By using the Services, you agree to be bound by these Bidder Terms and the Auction and Direct Purchase Terms and Conditions (the "GST Terms"). These Terms shall be incorporated into the GST Terms and govern your participation in auctions or direct purchases on the Site.
1. Bidder Registration and Account Approval. To participate in the purchase of products ("Products") listed through GST's Services, you must first register for a Bidder Account. Your Bidder Account must be approved by GST, at its sole discretion, before you can access the Services. By creating a Bidder Account, you expressly agree to these Terms and the GST Terms.
2. Listed Products. GST does not inspect or verify the Products listed for sale, nor does it guarantee the accuracy of any Product descriptions provided by Sellers. Transactions initiated on the Site are between you and the Seller. GST is not responsible for any disputes or issues arising between you and the Seller regarding listed Products.
3. Auction / Direct Purchase Information and Bidder Inspections. Auction dates, product descriptions, and prices are determined by the Seller and are subject to change. GST does not guarantee the accuracy of Product information. You should not rely solely on the descriptions provided and are encouraged to examine the photographs and other information provided for each Product. GST reserves the right to remove or cancel any listing at its discretion.
4. Additional Terms Posted by Seller. A Seller may post additional terms and conditions for their Products (the "Seller Posted Terms"). You are solely responsible for reviewing and agreeing to the Seller Posted Terms before placing a bid or making a direct purchase. GST does not create or enforce Seller Posted Terms.
5. Additional Fees by Seller. Sellers may charge additional fees, such as a buyer's premium, shipping, handling, and other fees, which are set by the Seller and may vary. You agree to pay all fees associated with the purchase of a Product.
6. Additional Seller Registration. A Seller may require you to register directly with them before bidding on their Products. Seller approval is at their sole discretion.
7. Transportation, Risk of Loss, and Additional Costs. GST is not responsible for the transportation, delivery, or risk of loss for any Product purchased through the Services. You are responsible for coordinating the transportation and covering all associated costs, including shipping, taxes, customs duties, and fees.
8. Bidding. When you place a bid or select a direct purchase option, it is considered a firm commitment to purchase the Product. Bids cannot be retracted. If you are the highest bidder or make a direct purchase, you are legally obligated to complete the transaction.
9. Prohibited Bidder Conduct. Attempting to manipulate auction prices or engaging in prohibited conduct, such as bid rigging, is strictly forbidden.
