Terms and Conditions of Sales
Any prospective bidder who bids on any item, herein agrees to these terms and conditions of sale of the Claystrong Auction Company (herein often referred to as the “auction company”) relative to property being offered for sale at the auction. The auction company has made every effort to catalog and correctly describe the property to be sold, however, all lots are sold “as is” and should be examined carefully prior to bidding. Any additional condition questions should be made 24 hours prior to the start of the auction. In all matters, the auction will be final.
By participating in the sale, the bidder agrees to be bound by the following:
Registration: All bidders must register for a buyers number and provide satisfactory identification. A 15% in-house Buyer’s Premium is added to each item sold at auction. . All bidders buying online must use a credit card if they are having their items shipped. If online buyers pick up items in person, they may use cash or check.
Sales tax: A 6% sales tax will be added to each item sold except for bidders with a Dealer Sales Tax Exemption on file with the auction before the bidder checks out for the day.
Absentee bidding: Absentee bidding or “left bids” will be accepted with a valid credit card on file. Absentee bidders will pay a 15% buyers fee. In the event of a tie between a floor bidder and an online bidder, the floor will take precedence.
On-Live Bidding: On live bidders will pay the 15% buyers premium. The auction company will not be responsible for any omissions, errors, or slow communications on absentee or online bidding. Items purchased will be shipped only to the address on the credit card on file.
Phone Bidding: All requested to make phone bids must be made 24 hours in advance of the auction. The phone bidder agrees to securing all bids with a valid credit card.
Payments: Payments must be made prior to removal of the items from the auction house. All bidders must settle their accounts on the day of the sale. Any items requiring shipping will be sent only to the address on the credit card. All credit card purchases will incur a 15% buyers premium.
All Items Sold As Is: The bidder agrees that all items should be inspected as to condition, size and whether or not any repairs are required. All descriptions made in the catalog are statements of opinion and are not to be relied on as statement of fact. The auction company assumes no risk, liability or responsibility for the authenticity of any of the property described in the catalog.
Withdrawal: The auction company reserves the right to withdraw any property before sale and shall have no liability for such withdrawal.
Reserves: Unless the sale is advertised and announced as a sale without reserves, each lot may be offered subject to the reserve. The auction company may implement such reserves by bidding through its responsibilities on behalf of the owner.
Successful Bid: On the fall of the auctioneer's hammer, title to the offered lot will pass from owner to the highest bidder. Such bidder assumes all rights and responsibilities to pay for the item before leaving the auction house or before the auction has reached the final deadline for payment.
Removal of Property: The bidder, at bidders expense must remove the property from the auction house premises within the required time declared by the auction house at the beginning of each auction. Bidder agrees that any property that is paid for but left behind at the auction house for 30 or more calendar days, will be the property of the auction house.
