This is a legal binding contract between you, referred to as the “Bidder” and Coughlin’s Auctions referred to as the “Auction House”. 1. Item Condition: All items are sold “AS-IS” and “WHERE-IS.” The Auction House does not guarantee the condition or functionality of any items. Descriptions provided are for informational purposes only and are not guaranteed to be accurate. The Bidder accepts responsibility for inspecting items during preview days. The Auction House is not liable for any issues related to broken or damaged items once they are sold. 2. Loading Items: The Bidder is responsible for bringing assistance to load large items. The Auction House does not provide assistance, packaging materials, or other supplies for loading. Any damage caused during the removal of items is the responsibility of the Bidder, and any costs incurred for damages will be charged to the Bidder's credit card. If Auction House staff assist with loading, they are not liable for any damage to items or property. 3. Picking Up, After Pick Up Fees, and Storage Fees: The Bidder agrees to pick up all items on time, as specified in their invoice. If items are not collected within the scheduled time, a storage fee of $5 per lot ($20 minimum) will be added, covering up to 5 business days. At the start of the next week, if the items are still not picked up, we will charge the same storage fee outlined above which covers one additional week of storage. If after 10 business days the items are not picked up they will be considered abandoned, with no refund issued. We will assess a disposal fee of $5 per lot ($25 for furniture). There is no storage available for auction held off site (not at a company owed auction house location). Any additional storage, approved by the Auction House, will incur a $5 per day per lot charge. Unpaid fees will be charged to the credit card on file, and failure to resolve payments may result in legal action and/or sending the account to collections. 4. Payment: Full payment of the invoice is required. Credit cards on file will be charged after the auction. For invoices exceeding $2000, payments must be made via bank transfer. Bidders intending to pay in cash must indicate this during registration. We may charge the card on file for a deposit any invoice if we choose. Failure to pay for your entire invoice will result in the auction house taking legal action against the full invoice amount plus any other storage and/or removal fees. We reserve the right to ask anyone to pay via wire transfer. For items won on www.LiveAuctioneers.com, payment may be different, as we may ask for payment via an invoice, phone call or text. 5. Buyer’s Premium and Sales Tax: A buyer’s premium of 18% will be added to the final sale price of each item. Additionally, Michigan's 6% sales tax applies unless a valid sales tax license is provided before the auction's closure. 6. Sales Tax Exemption: If exempt from sales tax, Bidders must submit their tax-exempt license before the auction concludes. No refunds on sales tax will be given after payment. 7. Text Messaging Services: The Auction House may send SMS notifications. The Bidder is responsible for any charges or data fees. 8. Inspection/Preview Day: Bidders are encouraged to inspect items during preview periods. The Auction House does not offer refunds, returns, or discounts for dissatisfaction with items post-purchase. 9. Bidder Information: Bidders must promptly update the Auction House with any changes to contact or credit card information. 10. Bidding Errors and Software Malfunctions: In the event you have made an error bidding, the Bidder must contact the Auction Houses immediately. Bidding errors cannot be fixed after the bidding has closed on those items. If you have made a bidding error on the last day of the auction, we may not be able to fix those issues as we may not see your request before the auction closes. In the event we cannot fix those issues on the last day of the auction, you will responsible to pay your invoice amount. The Auction Houses will not assume any bid is an error. In the event there is a malfunction within the software the Auction Houses is using, issues with clerking the auction, the Bidder will not hold the Auction House accountable. 11. Lot Removal: The Auction House reserves the right to remove any items or lots, even after bids have been placed, without notice. 12. Staggered Closing and Soft Closing: The auction follows staggered and soft closing methods to ensure fairness. The Auction House may also host live online auctions (simulcast auctions), which could adjust the time intervals between lot closures. 13. Bidder Notification: After the auction, the Bidder will receive an email listing their winning items and amounts owed. Bidders must check their email, including the spam folder, as no additional contact will be made. 14. Third Party Liability: The Auction House is not liable for actions by third parties, including other Bidders, clients, or any criminal acts like theft or vandalism. 15. Auction House Liability: The Auction House is not responsible for any injuries or damages that may occur during preview or pick-up. Bidders must exercise caution on-site. 16. Legal Recourse: Disputes must be settled through mediation in Macomb County. Bidders are responsible for all mediation costs. The Auction House will use all legal means necessary, including small claims court, to recover unpaid invoices or fees. The Bidder is responsible for all fees incurred in our attempt to retrieve money owed including, but not limited to, attorney fees, court costs, our time on a per hour basis, ect. 17. Client Rights: The clients of the Auction Houses have the right to bid on and win any items they have put to auction. The Clients agree to pay for all items and buyers premiums associated with any lots they have won. On occasion, the Auction House may bid on behalf of the client to reach predetermined reserve price. 