Bidding Instructions: Credit card on file will be charged immediately when the auction is completed. Any declined credit card charges must be settled within 24 hours following the conclusion of the auction to avoid a dispute filed with Hibid. Your credit card will be charged for the following: Your Total Purchases, Buyer's Premiums, Shipping and Handling Fees, and any applicable sales taxes. A pre-auction authorization will be performed to establish available credit. Debit cards may show a hold on funds for a short period of time. Nothing will be charged to your card until a purchase is made. Credit card chargebacks will NOT be accepted. Invoices will be posted within 24 hours of the close of the Auction. All sales are final and items are sold AS-IS, with no warranty expressed or implied. It is the bidder's responsibility to determine condition, age, genuineness, authenticity or value BEFORE bidding. Bidders should rely on their own knowledge and research of value and other characteristics before bidding on any item. Buyers will accept the items or lots in spite of any defects or conditions, known or unknown, visible or not visible, and therefore buyers do by these presents remise, release, acquit, quit claim and forever discharge the sellers, auctioneers, licensees, employees and agents from any and all claims now and in the future. Buyer understands that any description given in the catalog or written on the lot is not guaranteed, and the buyer will rely entirely on their own inspection and/or investigations. All information and descriptions contained in advertising this sale are believed correct, but are not guaranteed. Bidders agree to hold Fouss Auction & Appraisal LLC harmless if the internet fails to function properly, for power outages, for computer or internet complications before during or after the auction. Bidding may be extended if bids are placed in the last new minutes to prevent bid sniping. Currency Type: USD ONLY Titles: Titles for any vehicles will be sent to buyer 10-15 business days following receipt of payment unless delayed by a bank or financial institution. Pick-up: Free local pickup is available on the designated date and time ONLY. Buyers must bring their own packing materials, blankets, shrink wrap, dollies, trucks, tools, trailers and manpower as needed to disassemble, carry and load their purchases. Auction staff WILL NOT assist with loading. Buyers are solely responsible for the transportation of any vehicles, equipment, and/or large items. Buyers of large items can make arrangements with auctioneer for a scheduled pickup date, however this date must be within 7 days after the close of the auction. Buyer agrees that any and/or all remaining lots left after removal deadline are considered to be automatically forfeited, but buyer is still responsible for invoice total. Shipping: Shipping on smaller items that will fit into a 12"x12"x12" or smaller box is available upon request. We ship via USPS or UPS at the buyer's expense to include actual shipping charges plus a $10 charge for packing & handling PER 12"x12"x12" or smaller box. All items will be shipped within 14 days following the auction when possible. Forfeiture: If you do not wish to pick up or ship your items, you may forfeit them. Forfeiting your items is defined as relinquishing all ownership and claim to the items in question to the auctioneer with no expectations of reimbursement; however, you are still responsible for the invoice total. No refunds will be made if you decide to forfeit your item(s). If you wish to forfeit your item(s), please contact us ON or BEFORE the removal deadline. Buyer agrees that any and/or all remaining lots left after removal deadline are considered to be automatically forfeited without further notice, but buyer is still responsible for invoice total. Auction Revisions: All aspects of this auction are subject to change without or with limited notice. The Auctioneer reserves the right to, at any time: 1. Add or remove items from the auction, 2. Split or combine lots, 3. Add minimum bids or reserve prices, 4. Cancel, suspend, extend or reschedule the sale of an individual item, lot, part of or an entire auction, 5. Make changes to the auction's closing date or time, inspection, or removal times, or 6. Take any other action the Auctioneer deems necessary to effect the fair conduct of this auction or protection of the buyers, sellers or other parties of interest. Auctioneer and staff retain the right to bid and buy at the auction under the same terms and conditions as any other bidder. Preview Date, Times and Location: Items can be inspected at Fouss Furniture & Outlet 517 21st Street Vienna, WV 26105 during normal business hours of Wednesday 9-noon, Friday & Saturday 11-5 and Sunday 1-5pm until the auction closes. Inspection of Items: Every item in this auction is available for bidder inspection prior to the auction ending. By bidding, each bidder acknowledges and agrees that they have had the opportunity to inspect the item or lots and is relying solely on the bidder's personal inspection, whether in person, through proxy, or based on the provided photographs and opinion in determining whether and in what amounts to bid. In all cases the Liability of Fouss Auction & Appraisal LLC and any seller of products in this auction will be limited to the refund of your purchase price regardless of circumstances.
