Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the items and come to a state of satisfaction as to its condition and value and to bid based solely upon that judgment. By participating in this auction you agree that Clark Auction Company, LLC, nor its employees or affiliates will be held responsible for any errors in descriptions or any failure to execute a bid on behalf of any participant(s) for any reason whatsoever. By submitting winning bid(s) on this auction, you acknowledge and accept without recourse that you have purchased the above items at public auction "as, where is" without warranty or guarantee of any kind. You will not stop payment, dispute or otherwise contest this transaction.

Payment Terms:
ALL Invoices will be charged against the credit/debit card presented to register. NO Payments will be taken onsite. A Paid Receipt will be emailed to winning bidders on Thursday, April 16th.
All items are in UNKNOWN WORKING CONDITION unless otherwise stated and are sold AS IS, WHERE IS with NO WARRANTIES implied or expressed. Item preview is highly recommended and bidding without previewing is strongly discouraged.

Vehicle Paperwork:
Clark Auction Company, LLC, as acting agent for the seller, does not possess, cannot process and is not responsible for preparing or delivering title documentation to the winning bidder on this item. The seller, as posted at the top of the auction listing, will complete and provide all title documentation to the buyer. CAC IS NOT THE SELLER.
A Storage Lien Certificate will be provided to the winning bidder for title paperwork on all Impounded Vehicles unless otherwise stated. Vehicles marked with NO TITLE, FOR PARTS ONLY, SALVAGE or NON-REPAIRABLE are subject to standard 8.25% sales tax and cannot be titled through local tax offices.
All paperwork MUST be made out in the company name exactly as it appears on the winning bidders' online account at the time of auction close. If no company name is provided, then it will be listed in the individual name exactly as it appears on the winning bidders' online account at the time of auction close. Updating your online account information AFTER the item closes will not update your title paperwork information. All title paperwork will appear exactly like it is on your invoice. No changes to paperwork will be allowed. No exceptions!
NOTE: State law requires all vehicles be titled within 30 days of receiving vehicle paperwork (includes Storage Lien Packets, Titles or Auction Sales Receipts). Once 30 days have passed, the seller will no longer be able to help you obtain a title. Please apply for title with the State using your provided paperwork before this time period expires!

CLARK AUCTION COMPANY, LLC IS REQUIRED BY LAW TO COLLECT THE FOLLOWING TAXES:
Texas Sales Tax of 8.25% will be collected on all non-titled items unless the items are being purchased for qualified:
" resale under a valid Texas Sales and Use Tax Permit;
" non-profit exempt use.
Applicable forms and ID must be presented to qualify for a non-taxed purchase. NOTATE any intention to claim tax exemption, along with proper ID Numbers, in "Notes to Auctioneer" when registering.
Item Removal:
ITEM REMOVAL DATES ARE SUBJECT TO TEXAS TOWING! By placing a bid, you are agreeing to all terms and conditions. Pick up date: You MUST call Lacey at 903-390-9187 for a scheduled pickup.
Loading Staff is NOT provided. Please bring help if needed.
Items NOT picked up during the schedule times will be forfieted. NO REFUNDS.
WE DO NOT DELIVER. BUYER MUST MAKE THEIR OWN DELIVERY ARRANGEMENT WITH THIRD PARTY COMPANIES.
Notice of "Soft Closing":
Each auction item is scheduled to end at a specific time. However, all Online auctions performed by Clark Auction Company, LLC use a "Soft Close" feature. Thus, bidding will still remain open on any item that receives a bid within the last 5 minutes prior to the scheduled closing time. Time extensions are added in 5 minute intervals to the original auction closing time and to each extension's closing time when a bid is placed. For example: if an item is scheduled to close at 10:00am, and a bid is placed between 9:55am to 10:00am, the closing time will be extended by 5 minutes until 10:05am. If a bid is placed within that 5 minute interval, then bidding the closing time will extend until 10:10am, etc… Once a 5 minute extension interval has passed without any bids, the auction for the item will close, and the lot will show as COMPLETED. Click the "Refresh" button on your web browser frequently before that item closes and during any extension periods. Your screen may not "auto-refresh," and you may not see bids placed after yours if you don't manually refresh.

The bidder acknowledges and accepts that Clark Auction Company, LLC does not guarantee continuous, uninterrupted service or secure access to our website. Operation of our website may be interrupted, interfered with or adversely affected by numerous factors or circumstances outside of our control. Neither Clark Auction Company, LLC nor any of its sellers, agents, or any provider or third-party vendor will be liable for nor have any responsibility for any loss or damage incurred in the event of any failure or interruption of the website or internet bidding, or from any other cause regarding access to or inability to access the site or its materials, or to place bids whatever the perceived cause. In the event of service interruption during the course of internet auctions, Clark Auction Company, LLC and its sellers reserve the right to terminate the interrupted auctions and declare all bids in those auctions null and void, to allow auctions to continue to run after an interruption, to relist and restart affected auctions at the original starting bid or the high bid at the time of the interruption, to restart all auctions containing any lots of merchandise affected by an interruption or to take any other action deemed necessary. The auctioneer's decision, with Seller's consent, shall be final without recourse or liability.