18. Modifications to Terms: These Terms and Conditions can be changed at any time without notice. Please read these terms and conditions each time you register for one of our auctions. These terms and conditions supersede any other agreement between you the Bidder and the Auction House has made in the past or present. 19. Lot Descriptions: You are bidding on what is described. There may be items in the background, but those are not included in the lot unless told otherwise. 20. Retail Items: Items may have any barcode or tag marked through or removed after the photos are taken to prevent returns. The Bidder agrees not to return any auction items to a retailer. 21. Contest Rules: To enter a contest, Bidders must register for the auction associated with the giveaway. Only one randomly selected winner will receive the prize. The winner must pick up their item within the designated time frame. No shipping is available for contest items. 22. Covid-19: The Bidder holds the Auction House harmless for any illness or virus contracted at auction-related events or activities, including but not limited to pick-up or preview events. 23. Credit Card Disputes: Bidders agree not to dispute charges made by the Auction House. Any disputed charge will incur a $250 fee to cover the cost of addressing the dispute. 24. Shipping: You do not need to contact us if your out of state and need shipping. We will assume you need shipping for all out of state zip codes and if we have any questions, we will reach out. If you need shipping and you are local, you will need to reach out to us and let us know. All shipping policies are below: SHIPPING CAN GET EXPENSIVE. WE ENCOURGE YOU TO READ OVER OUR SHIPPING POLICIES BEFORE BIDDING. We charge for labor, packing supplies, insurance, and price of the label itself. We do not provide quotes for shipping. Cost of Labor: We charge a minimum of $15 per lot in labor. If your lots are: large, bulky, breakable, lots of small items, lots of large items, or require any additional or special work, this labor portion will rise. Cost of Packing supplies: These are on a per box basis, and the pricing below is in addition to the labor pricing. Envelope: $2 each USPS Boxes: $5 for packing supplies and tape (free box) Small to Medium sized USED boxes: $5 for box, and packing supplies (bubble wrap, cushions (if used), and/or peanuts. U-Haul Lamp Box: $17 for box, and packing supplies (bubble wrap, cushions (if used), and/or peanuts. U-Haul Mirror Box: $23 for box, and packing supplies (bubble wrap, cushions (if used), and/or peanuts. NOTICE: If we are using this style box is because we shipping something large and flat like paintings, prints, mirrors, ect. For these, we charge $75 in labor plus the cost of shipping, insurance, and materials. U-Haul or Home Depot Medium or Large Box: $15 for box, and packing supplies (bubble wrap, cushions (if used), and/or peanuts. Custom Box: Pricing will vary and depends on how long it takes us to source the box and/or make the box, and will depend on materials used for packing. Freight: We don’t offer freight shipping in-house. If you purchasing very large items that need to be created and sent via freight, you can contact Craters and Freighters for a quote at 586-268-4102. You are responsible for all shipping costs with them. We charge $25 for the time it takes to work with them, and up to 1 week of storage until they can pick up your items. (These costs are on a per box basis, regardless of how many lots you have won or how much packing material was used.) Flat Rate Labor Pricing on Paintings and Prints: For any painting, print, or anything similar, we charge $75 in labor plus the cost of shipping, insurance, and materials as outlined above. Additional Options: Removing prints from frames: $50 (if possible, as some mats are glued to the print). If we attempt and it can’t be done without damaging the print, there is still a $50 fee and we are nor responsible for damage done to the art piece. Meeting a shipping of your choice to pick up large/bulky items: $25 For international shipments, you are responsible for all taxes associated with the shipment of the items to you. Firearm Shipping: You must send us a copy of the FFL of the person you would like a firearm shipped to. We can not ship until we have that license on file. For firearms, we charge a minimum of $25 per firearm in labor to ship plus all the actual costs of shipping (noted above). Shipping Discount: If you purchase multiple small lots (like jewelry, coins, signed flats, or anything else that fits into a USPS large box and not breakable, we will provide a discount on our labor at a new rate of $10 per lot in labor plus the cost of shipping, insurance and materials. If we have to use 2 or more boxes, no discount applies. We use our own labels, and will not allow you to send your own label. We are not responsible for any tariffs or country taxes when items are shipped outside of the country. How Shipping insurance works: Every package we send out will have insurance on. In the event something gets damaged, lost, or stolen after delivery, Coughlin’s is not responsible. We will be able to file a claim with the insurance provider, however it is up them if the claim gets approved and for how much the claim will get approved for. Please contact us within 24 hours of delivery and send up photos of the damage CustomerSupport@CoughlinsAuctions.com. Labor and shipping materials (boxes, bubble wrap, ect.) costs are not covered by the shipping insurance. You have to provide us with photos of the box, damage, and the box certificate on the outside of the box. 25. Auction Information Lots: Bidders must read the informational lots at the start of each auction for important details. The Bidder agree to all the info found in this info lots. 26. Buying a Firearm: Firearm purchases are subject to Federal and state background checks. Denied background checks will result in the firearm being re-auctioned, with a 40% commission charged to the original Bidder. Bidders must be certain of passing the background check before bidding. If you are picking up a firearm, you must bring all paperwork from your local police station (if applicable) and a trigger lock for each firearm. 