TERMS OF ONLINE AUCTION ENDING ON October 10 2024
The terms for this online bidding internet auction of items from Z!eats (ZOUP) SITE AT EASTON GATEWAY and items from other closed food service operations are as follows:
a Buyer's premium is 15 % of the bid price will be added to the purchase. NO OHIO sales tax is in place for this going out of business auction.
In the unlikely event of a software glitch that renders the online bidding inaccurate. Or in the event of a local, national or international power outage or crisis, the online bidding will be stopped and or voided and the event will be reposted at a later date at the auctioneer's discretion, or if such a glitch or event affects only certain lots in the auction, then those items may be offered at a different event at a later date at the auctioneer's discretion
Bidding constitutes a contract to purchase under the terms of sale laid out here. Bids ( purchase contract) are not transferable by the bidder to any other party unless with the written consent of the auctioneer.
Please note that as of September 13, 2022 The Ohio Revised Code considers that an online bidding auction in Ohio now fits the definition of an auction and is thereby subject to Ohio Auctioneer License law. Paul Delphia is licensed as an auctioneer by the Agriculture department of Ohio and Paul Delphia dba Restaurant Equipment Auction Specialists of America and Paul Delphia dba AuctionViaInternet are also Licensed as Auctioneers in Ohio. It is hereby announced that for this auction which is implicitly " with reserve, the auctioneer is allowed to bid at this auction as are the "seller's" of the items ( up to but not beyond reserve values). Please only bid if you want to purchase the item. Being the final high bidder is in fact agreement to be the purchaser under the terms herein detailed. Invoices are sent but not always arrive. Failure of arrival of an emailed invoice DOES NOT VOID THE CONTRACT TO PURCHASE. If you do not see an invoice within 24 hours, call the auctioneer at 614 267 5100. And email auctioneer at delphia@aol.com Also your bids can be seen by going to the auction ( past ) auction and logging in and looking at your current bids You can see your high bids by clicking on your name at bidder page and looking at current bid, high bidder or " you may have won" means you are the purchaser. Credit cards will be run as per the terms here and agreed to by virtue of registering for the auction… If you do not see an invoice please contact us to arrange pick up. Bidding authorizes payment whether the bidder (you) pick up and take possession of the item or not.
PICK UP for this event will be on FRIDAY , SATURDAY, SUNDAY, MONDAY, and Tuesday , Wednesday AFTER THE AUCTION ENDS ON Thursday October 10 2024
Paul Delphia, Auctioneer can ship items that can be shipped with a crating fee, time delay and with buyer paying the actual shipping but only if the suitability of an item for shipping is discussed with the Auctioneer prior to the close of the online bidding. Via Delphia@aol.com
The items in this online auction are selling as is with no warranties expressed or implied including the suitability of that item for any particular use, EXCEPT THAT THE BUYER CAN VOID THE PURCHASE AND PAY A 5% of the bid price as a RESTOCKING FEE IF HE/SHE IS NOT HAPPY WITH THE ITEM at the time of pick up, on Friday October 11 2024 but ONLY if that decision in made and shared with the auctioneer at the pick up site otherwise the items ae selling :"as is" with no guaranty of any kind including the "use" of the item for any particular purpose.
All credit card purchases are done so with the bidder understanding the "as is" nature of the sale and thereby agrees to void ( not implement ) any normal right of recession that follows with their credit card purchases. That is, the buyer using a credit card to pay for items at this internet auction, online bidding event, agrees, here at time of registration and acceptance of these terms, to not use any dispute options that the buyer might otherwise have with his or her credit card issuing entity since the items are selling "as is". Registration for this auction implies that the bidder has read the above and agrees to these terms.
PURCHASE TOTAL IS THE BID PRICE PLUS 15% BUYER'S PREMIUM
BUYER GIVES PERMISION HERE AS PART OF THE TERMS FOR THE AUCTIONEER TO RUN THE BUYER'S CREDIT CARD USED TO REGISTER and that the card can be RUN AT ANY TIME AFTER 10 A.M. on Friday October 11 2024 .The contract to purchase made by being the high bidder an agreement to have the auctioneer process payment via credit card is in place whether the buyer comes to pick up or receives the items purchased or not.
PLEASE CONTACT AUCTIONEER ON FRIDAY October 11 , 2024 prior to 10 am.. to tell us If you desire to pay with your purchase with a different credit card than that which was used to register. but this does not negate the above agreement to authorize auctioneer to run the credit card used to register if other payment is not actually made in a timely manner
Declined credit card transaction attempts may result in the purchase being voided by the auctioneer and the bidder being disallowed to participate in future auctions
WE ARE NOT ABLE TO Accept CHECKS OF ANY KIND FOR THIS TYPE OF EVENT
Bidders/buyers will be asked to sign the above terms for this auction at pick up also
Bidder/ Buyer hereby authorizes auctioneer to use email and phone numbers provided by the bidder to the auctioneer for emailing, faxes and text messages in the future
Buyer agrees to the above terms of this auction, BY Registering for the online bidding and further acknowledge by signing here upon pick up of the item(s)
