions • All Bids Are Final - All Sales Are Final - No Refunds - NO Returns - NO Exceptions • We report non-paying bidders to the national database to exclude them from further online auction bidding. • All of our auctions have a soft close. • You must register to bid on this auction. • You must be 18 years of age or older to register. • Software and server technical issues: ThriftTank is not responsible for any technical difficulties related to the server, software or any other online auction related technology. ThriftTank reserves the right to resolve any bidding dispute by extending bidding, continue bidding or closing the bidding. Neither ThriftTank or any company providing the software shall be held responsible for missed bids or the failure of any software to function properly for any reason. • Auctioneer reserves the right to reject the bid of anyone who is not a registered bidder. • Any Announcements made on day of sale supersede all printed material. ITEMS IN LOTS: • Any questions should be asked prior to bidding. • ThriftTank has attempted to provide accurate descriptions of all items, however it is the bidder’s responsibility to examine pictures and read the descriptions thoroughly to determine the condition and suitability of each lot. • All printed statements or descriptions by ThriftTank’s staff are provided in good faith, based solely on visual impression and are matters of opinion and are given solely for identification purposes and does NOT create any warranty expressed or implied. ThriftTank is not responsible for incorrect listing information if any. • WARNING: ALWAYS READ THE ITEM LOT DESCRIPTION. Do not assume a lot consists of more than one item simply because you may see or the item may be connected or pictured together. You are bidding on the described item only, no other items in the picture are included. All Property Sold "AS IS", "WHERE IS", and "WITH ALL FAULTS". • All property is being offered and sold in its “as is/where is” condition at the time of the auction, with all faults, including any hidden defects of any nature. • Neither ThriftTank nor any seller makes any representations, warranties, or guarantees whatsoever, express or implied, regarding the nature, value, source, authenticity, fitness, merchantability, and/or any other aspect or characteristics of such property. No statement anywhere, whether express or implied, including verbal statements made by ThriftTank, will be deemed a warranty or representation by auction firm or any seller. Without limiting the generality of the foregoing, there are no warranties of title, non-infringement, authenticity, origin, merchantability, or fitness for a particular purpose, all of which are expressly disclaimed. • You acknowledge and agree that you cannot rely on, and you have not relied on, any representation, warranty, or guaranty made by any seller or anyone acting as agent of a seller (including ThriftTank), orally or in writing, about any lot, that you are relying solely on pictures and descriptions in determining whether to bid, in determining the amount of your bid(s), and in bidding. It is your responsibility to determine condition, age, genuineness, value, or any other determinate factors regarding any lot on which you bid. • Any further questions you have you will need to contact ThriftTank prior to bidding. BUYERS PREMIUM: • A 15% buyer’s premium will be added to every item sold. • Includes the cost of processing credit cards PAYMENT INFORMATION: • The credit card you registered with will be charged after the auction closes. • Information on Credit Card MUST match registration. • PAYMENT ACCEPTED FOR THIS AUCTION: Credit cards only. • If you are having items shipped, we will be charging for shipping and handling after your item(s) has been packed. DECLINED CREDIT CARD: • If your credit card is declined at reconciliation for any reason whatsoever, you will be charged a $10 processing fee to run another credit card or to run the same card at a later time OR to pay in cash without prior authorization. NO CREDIT CARD CHARGEBACKS: • YOU(bidder) agree that such YOU(bidder) will not, under any circumstances, initiate a credit card chargeback with respect to any purchases at the Auction. • YOU(bidder) further agree that if, in violation of these Terms and Conditions, a credit card chargeback is initiated, these Bidder Terms and Conditions will be conclusive evidence of YOUR(bidder) agreement not to initiate a credit card chargeback; and YOU(bidder) acknowledge and agree that on the presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse or deny any credit card chargeback, and will re-credit all amounts to or for the account of ThriftTank. • If, in violation of these Bidder Terms and Conditions, YOU(bidder) initiate a credit card charge back, even if successful, YOU(bidder) will remain liable for all purchases made at the Auction, and YOU(bidder) will be responsible for all costs and expenses, including attorneys' fees, incurred by or on behalf of ThriftTank and/or any Seller(s) in challenging the credit card chargeback and in collecting payment. • YOUR(bidder) agreement not to initiate a credit card chargeback is a condition to YOUR(bidder) Registration as a Bidder, and for the privilege of bidding at the Auction, and is being made as an inducement for ThriftTank to accept YOUR(bidder) Registration and to permit YOU(bidder) to bid at the Auction. ThriftTank is relying on YOUR(bidder) agreement not to initiate a credit card chargeback in accepting YOUR(bidder) Bidder Registration and in permitting YOU(bidder) to bid at the Auction. SHIPPING: • Shipping is ONLY available if the Shipping Icon is on that lot. If YOU (bidder) bid and win a lot that is not indicated shippable YOU(bidder) are still responsible for paying for that lot OR there will be a $20 inconvenience fee, whichever is cheaper. • You will be charged for the shipping cost after the item(s) have been packed and ready to ship. You will be charged actual shipping cost plus $5 handling fee per lot. All items shipped will include insurance in the shipping cost. • Purchaser does hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal or shipping of items purchased. • If you win several lots, some items may be able to be shipped together but others may come in a separate box. It will be determined via our discretion. PICK-UP AND REMOVAL: • All items are to be picked up during normal pick up times designated by each auction. Items not picked up during that time will be subject to forfeiture with no refund. Items will be resold, disposed of, or donated. • No items will be picked up until ALL items are paid for in full. • YOU(bidder) are responsible for pick-up and removal of Lot(s) purchased by YOU(bidder). • Pick-up and removal dates and times will be stated on YOUR(bidder) invoice and/or will be posted in the auction description. • Unless otherwise agreed, YOU(bidder) are solely responsible for the disassembly, rigging, removal, shipping, and transportation of each Lot purchased by YOU(bidder). Disassembly and removal must be done in a workman like manner, and YOU(bidder) will indemnify and hold harmless both Auction Firm and Seller(s) against any and all damage caused by YOU(bidder) or YOUR(bidder) employees, agents, representatives, or independent contractors in connection with the disassembly or removal of any Lot(s). Any and all damage, including, without being limited to damage to land or buildings, caused by YOU(bidder) or by YOUR(bidder) employees, agents, representatives, or independent contractors, will be repaired by YOU(bidder), or at YOUR(bidder) expense, to the satisfaction of ThriftTank and Seller(s). • YOU are responsible for insuring all Lots purchased by YOU. • Possession and risk of loss will pass to you at the point of shipment. Any claims after shipment is made will be between YOU(bidder) and shipping company only. • YOU(bidder) AND/OR YOUR(bidder) REPRESENTATIVE MUST HAVE PRINTED PAID INVOICE BEFORE LOTS ARE RELEASED. ID maybe required if you or your representative is not known by ThriftTank or yard persons.