27. Firearm Transfer Fee: There is a $20 transfer fee for each firearm sold and will be added to your invoice. (example: you buy 5 firearms you pay $100 in transfer fees). This fee is in addition to the buyers premium, tax, and any shipping fees (if applicable). This applies to FFL to FFL transfers as well. 28. Michigan Firearm Laws: Bidders are responsible for understanding and complying with all local, state, and federal firearm laws before purchasing. 29. Special Info about On-Site Auctions: This applies to auctions held not at a company owned auction house. You must pick up all items during the pick-up windows outlined in the auction detail pages. There is no storage available. Any items that need picked up after this window must be approved by us, and subject to a $50 per hour fee (min. 1 hour) for a member of our team to meet with on location. If any item you buy requires electrical lines, plumbing lines, or any other specialty work done, you will hire and pay for a licensed person to do those tasks. No unlicensed person will be able to do those tasks. 30. LiveAuctioneers.com: If you win an item on LiveAuctioneers.com, we may contact you via email, phone, or other means for payment. We are still learning this platform, and we ask for your patience during this transition. Any decisions we make regarding how we use this platform, regardless if they are not listed here, must be followed by the bidders. 31. Binding Bids: All bids are binding, including those that were outbid, in the event that the winning bidder withdraws from the transaction. 32. Auctioneer Discretion: The Auction House retains full authority over all aspects of the auction process, including but not limited to auction schedules, item lots, promotions, handling all disputes, who won or did not a lot, and customer service. 33. Bidder Score: Each bidder is assigned a score on platforms like HiBid and AuctionFlex. The Auction House reserves the right to adjust a Bidder's score for any reason, including failure to follow auction rules. Low scores may restrict participation in future auctions. 34. Auction Cancellation, Rescheduling and Extensions: The Auction House reserves the right to cancel, reschedule or extend an auction at any time for any reason. The Auction house can relaunch an auction, even after the auction has concluded in the event the date/time listed to end was incorrect. 35. Item Authenticity: The Auction House does not guarantee the authenticity of any items unless explicitly stated otherwise by using the phrase “Authentic”. Bidders are responsible for performing their due diligence before bidding. No refunds or returns will be made based on claims of non-authenticity after the auction has closed unless a written authenticity guarantee has been provided. 36. Condition: The Auction House may offer condition reports for certain items, but they are not a guarantee of the item's condition or authenticity. These reports are intended as an informational resource and should not replace the Bidder’s own inspection. 37. No Warranty or Guarantee: The Auction House makes no warranties, express or implied, regarding the items up for auction, including but not limited to warranties of merchantability, fitness for a particular purpose, or title. 38. Refunds: Refunds will only be issued if the Auction House provides incorrect information in the item description. (For example, if we explicitly state that an item is made of concrete, but it is actually made of plastic, a refund may be granted). However, if nothing is specified and you assume the item is something when it’s not, no refund will be given. If you have any questions or require clarification about an item, please contact us via email before placing a bid. 39. Shill Bidding Notice: Shrill bidding is the act of bidding on an item, just to increase the price, with no intention of winning the item. This act is considered illegal, and the Bidder agrees to not participate in this act. 40. Auction House’s Right to Refuse Service: The Auction House reserves the right to refuse service to anyone for any reason, including but not limited to non-payment, disruptive behavior, or unethical bidding practices. This includes revoking bidding privileges or banning individuals from future auctions. 41. Payment Fees: Some auction platforms allow The Auction House to pass credit card fees to the bidder. This feature may be turned on for an auction and if that is the case, the Bidder will be responsible for paying those associated fees. 42. Competing Bids: The Auction House reserves the right to choose the who is the winning bid at its sole discretion, regardless of which bidder currently holds the highest offer on the item. 43. Who can Bid: Bids may be placed by the seller, or a representative of the seller, as allowed under this disclosure to all bidders. 44. Notice of Actual Value Loss: If for any reason the Auction House is unable to provide the purchased items to the Bidder, the Bidder will be entitled to a refund of the amount paid. The Auction House will not be responsible to pay anything above the cost of the of the items final price at auction. 45. Simulcast Auctions: If the auction is classified as a “Simulcast” this means that the Auction House will have 2 or more competing platforms for the items. If the Bidder is winning on one platform it DOES NOT mean you are necessarily the highest bidder and will win the item, as the auction will be running on 2 different platforms. During the time the auction is slate to start closing, bidders on each auction platforms will bid against each other in real time, and the auction lot winner chosen at that time.
