PICKUP DATES by appointment in Bennington, NY:
-Thursday, July 30th, 12 noon to 7 p.m. by appointment
-Friday, July 31st, 10 a.m. – 2 p.m. by appointment
*Pickup appointments are necessary to limit the number of people at the pickup site. State law requires that you wear a face mask at the merchandise pickup site at any time that you cannot properly social distance from others.
(Successful bidders will be emailed a receipt with a link to make an appointment for pickup on one of two days. Please plan accordingly for pickup, as there may not be anyone at the pickup site to help you if you must pick up on a different day. Be aware that the auction company does not offer delivery. If we must send auction staff back to the pickup site after the pickup dates, or if we must move items that were not picked up to our auction center, the customer will be billed for our staff time.)

Terms and Conditions
By bidding with our auction company, you are agreeing to the following.
-All sales are final. Everything is sold "AS IS" with no guarantees unless otherwise stated by the auctioneer. It is the responsibility of the bidder to assure him or herself as to the condition of items prior to bidding. Condition reports given by the staff of Bontrager’s Auction Service are subjective, and while we strive to be honest, we will not be held responsible or liable for any errors in description. Buyer is responsible for examining items before bidding. Auction company does not take responsibility for buyer's failure to examine. Merchandise is not subject to adjustments once the item has been sold.
-Bontrager Real Estate & Auction Service and its staff will not be held responsible or liable for any errors in absentee/left bids or phone bids, nor for the possible failure to execute left bids for any reason.
-Payment is due in full within the time limits posted in the auction. For this auction, all payment will be made through the credit card you provide when you register. We accept Visa, MasterCard or Discover. (Please note that while you may be able to register for our auction with any credit card, we will only accept Visa, MasterCard, or Discover for payment.) 13% buyer's premium and NYS sales tax added to all items purchased. Late payment will result in a $25 late fee.
-Charges will range from $10 - $25 depending when auction purchases are not picked up on the designated pick up date, even if you are consolidating pick ups for multiple auction purchases. Charges will vary depending on location (many items are not at our auction center), size, fragility, and length of storage time.
-By bidding with our auction you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as winning bidder, and agreeing that Bontrager Real Estate & Auction Service, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. Any liability to a purchaser will not exceed the purchase price actually paid.
-Successful bidders will sign their receipt at the time of merchandise pick up indicating that all items are present and in satisfactory condition. No returns, refunds or exchanges will be issued after the merchandise leaves the pick up location.
-Bontrager Real Estate & Auction Service will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
-Bontrager Real Estate & Auction Service has the right to void any sale, suspend bidding, re-sell any item/lots for any other reason.
-All sales are subject to appropriate sales tax and buyer's premium. Buyer's premium is 13% of purchase price and is subject to sales tax.
-Bids cannot be retracted once the auction begins.
-Buyers are responsible for making arrangement to pay for and pick up items within the time frames listed for the auction. Any variation, resulting in late pick up or payment will result in additional fees of $10 - $25, plus additional fees required for moving or storing the merchandise. There is no delivery service for this auction. Bontrager’s Auction Service is not liable for any damage to property left on the auction premises after the auction, whether or not payment has been made. We reserve the right to impose a storage fee of $10 per month for property not picked up within stated deadlines. Merchandise left 1 month after the auction is subject to sale with the proceeds covering storage and auction fees due to the auction company.
-In the event of legal proceedings arising from this contract or from the auction in connection therewith, buyer consents to being subject to the personal jurisdiction of the courts of the State of New York, Genesee County.
-For this auction, payment is by credit card only.

-All payments by credit card at the close of the auction. Please make sure the credit card you registered with is up to date and is a valid form of payment. We accept Mastercard, Visa, and Discover.
-Any customer who wishes to pay by cash or check must make arrangements with the auctioneer prior to bidding. Buyer's premium is 13% for all payment types (there is no discount).
--If you need to adjust your credit card information in your profile, you will need to log on to HiBid.com, click on your name and go to Payment Methods. Scroll down and delete your payment method. Click on "add a payment method" and carefully type in your credit card information. Please make sure that your address matches the address to which the card is registered.
-To protect you, we are unable to take your credit card number over the phone.

Shipping / Pick Up
SHIPPING:
Shipping is available on select lots. Please contact us at 585-343-4529 or todd@bontragerauction.com to find out if we will ship specific lots. We do not ship items with mercury, fuel, or oil. We ship items through the UPS and US Postal Service flat rate and charge $10 - $25 for handling (depending the size/weight/fragility of item). Buyer pays all shipping, insurance and handling fees.
All payments will automatically be charged to the buyer's credit card.

LOCATION:
To be disclosed to the successful bidders when an appointment is made for pick up. (Bennington, NY area). Bidders who make an appointment will be shown the pick up location in the appointment confirmation and by email.
ARRIVE AT YOUR SCHEDULED TIME:
Merchandise is organized by appointment time. When customers arrive at a significantly different time than they were scheduled, they will wait longer for their merchandise and create delays for other customers.
CONSOLIDATING PICK UP FOR 2 OR MORE AUCTIONS:
Our terms have always stated that there is a charge when auction items are not picked up on the designated pick up date. We've tried to be accommodating, rarely actually charging customers even when we've had to move items from other locations back to our center. After much discussion, we've decided that going forward, we will be charging for consolidating merchandise for more than one auction to one pick up location. It takes a great deal of time, labor, and effort to organize pick ups for auctions. Bringing items in from other auctions seems simple enough, but it greatly increases time, labor, need for storage, and likelihood for damage. Charges will range from $10 - $25 depending on whether the item must be moved from a different location (many of our online auctions items are not at our auction center), size, fragility, and length of storage time.
