AUCTION TERMS & CONDITIONS -
CONDITIONS OF SALE:
All sales are final, and all property is sold "AS IS". It is the bidder's responsibility to determine the condition and usefulness of the items purchased. If you have questions or are NOT SURE about the condition of or anything pertaining to an item in our auction, please do not hesitate to pick up the phone and give us a call, we will answer your questions to the best of our ability. BUYER'S PREMIUM:
We currently charge a 10% buyer's premium.
BUYER TAX:
7% Indiana Sales Tax.
BIDDING:
A bid by any person shall be conclusive proof that the person has made himself acquainted with these conditions of sale and has agreed to be bound by them. In the event of non-payment during posted pickup days, we reserve the right to charge the outstanding invoice balance to the credit card you provided upon registration. Failure to honor your bid may result in the loss of bidding privileges. Upon failure to pick-up purchased items, 7 days following the initial pick-up dates, the auction house reserves the right to re-sell/auction any and all items.
The Auction House reserves the right to reject a bid from any bidder. The highest bidder acknowledged by the Auctioneer shall be the purchaser. In the event of any dispute between bidders, the Auctioneer shall have sole and final discretion to determine the successful bidder or to reopen bidding.
AUTHENTICITY:
Though all descriptions are believed to be correct, neither auction house nor seller makes any warranties of any kind with respect to the property and in no event shall be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source origin, fitness for a particular purpose, condition etc.
OPEN INSPECTION:
Open inspections are by appointment only, please contact us to book a showing. Condition report not provided. Please view detailed photos closely as they are part of the description.
PAYMENTS:
Payment by Credit Card in USD, Cash, Check, Venmo or Cash App. Credit Card accepted with 3% convenience fee. Payment by check may be subject to a 10-day bank clearance for out of state and buyer's unknown to the auction company.
SHIPPING:
Shipping available for select items at the buyer's expense. Purchaser must notify us (Zips Real Estate & Auction Services) immediately if you would like your items shipped. Items / lots purchased will only be shipped AFTER we calculate and receive both the shipping fee and the settlement payment. No exceptions.
There is also a $2 handling fee per lot shipped.
SCHEDULE PICK-UP:
Pick-ups are the following 2 days after the auction closes (12pm to 3pm). Buyers are responsible for packing, loading, and moving all items purchased. It is highly recommended and encouraged to bring your own help and equipment to load your items.

All trademarks, service marks, and copyrights owned by Zips Real Estate and Auction Services shall not be used without written permission. This includes the name Zips Real Estate and Auction Services, any and all website URL addresses and abbreviations of such.

The 10% buyers premium is due and non refundable from the winning bidder no later than 48-hours after the auction closes with balance and possession due upon closing. Closing of this transaction shall be no later than 30-days after the auction sale and the closing fee charged by the title company will be split 50/50 between both buyer and seller. The buyer is responsible for the taxes due and payable for the Spring of 2025 and thereafter. Seller agrees to furnish good and merchantable title to said real estate or an owner's policy of title insurance for the sale price of the real estate and agrees to deliver a good Warranty Deed. Any costs associated with the provision of title insurance and title search will be at the expense of the seller. The buyer will be responsible for any costs associated with obtaining funds to close the transaction. If a survey is required by the lender that will be at the sole cost of the buyer. The property is selling in AS-IS condition, and the seller does have the right to accept or reject any and all bids. Sale of the property is not contingent upon buyer inspection or buyer financing. Possession of the property will be granted on the closing date. Buyer is responsible for conducting their own inspection and inquiries on the property. All buyer inspections need to be done prior to the auction date of 1-13-2024. The property is available to be seen anytime leading up to the final day of bidding at 6:00 P.M. when the online auction bidding ends. Buyer will be contacted immediately following the auction and will be asked to enter into a purchase agreement.
