Terms and Conditions
Auction Terms & Conditions
DESCRIPTIONS:
Items are described to the best of our knowledge and ability. The intentions of the descriptions are not to be assumed as definitive and should be thought of as opinions of the auction company regarding the genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property. No statement made in item information lead descriptions, full descriptions, estimates, or those made during the sale should be considered an assumption of liability or warranty. Items that we deem to be questionable will be described as such. The usage of this term does not imply anything other than our opinion. Artworks described as works by a specific artist fall into our highest tier of authenticity. However, no qualified statement about the authorship is strictly implied. The term signed by the artist is believed to have been inscribed by the artist described.
REPRESENTATION, WARRANTY DISCLAIMER, AND NOTICE OF NO GUARANTEE: All items offered for bid or sale are sold "AS IS," "WHERE IS," and without representation, warranty, or guarantee of any kind, whether created by statute or by common law. AUCTIONEER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ANY WARRANTY IMPLIED BY COURSE OF DEALING, OR ANY OTHER WARRANTY, WHETHER CREATED BY STATUTE OR BY THE COMMON LAW. CONDITION, MEASUREMENTS, AND ESTIMATES Information regarding the condition, all measurements, and estimates are given as a courtesy to potential bidders and is only an opinion. These opinions should not be treated as a statement of fact. Geyer's Auction and Appraisal assumes no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, possible imperfections, or the effects of any aging issues. Bidders are encouraged to preview the item in person or request additional photos or measurements before bidding. If provided, the values shown after each lot are the auctioneer's estimate of what each is likely to sell for.
BIDDING:
By bidding on any item, Bidder accepts and agrees to be bound by these Terms and Conditions and expressly acknowledges that these Terms and Conditions constitute a binding contract. If Bidder does not agree to these Terms and Conditions, Bidder is not authorized to place a bid on or buy any item. The auctioneer shall determine bidding advances, which shall be at his discretion. The auctioneer has the right to refuse any bids. Some of the items offered at auction may be subject to a reserve. A reserve is a minimum price agreed upon by the consignor of the property and the auction house. The auctioneer may bid on behalf of the consignor to reach the minimum sale amount. The auctioneer may pass the item if the minimum amount is not reached. The auctioneer reserves the right to bid on behalf of clients and vendors but shall not be liable for errors or omissions in executing instructions to bid. All bidders are required to complete the registration and obtain a bidder number. Absentee bidders agree to all terms and conditions. The highest Bidder acknowledged by the auctioneer shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or offer the lot for resale. The auctioneer shall have sole discretion to refuse any bid or refuse to acknowledge any bidder. The buyer's premium is applied to all items sold at auction. This amount will be 12% of the high bid price. Sales tax will be applied according to federal, state, and local regulations.
PAYMENT and AGREEMENT NOT TO DISPUTE CREDIT CARD CHARGES:
Bidder agrees that upon processing a credit card, debit card, or other bank card, such payment shall be immediate and irrevocable. Bidder shall not dispute, challenge, or reverse any such payment or charge. Invoice totals for Out-of-state and Non-Local Bidders will be invoiced and emailed on the night of the auction or the following day and are immediately due and payable. All items must be fully paid for before being released for shipment. Successful online buyers of coins, precious metals, and currency or any purchase totaling over $1000 must make payment by wire transfer before shipment. The total purchase price on all lots sold to the same buyer must be paid before removing any items. The total purchase price on all lots must be paid for in full upon receipt of the invoice, regardless of when the lot or lots are picked up. If picking up, you must sign up for a time slot to pick up your items. The available pickup dates are November 16th, 2024, between 11:30 a.m. and 5 p.m. and November 17th, 2024, between 8 a.m. and 2 p.m. A link will be sent with your invoice so you can sign up for a pick-up slot. Any items not picked up where shipping arrangements have not been made or advised with the auction company to turn the items over to the courier of choice for shipment will be forfeited, including all monies paid for the item or items. Items left unpaid and not picked up will become the property of Geyer's Auction and Appraisal and will be resold at our discretion. Every effort is made to safeguard merchandise throughout the auction; however, the Bidder becomes solely responsible for all items purchased immediately following being declared the winning Bidder. Therefore, the Bidder is advised to guard his items further at their discretion.
