Preview and inspection time: Saturday and Sunday, July 24th and 25th, 2021 from 9 am to 5 pm. Payment of CASH or CHECK ONLY.. All payment is due at load out time unless special arrangements have been made. A 10% buyer's premium will be charged. 6% Idaho sales tax will apply to all purchases. All items will go to the highest bidder. Titled merchandise purchasers will recieve a 3 day permit and a bill of sale. New title will be mailed to you in approximately 30 days. All online buyers register to bid through the website. By registering to bid or placing a bid you agree to be bound by all of the terms and conditions of the sale. Bidders will establish a user name and password. A credit card authorization will be required. The credit card WILL NOT be used for payment. An invoice will be emailed to successful online buyers at the close of auction. Bidder acknowledges that the internet bidding service may not function correctly on the day of the auction and no bidder shall have claim against Rod Fivecoat Auctions if the internet fails to work correctly during the auction. Bidders acknowledge that an auction site is a potentially dangerous place. Every person enters the auction site at his or her own risk. No person shall have claim against Rod Fivecoat Auctions, sellers, or employees for any injuries or damages to or loss of property that may occur at the auction site. All sales are final. We are working with a trucking company to help load items out for our buyers for a fee, if you do not want to travel to Zena Creek. If items are not picked up, they will be considered abandoned and will be removed at the buyer's expense. All property is sold as is. All descriptions are believed to be accurate. All applicable sales tax will be added to the purchase price of all taxable items unless the buyer has proof of exemption and files an ST-101 form with the Auctioneers. If there is a buyer's premium, the sales tax is applied after the combined total. The purchaser shall not be entitled to possession of any of his purchases until total purchase price of all his purchases has been fully paid and in the event the purchaser fails to pay the full purchase price for any lot within the prescribed time or fails to comply with any other terms of sale, the Auctioneers shall retain the possessory lein and all lots of the purchaser and have the right to resell such lots by public or private sale without notice of any kind to the Purchaser. LOAD OUT: Rod Fivecoat Auctions, LLC will provide staff and SOME equipment to load your auction items. They are intended to ASSIST you ONLY. It is the purchaser's ulitmate responisbility to load out their items. Please plan accordingly. And, please be KIND to the staff, as they are provided as a COURTESY to the purchaser. All cost and responsibillity for auction item removal shall be borne by the purchaser. The Auctioneers reserve the right to require proof of adequate insurance coverage from any purchaser of lots requiring dismantling, rigging or hot cutting. Purchaser agrees to hold harmless both the Consignor and Auctioneers against any damage caused by the act of Purchaser and/or his agents in connnection with the dismantling or removal of any lot. All lots must be removed within the time announced or posted at sale. At Purchaser's sole cost and risk, and only in a manner approved by the Auctioneers. If for any reason the purchaser fails to remove any lot within the time specified, the lot shall be deemed abandoned and the Auctioneers, at their sole decretion, may resell at any time at the Puechaser's expense. We do not ship firearms or ammunition. If for any reason whatsoever, the Auctioneer is unable to deliver any lot, or any necessary documentation required in respect of any lot, the Auctioneers' sole liability, if any shall be the return of any monies paid on such lot. There shall be no guarantees of warranties expressed or implied, statutory or otherwise of any nature whatsoever. Each and every item will be sold "As is, Where is", with all faults.
