TERMS AND CONDITIONS OF SALE: ADDITIONAL TRACT INFORMATION: Tracts 1 and 2 will be offered separately or as one unit. If sold separately, the Seller will provide a land survey to create boundary lines for each tract. The final contract price will be adjusted to account for any discrepancies between the advertised acres and the actual surveyed acreage. MINERAL RIGHTS: Any mineral interests owned by the Seller, if any, will transfer to the Buyer. TAXES: The Seller will pay the 2024 real estate taxes. Responsibility for all subsequent taxes will rest with the Buyer. PROPERTY CONDITIONS: The property is sold subject to all existing easements, covenants, recorded restrictions, and leases. Bidders are responsible for conducting their own inspections, inquiries, and due diligence at their own expense and risk prior to the real estate auction. The property is sold "AS IS-WHERE IS" without any warranties or guarantees, either expressed or implied, from the Seller or Auction Company. POSSESSION: Possession will be granted at closing, scheduled for January 14, 2025, or another mutually agreed-upon date. Any equipment that is part of the property being sold will have a "Bill of Sale" for the benefit of the Buyer. Possession is subject to the terms of any existing lease. EARNEST MONEY DEPOSIT: $25,000 deposit per tract is due the day of sale and the balance upon closing. Payment can be made via cashier's check, personal check, company check, or wire transfer. Funds will be deposited and held by McCarthy Abstract Title & Escrow Company of O'Neill. CONTRACT & TITLE: At the conclusion of the auction, the highest bidder(s) will sign a real estate purchase agreement and deposit the required earnest money with McCarthy Abstract Title & Escrow Company of Bassett, NE. The Seller will provide an owner's title insurance policy for the contract price. The cost of title insurance and escrow services will be split equally between the Seller and Buyer. The sale is not contingent upon the Buyer obtaining financing. CLOSING: Closing to occur on or before January 14, 2025 or another date agreed upon by the parties. The remaining balance of the purchase price must be paid in certified funds or by wire transfer, per the instructions of McCarthy Abstract Title & Escrow Company of O'Neill. SALE METHOD: The property will be offered in four separate tracts or combinations. Bidding will remain open until the Auctioneer announces the sale is complete or bidding is closed. The property will be sold to achieve the highest total price. Bidding increments are at the Auctioneer's discretion. Absentee and telephone bids are allowed with prior approval.
