Auction Terms & Conditions of Online Personal Propery Auction
Please review this document carefully. This document creates certain legally binding contractual obligations.
In order to register and receive access to the interactive bidding platform, a Bidder must accept and scknowledge these Terms and Conditions.
1. any bid placed shall constitue a legally binding and enforceable offer to purchase the subject personal property. All bids therefore constitute an irrevocable offer to purchase and shall remain valid and enforceable until the seller declares the property SOLD and the auction has concluded.
2. Wilson auctions reserve the right to reject any bid placed, Wilson auctions agrees to timely advise any bidder of a rejected bid.
3. The winning bid convenants and agrees to purchase the subject personal property at the price of the winning bid.
4. winthin 24 hours of the close of the auctionevent, the winning bidder for the property shall receive an email from Wilson auctions which will detail a date, a time and a location for the pick up of property, with specific arrangements of the parties, including options for shippng and electronic payments.
5. At appointed date, time and location the winning bidder shall pay the full purchase price (including buyers percentage and the Illinois sale tax unless you have a valid resale number) for items by means of cash, check and credit card.
6. you are solely responsible for the safe and timely pick -up and removal of any items you have won. if you are unable to pick up and remove items duing the removel time that have been set please do not bid. Wilson auction is not obligated to issue you a refund if you are nuable to pick up and remove items at set time.
7. Failure to appear at the set date, time and location by the winning bidder, shall be considered an ace of default by the winning bidder which are available to seller pursuant to the laws of the jurisdiction of the State of Illinois. if the Wilson Auction file suit against winning bidder , the Wilson auction is entitled to recover attorneys' fees and expenses incurred.
8. Buyers understand that not appearing at pick up or not getting hold of Wilson Auction my result in the invoice being charged to the registered credit card plus fees for storing items.
9 By registering and bidding, the buyer has submitted themselves to the personal jurisdiction of the State of Illinois. Disputes shall be governed by the Illinois Law, conflicts of law provisions notwithstanding, or all litigation associated with the sale and purchase will be filed in the Courtsof Richland County, Olney Illinois.
10. The seller,auctioneer and their representatives, agents assume no liablity for errors or omissions in this or any other property listing or advertising, also make no guarantee as to the accuracy of the information of other property.
11. Wilson Auction will provide you with the opportunity to inspect the items being offered on online auction. If a preview is available, we strongly encourages you to attend the scheduled inspection for all our online auction, with a set time, date and location. If you do not choose to attend or have questions about items bid accordingly. You acknowledge and agree that by bidding on item that you have looed at items, or have waived the inspection in determining whether to bid, and the amount of bid in bidding.
12. all property is sold "AS IS" we will discripe the item to the best of our abillity . All information was derived from sources belived to be correct, but is not guaranteed. Bidders shall rely entirely on their own information, judgment, and inspection of the property.
13. By registering and bidding, the buyer acknowledges they understand, accept and agree to these terms and conditions.
14. whether you are a new or returning bidder, you agree that if any of the information associated with your bidding account - including contact infromation and credit card infromation - changes at any time pior to, during or after the sale you will notify the auctioneer in charge.
15. When you bid on the wrong item or decide an item is not suited for your intended use, neither our sellers not our auction company will assume the cot of your mistakes. You agree that your failure to inspect or otherwise become fully informed about the items offered for sale in this auction will not be grounds for refusal to pay amounts due.
16 Wilson auction cannot and will not, be held responsible for any interruption in service, errors and or omissions.
17. You should refresh your browser often to view for updates, and review every bid you choose to mae before submitting bids. Many bidders routinely increase their own bids to a higher amount out of the reach of other bidders. You understand and agree that you are responsible for all bids using your account. if a problem arises reach the wilson action.
18 All aspects of the auction are subject to change without notice. We reserve the right to at any time (a) add or remove items. (b) split and combine items (c) add minimum bids reserve prices, cancel, supend, extend, or reschedule the sale (d) make changes to the times or closing, preview, or pickup time, (e)take any other action to deem necessary to conduct a fair sale.
19. Our on line auctions are designed to mimic traditional auction, with staggered closing.
20. At the end of the auction the credit card on your account will charged . We offer cash /check payment at pick up time, Please let us know if you are paying that way when you register for bidding for the auction. Emails will be sent your your paid invoice in 24 hours after end of sale. chargebacks prohibited : you agree that you will accept all charges on the credit card on your account and you agree that you will not charge back any amount that we charge on your credit card.
21. Buyers premium : will be charge as noted and Illinois sale tax will be charged if you do not have a retail number on account.
22. you undersatand and agree that any violation of these Terms and Conditions or unsale or illegal activity during any auction or related event may suspended your online privileges. If you try to create a new account or use a thrid party's account - will constitue a breach of these term and conditions..
23. The registered bidder acknowledges receipt and copy of these terms and conditions, and have read and understand the provisions set forth there in. accepts same and agrees to be bound thereby.
