Bidding Notice: This auction will be conducted online only. Bidding will begin November 2nd, 2024. This auction will have a staggering close with lots closing every few seconds beginning at 7:00pm CST on November 12th, 2024 until all items are sold. This online sale utilizes a soft closing which means if you bid in the last minutes of lot closing, the bidding will be extended a few mintues until all parties are done bidding. If we do not have any notes, we will charge the credit card on file after the auction has concluded. Auction Terms & Conditions Auction Terms & Conditions All sales are final and items are sold "as is, where is". This is an estate auction so please note items are used. No sales tax will be charged for this auction. BUYER'S PREMIMUM: 15% buyers premimum will be charged, no matter the form of payment (cash, check, or credit card), to the winning bid to reach final sales price. PAYMENT: Credit Card used for registration will be charged immediately following the auction unless other arrangements have been made BEFORE auction's end. By registering to bid on any item, bidder agrees to all terms and conditions of the auction. Kail Auctions, LLC reserves the right to refuse to accept bids or approve bidders for any reason. If payment has not been received at auction end or other payment arrangements made by end of business hours on pick up day, we reserve the right to cancel any unpaid item(s) after that time. At this time, we will ban the bidder from any future sales and resell the item(s) to the back up bidder. Shipping will only be arranged after payment has cleared. There will NOT be any alternate pick up dates. PICK-UP: 11/14/2024 from 10:00am - 5:00pm CST. Our staff will be assisting you in retreving your items around the house. We may only be able to assist one customer at a time. Please be patient. Please bring help tp load your items if needed. You must pick your item(s) up at the stated times if you do not you will release your item to be resold or sold to the back-up bidder. This does not mean you are released from paying for items you won at auction. If you do not pick up your items on the designated pick up day or make arrangements prior to the auction closing, you will forfeit your items to the auction company. So, if you cannot pick up your items on the specified pick-up day , DO NOT bid. Please bring help if needed and bring your own boxes. Contact us if you need other arrangements. PREVIEW: 11/10/2024 from 2:00pm-4:00pm CST. All lots are sold "AS IS, WHERE IS." Property shall be displayed for thorough public inspection and sold as is, where is, and without recourse for any refund or reduction of the sale price. On the fall of the auctioneer's hammer or other acknowledgment of a successful bidder on a lot, title to the property in that lot will pass and the successful bidder there upon assumes full risk and responsibility for the purchased property. The highest bidder shall be the buyer. If any dispute arises, the auctioneer shall have absolute discretion to settle it and put any disputed lot up for sale again. Shipping will be offered on SMALL ITEMS ONLY! Buyers are responsible for the entirety of the shipping cost. There will be a minimum of $5 fee for cost of packaging and handling on all items. If purchasing large ammounts of glassware or fragile items expect increased packaging costs. Please allow 5-7 business days for our staff to package your items, once packaged, the CC on file with Hibid will be charged unless other arangments have been made. It is YOUR responsibility to contact Kail Auctions to arrange shipping. Items bought will not be packages and shipped before the scheduled pick up date for the auction. Kail Auctions cannot qoute you how much shipping will be unless they wrap your order, hence, why we make sure you want shipping beforehand. Please note that your order may take some time to prepare depending on the volume of shipping items per auction. If you do not attempt to make contact reguarding shipping or we cannot reach you via the info provided through HiBid within a reasonable ammount of time, your items will be thrown away. Kail Auctions does not have room to store items. Online bidding is a convenience offered to customers and while we make every effort to execute your instructions regarding your Online Bids. Kail Auctions, LLC is not liable or responsible for any errors or failure to execute such instructions. Kail Auctions, LLC reserves the right to cancel, postpone, or extend the auction at their discresion. The auctioneer, the auction staff, or anyone affiliated withe the auction company reserve the right to bid on and or buy any items in the auction. They will be held to the same terms and conditions as stated. STORAGE: We have no storage. Your items must be picked up at address of sale. If you require shipping, your items will be transported to our office where they will be packaged for shipping. DESCRIPTIONS: All descriptions are subjective and up for interpretation. Please note you are responsible for looking at all photos and reading descriptions. We offer a preview day for in person inspection of the items being offered for auction. TECHNICAL PROBLEMS: We have made reasonable efforts to provide for online bidding for this auction. You recognize and acknowledge, however, that technical problems with hardware, software, or internet connectivity, as well as human errors, may arise and may affect, without limitation, the Kail Auction's HiBid website, our online bidding program and process, your or our internet service and access, and your connection to this auction’s bidding program and process. You further acknowledge that these and other technical problems may develop at any time and with or without notice. You acknowledge and agree that neither we nor the Seller is in any way responsible for any such technical problems, and that you have no absolute or other right to be able to bid on this auction in the event of any such technical problems. Notwithstanding the foregoing, you further acknowledge and agree that, in the event of any such technical problems, we reserve the right to postpone or cancel the auction and/or extend the bidding time for this auction and/or relist the property for auction at another time, in our sole discretion, and that our decision with regard to any such actions is and will be final. All legal disputes or any litigation's that may arise, for any reason, between Kail Auctions, LLC and bidder shall be tried in Courts of Paris, Henry County, Tennessee. Successful purchasers agree to pay any and all reasonable attorneys' fees and costs incurred by Kail Auctions, LLC, the seller and/or their assigns, agents or employees in the commencement or defense of any action here-under as well as in the collection of any obligation here-under. This auction is being conducted under appropriate state and local laws and the Uniform Commercial Code. Any additional terms or conditions of sale shall be announced prior to the auction.
