Auction Terms & Conditions THIS IS AN INTERNET AUCTION ONLY Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. Zalesky Realty & Auction LLC shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. We make no guarantees to the item being complete, in working order or any guarantee of the above.
BUYERS PREMIUM: A 10% Buyer's Premium will be added to all purchases, plus 3.5% for credit card charges & 5.5% Sales Tax
PAYMENT: Cash or check will be accepted at pick up/check out or pay with the credit card that was used to register with. 10% Buyer's Premium will be added to all purchases, plus 3.5% for credit card charges. Sales tax of 5.5% applies unless tax exempt form is provided. Payment must be made prior to the end of pick up/check out. Failure to do so will result in your card you registered with being charged, forfeiture of your items and possible ban from future online auctions.
TITLES: Titles will be mailed to buyer within 14 business days of items being paid for and picked up. In the event the item was paid for by check, then that check must clear the bank prior to the title being mailed. NO EXCEPTIONS
PICK UP/ CHECK OUT: Winning Bidders must pick up their items during the specified pick up time. Any items left after the specified pick up/check out date will be considered forfeited. We will not be offering any additional load out dates or times. It will be the buyer's responsibility to dismantle & disconnect any and all equipment. Please bring your own packing materials, labor, tools & moving equipment. Some items may be in the basement! Bring a Friend or Someone to help you load your items if you are unable to do it yourself. All Buyers will be required to sign a hold harmless/liability waiver prior to loading. DO NOT BID IF CANNOT ATTEND THE SCHEDULED PICK UP TIME!!
SHIPPING: SHIPPING SMALL ITEMS ONLY! We do NOT ship furniture or large items and will be noted on each individual lot, but if you question if we will ship an item or not, email nickyzalesky71@gmail.com. Please use this same email to notify us if you need to have your items shipped. Will use USPS and the cost of shipping plus a $10 Handling fee will be charged in addition to the 3.5% convenience fee for credit card payment. We will NOT ship outside of the U.S. NO EXCEPTIONS!
CAUTION: For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.
CATALOG DISCREPANCIES: You are bidding on the described item not the photograph, occasionally the wrong photo may be displayed, always read the item description.
Server & Software Technical Issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Zalesky Realty & Auction LLC reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR ZALESKY REALTY & AUCTION LLC SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON.
WARRANTY & CONDITION OF ITEMS SOLD: All items are sold 'AS IS, WHERE IS', with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items and bid accordingly. Descriptions are believed to be accurate but not guaranteed. When you are not certain of the condition or use of an item please bid accordingly. The auctioneer reserves the right to add or remove items from the auction; split or combine lots; add minimum bids or reserve prices; cancel, suspend, extend or reschedule an individual item or auction event. The auctioneer reserves the right to make changes to the auction closing times or inspection or removal times.
