As ever we guarantee that everything works right out of the box or your money back.
We don't do "As is where is" auctions. However we cannot test some of the parts but we will still offer a money back guarantee on everything, unless stated.
We require that all invoices are paid for by 1pm on the Saturday following the auction.If you haven't contacted us and arranged payment by that time we will offer your lots to the next highest bidder.
It is your responsibility to ensure that you have a valid credit card registered with hibid at the time of the auction and that your credit card can be billed.

Terms and Conditions
AUCTION TERMS & CONDITIONS
Terms and conditions to bid and buy. Please read these terms carefully. These terms, as modified or amended from time to time, are a binding contract between Niagara Auctions.ca ("we" and/or "us", etc.) and you ("you", "bidder", "purchaser"). While we endeavour to make sure all information is correct, such as descriptions, shipping fees etc we cannot guarantee that they are 100% accurate at all times. By bidding on this auction you agree to abide by whatever NiagaraAuctions.ca might decide is correct to be correct.
REGISTRATION & IDENTIFICATION
At the time of registration, we collect information about you to verify who you are before you can bid. All bidders must be of legal age to bid.
PAYING FOR YOUR PURCHASES
We accept Cash (Exact amount only: Change is not available), Debit, Etransfer, Visa and Mastercard. IF YOU INTEND TO PAY CASH YOU STILL NEED TO REGISTER WITH A VALID CREDIT CARD. We accept cash, debit or credit card on the day of pick up. Etranfer must be paid on the day before pickup If you fail to show up for your item(s) we will still bill your credit card. ***PLEASE NOTE THAT CREDIT CARD BILLINGS ARE BILLED UNDER ELITE PRODUCTS. YOU WILL SEE ELITE PRODUCTS ON YOUR CREDIT CARD STATEMENT*** If we do not receive any direction from you before 12pm on the Saturday immediately following the auction then your registered credit card will be automatically billed including any applicable shipping charges. If you initiate a chargeback against us without first contacting us then you may be subject to up to a $200 administration fee. If our system generates an invoice in your name this constitutes a binding agreement to purchase the goods regardless of who entered your credit card information. If you have not contacted us to arrange payment by the specified time and we cannot bill your credit card then you may be subject to a $30 administration fee.
BUYERS PREMIUM and TAXES
A 15% Buyers premium and HST is applied to all invoices. Additional charges may be applied for items held or abandoned as outlined in the terms and conditions.
REVIEWING THE STATUS OF YOUR BIDS
During an auction you can check the status of your bids at any time. No bids can be withdrawn after the auction for any reason. We do our best to ensure all items work or are complete and have all the right pieces. New items are new but may still be missing parts from the manufacturer. We have a no quibble guarantee that your items will wokr as intended at their initial use. All bids are legally binding and enforceable in Ontario, Canada.
BIDDING NOTIFICATIONS
You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale.
WINNING NOTIFICATION & INVOICING
All winning bidders will receive an e-mail invoice within 24 hours of the auction closing. Niagara Auctions.ca does not take responsibility for buyers security on their email accounts. Be advised that your email security may prevent our emails from going to your inbox. We enourage bidders to mark our email address as safe. It is strongly advised to check on Hibid to see if you have won your items. "MAY HAVE WON" means you HAVE won" It is the bidders responsibility to identify if they have won items.
PICKUPS & REMOVALS
Dates and times for pickups will be posted in the auction details of the particular auction you are bidding on. It is your responsibility to review the pick-up schedule prior to bidding on any item(s). WE WILL SHIP AT A FLAT RATE DEPENDING ON WHERE YOU LIVE. We will ship multiple items for one flat rate. You need to email us to clarify your shipping costs before 12pm on the day the auction ends. Response is very quick. We are flexible on pick up times as long as you contact within 24hrs of the auction. If there is no contact from you during the first 48hrs after the auction we will consider your items abandoned but you are still liable for payment. Shipping takes place on our timeline. Although we endeavour to ship your items as quickly as possible there are no guaranteed delivery times. We also deliver during daytime hours (9am - 5pm). Porch delivery is just that delivery to your porch without notification during daytime business hours. If you wish to know which day your lots will be delivered please email us. We do not enter anyones home, back garden or apartment building. We are not responsible for any items left on your doorstep. We will give you ample warning of your delivery day when you respond to the invoice we send out. If you chose to abandon an item after any auction, if your items are paid for but not picked up within 7 days then we consider this abandonded, you will forfeit those items. You can contact us at anytime during those 7 days to arrange an alternative pick up though. We do not initiate contact other than sending you an invoice, it is your obligation to contact us if you require an alternative payment option to a credit card and an alternative pick up day or time to the ones advertised. Disposable fees may apply. If you fail to pay within 48hrs then your lots are considered abandoned and you will be banned from any further bids on any of our future auctions. It is your responsibility to make sure that we can bill your credit card. We are flexible and understand that credit cards can be locked and payments you have made may not be proccessed in time and we will contact you for an alternative method of payment, but we will only do this once. Alternative pick-up is an option but is subject to Niagara Auctions.ca scheduled availability and may be denied. It is your responsibility to ensure we have confirmed your request for an alternative pick-up date/time. Alternative pick-up's must be requested through email at niagaraauctions.ca@gmail.com. If an alternative pick-up is arranged but you fail to show up or arrive on time , you will be charged a taxable holding fee of $50.00 in addition to the invoiced cost of the item(s). Alternative pick-up cannot extend beyond seven (7) days of applicable auction close. If item(s) with alternative pick-up arrangements are not picked up according to the arranged time (in accordance with Niagara Auctions.ca), the item(s) will be considered abandoned, will be disposed, and a disposal fee may apply. You will be banned from any further bids on any of our future auctions. You are required to bring any assistance you will need to pick up your items.Niagara Auctions,ca staff and representatives will not assist in lifting, loading, fixing, packing or unpacking any of your item(s) or any piece or part of your item(s). Successful bidders will be notified of the pick up address after the auction closes.
