Terms and Conditions - Auction Participation
1. Auction-Specific Notes:
• Any notes in lots apply specifically to this auction. Bidding signifies agreement.
2. Registration & Identification:
When you register, we collect your information to verify your identity before you can bid, including your credit card details to confirm buyer eligibility. All bidders must meet the legal age requirement to participate. If you prefer not to register online or cannot (e.g., do not have a credit card), you may still bid by providing a $500 deposit via e-transfer.
By registering, you consent to receive emails specifically related to the auction(s) you participate in, including any additional parts (e.g., 2nd, 3rd rounds) of the auction. These emails are essential for participation and cannot be opted out of. However, for general email updates, you may unsubscribe by clicking the "Unsubscribe" link at the bottom of those messages. If no unsubscribe link is available, it means the email is necessary for auction participation and cannot be opted out of.
By registering, you agree to receive these essential communications.
3. Payment:
Registering for an auction is free, though a temporary hold of up to $1 may be placed on your card by Auctionflex to validate your first registration. Your credit card will not be charged unless you win an item and fail to pay within the specified pickup period.
All payments are processed through AuctionFlex via most major credit cards. We do not accept e-transfers, certified checks, money orders, or phone/online/manual card charges.
Failure to pick up within the scheduled time will result in a 25% restocking fee (or $20, whichever is greater) charged to your registered card. Unclaimed items will not be held, and your account will be suspended. A $50 administrative fee will apply to reinstate your account.
By registering, you authorize AUCTIONFLEX/LIQUIDATIONEVENT/OPEN DOOR SALES INC to apply these fees to the card on file. Reinstating an account in this case will require a $100 administrative fee in addition to the outstanding restocking fee.
4. Buyer's Premium 10% & HST:
• 10% Buyer’s Premium and 13% HST apply to all items.
• Tax exemptions must be claimed on your income tax returns.
5. Bidding & Bid Status:
• Bids are final. Be cautious, as no bids can be retracted.
• All items sold as-is. Where is, no warranties or guarantee implied.
• Attend previews if available.
• Outbid notifications are not sent during the last two hours of the auction.
6. Item Removal:
• Buyers are responsible for safely disconnecting and removing items. No assistance will be provided.
• Items not removed by the specified time will be considered abandoned.
7. Winning Notification & Invoicing
All winning bidders will receive an email invoice the day after the auction closes. If you do not see the invoice, please check your junk or spam folder. Regardless of whether you receive the invoice, you are still responsible for payment and pickup as outlined in the auction terms.
To confirm your winning bids, you can log into your account after the auction closes and review each lot. If the lot status displays "Status," you have won; if it says "Outbid," you did not win.
8. Pick-up & Removals:
• Pick-up dates and times will be posted. We do not ship.
• Uncollected items will be considered abandoned, and restocking fees will apply.
9. Item Condition:
• Items are sold "as is." Previews are recommended.
• DO NOT BID IF YOU CANNOT PICK UP.
• YOU WILL STILL BE CHARGED FOR ABANDONED ITEMS
10. Credit:
• By bidding, you agree to pay and pick up as scheduled, or credit action may follow.
• Bids are binding contracts between buyer and seller.
11. Missing Items:
• In case of missing items, refunds will be issued. No other items on the invoice may be cancelled.
12. Auction Records & Soft Close:
• In disputes, our records are final.
• Auctions may be extended if outages occur. Items may remain open for 4 minutes after a last-minute bid.
13. Liability:
• No claims are allowed post-auction.
• Open Door Sales Ltd. is not liable for personal or property damage.
14. Additions & Deletions:
• We reserve the right to modify the sale at any time.
15. Buyer Liability:
• The BUYER expressly agrees to indemnify and hold Open Door Sales Inc., the Seller, and their assigns harmless from and against any and all claims, losses, expenses, damages, or liabilities arising directly or indirectly from any act, including negligent acts or omissions, of Open Door Sales Inc. or anyone acting on their behalf in connection with or related to the auction. All bidders and buyers must be of legal age.
16. Reserves & Strategy:
• Reserve prices will be clearly marked.
• We recommend placing maximum bids early to avoid being outbid.
17. Soft Close: Items will close at regular intervals. To prevent last-minute “sniping,” any bids placed within the final minute of an item’s closing will extend the auction for that item by an additional 4 minutes. This process will repeat until no further bids are placed.
18. CATALOG ERRORS & OMISSIONS: If there is a discrepancy between a description and a photo of an item in a lot, the written description prevails. All items are sold "as is, where is," including all faults. If an item is listed by mistake or is unavailable at pickup, the bidder's maximum remedy is a full refund for that item, while all other bids remain binding. Approved refunds require items to be returned at the buyer’s expense. BUYERS ARE RESPONSIBLE FOR CHECKING THEIR ITEMS BEFORE LEAVING THE PICKUP LOCATION.
19. LIMITATION OF LIABILITY: You acknowledge and agree that Open Door Sales Inc and its Consignors are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, loss of profits, goodwill, data, or other intangible losses (even if Sebae has been advised of the potential for such damages), arising from: (i) your use of, or inability to use, the service; (ii) costs incurred in obtaining substitute goods or services due to any goods, data, information, or services purchased, messages received, or transactions made through the service; (iii) unauthorized access to or alteration of your data or transmissions; (iv) statements or actions of any third party on the service; or (v) any other issues related to the service.
