If you are unable to pick up your merchandise at the above date/time please call Chris at 802-370-2261 to make other arrangements. All merchandise MUST be picked up no later then 5 days after close of auction. Any merchandise not picked up within 5 days after close of sale will become the property of the auction co. Due to the size of this location, we are physically only able to accommodate a limited number of people inside the building at a time. Please be patient with us if you arrive at a busy time. Parking is also limited at this location so please be considerate when parking. There is plenty of street parking available on Waynewood Drive. Please bring your own packing materials (paper, bubble wrap, boxes, totes, etc.) and moving equipment. PAYMENT Valid Credit Card required for bidding approval. All bidding is in US Dollars (USD). Cash, Visa, Master Card, Discover, American Express, Wire Transfer ($20 fee added to each Wire). When purchasing precious metals (gold, silver, etc.),coins, currency, vehicles, or any large purchases, at the auction company's discretion, payment may be required via wire transfer. Statements made sale day take precedence over all other printed materials. Your credit card on file will not automatically be charged following the auction. You may pay with cash, local check with valid ID if credit has been established with the auction company (the buyer agrees to pay a $50 fee for any check not honored by the drawee) or card (4% convenience fee for any type of card) when you pick your winnings up at our specified time and location for the auction listed above. If you are unable to pick up your merchandise on the specified day/time your card on file will be charged for your purchase total plus a 4% convenience fee. All payments for online bidding will be processed through our third party processing company using the credit card that was used to register for the auction , or if picking up in person, payment can be made in house via credit card, approved local check or cash. SHIPPING
In House Shipping Via USPS Priority Mail is available on small lots at auction company's discretion. Buyer is responsible for paying for items in full prior to being allowed to pick-up or have items shipped. Shipping costs include cost of shipping, insurance, plus a $10 minimum S&H fee per Lot . Buyer is Responsible for all Shipping/Handling Charges incurred including fees charged by delivery service for incorrect addresses.
For all items deemed ineligible for our in house shipping, You may arrange shipping with the company of your choice to pick up your merchandise at our location. Arrangements can be made with the auction company to drop off your merchandise at a local shipping company of your choice for a $10 handing fee per lot. Shipping is also available through our preferred 3rd party (for profit) shipper, Pak Mail. They can be contacted at (260) 637-4809 or by email at contact@pakmailfw.com . When any non inhouse shipping service is used the auction company does not personally pack or ship items, we are simply the selling agent. We strongly advise seeking shipping estimates PRIOR to bidding. Some items may be designated PICK-UP ONLY.

Your bid is a contract. Place bids only if serious about purchasing. Winning bidder enters into a legally binding contract to purchase item(s) bid on in accordance with "conditions of sale" as set forth below.
Please contact auctioneer with any questions regarding item(s) prior to day of sale. While efforts have been made to include size and quality in item pictures, it is solely the bidder's responsibility to determine exact condition of each item. Items are being sold "as is" and without recourse. All sales are final. No statement, whether written or oral, made in the catalog, advertisement, bill of sale, announcement, remarks of an auctioneer, or otherwise, shall be deemed to create any warranty, representation or assumption of liability with respect to condition of any item.
All statements made day of sale take precedence over any written material.
All auctions are conducted pursuant to applicable laws and regulations of the State of Indiana.
If auction company does not receive payment in full, in good cleared funds, within five (5) business days following the sale, auction company is entitled in our absolute discretion to exercise one or more of the following measures, in addition to any actions available to us by law: a.) to hold the defaulting buyer liable for the total amount due and to begin legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted under applicable law b.) to cancel the sale c.) to resell the property publicly or privately with such terms as we find appropriate, to resell the property at public auction without reserve, and with the purchaser liable for any deficiency, cost, including handling charges, the expenses of both sales, our commission on both sales at our regular rate, all other charges due hereunder and incidental damages. In addition, a defaulting purchaser will be deemed to have granted us a security interest in, and we may retain as collateral security for such purchaser's obligations to us, any property in our possession owned by such purchaser. At our option, payment will not be deemed to have been made in full until we have collected funds. d.) to offset against any amount owed e.) to not allow any bids at any upcoming auction by or on behalf of the buyer f.) to take other action as we find necessary or appropriate
Some lots in this sale maybe offered subject to a reserve. Reserve is a confidential minimum price agreed upon by the consignor and Ye Olde Vermonter below which the lot will not be sold. Ye Olde Vermonter reserves the right to execute such reserves by bidding for the consignor. In any event and whether or not a lot is subject to a reserve, Auctioneer may reject any bid or raise not in line with the value of such lot.
The highest bidder acknowledged by the auctioneer will be the purchaser. Auctioneer has the right at their absolute and sole discretion to refuse any bid, to advance bidding in such a manner as he may decide, to withdraw any lot, and in the case of error or dispute, whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the lot in dispute.
Ye Olde Vermonter will use reasonable efforts to execute online bids but is not liable for circumstances outside of its control which inhibit it from doing so. Please note there is generally a slight time lag when bidding online. To reduce the risk of not getting bids executed, it is recommended online bids be entered prior to auction.
Pre-registration before auction is highly recommended. Guarantee cannot be made of buyer's ability to register online day of auction.
Item belongs to highest bidder once Auctioneer says "Sold". While we endeavor to receive and record all bids, Ye Olde Vermonter is not responsible for any errors, omissions, or failure to execute bids. Purchaser shall assume full liability and responsibility for item(s) purchased. All merchandise purchased must be paid for the day of auction and removed from the premises within five (5) business days of the auction ending. Any property not removed from premises within five (5) business days of auction ending will be considered abandoned property to be disposed of at the auctioneer's discretion. Ye Olde Vermonter has no liability for any damage to property left on its premises.
Items may be picked up at Ye Olde Vermonter (6704 Old Trail Rd, Fort Wayne, IN 46809) up to 5 business days after auction or shipping arrangements need to be made. Auction House is not responsible for any damage or loss that occurs while merchandise is in it's care. The Auction House is also NOT responsible for any damage or loss that occurs if you choose a shipping method that we have advised against and Auction House will require a waiver from buyer acknowledging this. Selling price plus buyer's premium will be the declared value for insurance, customs, duties and other tariffs during shipping in all cases.
Buyer's premium: A 10% buyer's premium will be charged on final price.
Indiana 7% sales tax will be charged to all buyers (unless a valid ST-105 form for the current calendar year has been submitted to auction company).
Bidding on any item indicates your acceptance of these terms and all other terms announced at time of sale whether bidding in person, online, or any other method.
Winning bidder is responsible for payment and shipping of all items purchased.
Ye Olde Vermonter and its consignors make no warranty or representation, express or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold.
Conditions of sale shall be governed by the laws of the State of Indiana. The purchaser/bidder agrees that any suit for the enforcement of this agreement may be brought, and any action against Ye Olde Vermonter in connection with the transactions contemplated by this agreement shall be brought, in the courts of the State of Indiana or any federal court sitting therein. The purchaser/bidder consents to the nonexclusive jurisdiction of such courts and waives objections.