SHIPPING VIA CANADA POST OR OTHER COURIERS
When shipping by Canada Post the default service is expedited because this is the cheapest service that is tracked. We also insure all packages shipped for there retail value. We will not be held liable for any packages lost or damaged while in the care of Canada Post. It is up to the customer to contact Canada Post if they wish to start a claim. We will not issue you a refund for any items lost or damaged by Canada Post or any fees or taxes associated with invoices shipped via Canada Post.
FREE PORCH DELIVERY
Only invoices adding up to $20 or over before taxes qualify for free porch delivery. If you request porch delivery and your invoice does not add up to $20 we will round it up.
We will not accumulate invoices until the amount adds up to $20, we will automatically assess and deliver (at our convenience) a $10 delivery fee for any items not picked up within 7 days of the auction closing.
CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE
Our very best efforts are made to ensure all items are represented accurately in the photographs and descriptions; we offer no warranties but we do guarantee items will be as described and will work as advertised on their initial use. We are happy to refund or issue credit for any items you feel have been misrepresented, but you must contact us within 48hrs. No refunds or credits will be given for items that have been misued or damaged by the bidder. Bidders are strongly encouraged to read the full description of each lot prior to placing any bid.WE CANNOT OPEN EVERY SINGLE BOX AND CHECK EVERY SINGLE PART. but we do our best. Please don't assume we have sold you a damaged or misrepresented item deliberately. We are happy to try and rectify any issues you might have with our lots. Refund claims MUST be made within 48 hrs of auction pick up by emailing niagaraauctions.ca@gmail.com. Items may be examined at the time of pick up outside of our facility and Niagara Auctions.ca can be notified at that time. Note: Items with 'Sold as Is' written in the lot details, are absolutely non-refundable. Please exercise caution when bidding on these items. Please be aware that many of the items we sell require assembly and is the sole responsibility of the buyer. We will not accept items for return unless they are in their original packaging. Packaged correctly. We strongly advise buyers to check the contents of the box against any instructions that are in the box before the items are put together. We will not accept any items for refund that have been put together and then taken apart to be returned. Buyers are strongly encouraged to review the details of any lot they intend to bid on. Bids cannot be retracted. Where there is conflicting information between the item(s) details and the photograph, the posted written details prevail. CLAIMS Please inform NiagaraAuctions.ca within 48hrs of any claims you wish to make.
PERSONAL & PROPERTY RISK
The Buyer expressly agrees to indemnify and save Niagara Auctions.ca and their Sellers/Consignors harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including negligent acts or omissions of Niagara Auctions.ca or anyone acting on his/her behalf in connection with or arising out of an auction.
ADDITIONS & DELETIONS
We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction.
AUCTION RECORDS
In the unlikely event of a dispute, you agree to accept as true the information that we have in our records. Please note that some pictures are for illustration purposes only to give the bidder a better idea of the product they are bidding on. Pictures used for illustration purposes may contain items that help show what the product is for or looks like. Only the item in the description is for sale and you are only bidding on the item(s) in the description not item(s) you may see in the pictures.
ONLINE BIDDING
For online bidding, please keep in mind that the connection to the internet is not absolutely reliable. Connection problems can happen between or within our office, between or within the software servers, and/or between or within bidders and potential bidders. We cannot be held responsible for any of the above possible issues, or for your bids not making it into the system.
SOFT CLOSE
Items close at regular intervals. To prevent a bidder from 'sniping' all bids made in the last minute of the auction will force an item to stay open for an additional 3 minutes. This will continue until all bidding has ceased.
STRATEGY
We recommend that all bidders put in their maximum bid when placing a bid online. This does not mean you will have to pay the maximum amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.

Niagara Auctions.ca attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog, item descriptions or pictures within. Questions regarding item(s)/lots can be asked by emailing niagaraauctions.ca@gmail.com. By placing a bid, in any capacity, you signify that you have examined the items as fully as you desire and have had the opportunity to ask questions and receive answers from Niagara Auctions.ca that you deem adequate. If you are not satisfied with the information provided regarding any items or lots, do not bid on the item(s)/lot in question. Any listed retail values and/or prices are approximations only. It is your responsibility to do your own due diligence in researching values. Buyers are strongly encouraged to review the details of any lot they intend to bid on. Bids cannot be retracted. When you register for any of our auctions for the first time your email address is added to our mailing list. We only use your email address to notify you of any information about our auctions or special promotions we may be running. We do provide your email address to any other companies.
