1. All items offered in this auction sell ‘As-Is’ and ‘Where-Is’ with no warranties expressed or implied. 2. If you choose to bid without attending the in-person viewing day you assume all risk and are bound to all rules of the auction! So if you are not comfortable bidding prior to inspection, we highly recommend that you attend the in-person review day first and bid after. If you waive your right to personal inspection, bidder assumed all risks in placing their bid without having inspected the item. 3. All sales are final. No refunds will be made. Bidders were afforded an opportunity to examine the merchandise prior to the auction. Failure to examine the merchandise prior to the auction in no way relieves successful bidder of the obligation to pay for the items purchased. We emphasize that goods offered are, with few exceptions, Used items. We highly recommend making personal inspection on the designated viewing day. Auction company does Not test or Check merchandise for functionality or completeness. Items that are mechanical, electric, electronic or made of a material susceptible to breaking should be personally inspected to the satisfaction of the bidder. Bidders who do not do this should understand and be aware they assume all risk for purchasing items not inspected. 4. No Show buyers will be subject to any and all remedies permitted by law. Not limited to collection for bid amounts placed. Auction company reserves the right to determine any lot which is not picked up within the posted time frame to be a 'No Sale' at which point the lot is considered surrendered. No Show bidders who do not have good cause and do not contact the auction company to make alternative arrangements will be subject to being banned and blocked from future auctions. 5. Items offered for sale in this auction are from an estate(s). 6. Lot numbers will not necessarily start at zero. Inventory control labels available at time of listing dictate lot start and sequence. 7. Descriptions, sizes, colors, operating condition, or other information offered as part of the listing is for reference only. Potential bidders are responsible for verifying information regarding the item. If you are at all in doubt, please attend preview. If you win a lot you are legally obligated to complete the transaction regardless of any description, interpreted or implied. Auction company makes no representation of condition of any item. All lots will remain open for bidding so long as bids are received prior to the scheduled ending time. If a bid is received in this time frame, the bidding on that lot is extended for 1 additional minute. This can be repeated numerous times 9. No contingencies are offered or accepted regarding the purchase of any item in this auction. 10. Pay at the sale pickup location only. NO ONLINE PAYMENTS ACCEPTED. WE DO NOT PROCESS PAYMENTS THROUGH HIBID. YOU MUST PAY IN PERSON AT PICKUP! 11. Purchases must be picked up during the advertised pick up hours of August 19th 12-7PM. Failure to pick up on time will result in your credit card being charged at the end of pick up hours. You will incur a $75.00 reschedule fee if agent/auctioneer has to make a special trip to the auction site. 12. The purchaser is responsible for the merchandise once the auction ends, including packing and loading at the pickup site. In the event an employee is present and is available to help you load, kindly tip them as loading is not their responsibility or in their job description. Please Do Not count on there being dedicated help for this purpose. You MUST be able to pickup your items at sale location on 8-19-24 to qualify to bid. 13. The individual who appears as the registered bidder will be responsible for any and all purchases made on his/her registration (bid number) 14. A 15% buyer premium will be added to the winning bid on each item to determine the final price. 15. 4% will be added to the total invoice if a credit or debit card is used as the method of payment. 16. ABSOLUTELY NO Delivery or Shipping! Please pick up your items within the scheduled time frame. Please take note that in many cases the estate property where the contents are being held needs to be transferred in a timely manner. Items can not typically be held beyond the pickup window. There are exceptions (machinery, heavy equipment, cars, etc). But please do not bid on an item if you can not pick it up in person on the designated pickup date. If you need to make alternative arrangements, they must be done in advance and with the auction company's approval. Special pickup arrangements shall incur a fee. 17. Seller and Auction Company not responsible for accidents. 18. NO Cherry Picking. If you purchase a lot that has multiple items, you MUST take ALL items. When buying furniture or beds, No speculation bids. If you bid on it and win the bid, it is your responsibility to take it. You may not leave it if you change your mind. You may not leave mattresses. Any bidder who leaves items will be subject to being banned from bidding on future auctions and having negative bidder status issued. 19. By registering to bid, you acknowledge and accept All terms and conditions of sale. Please bring any boxes or packing supplies for the items you win. Also please ensure you bring sufficient assistance to move your purchase. We do not have anyone on staff dedicated to moving items for you. In the event someone on our staff is on hand and does assist you, kindly remember to tip them, as moving items is not in their job description and they do not get paid by us for that. 20. No Canceling or Retracting of bids allowed. Please understand that your bid represents a legally binding agreement. We do not care if your 2 year old couldn't live without a china cabinet and took your phone and used it to bid. We do not care if the family cat was so enamored with that silverware that he jumped right on that bid button. If a bid is made from your account and you win, you are legally obligated to pay. No bidder remorse. Please consider your bid before you place it. 21.Descriptions, sizes, colors, operating condition, or other information offered as part of the listing is for reference only. The term Title NOT Present or no notation indicates that you are buying without title and are assuming all risks with regards to future registration. Electronic Devices and Computers. Auction company does Not check or test any computer, phone, tablet, or other smart device for functionality. Furthermore, we do not know the security status of any given device. Password or bio protection measures employed by the original owners are not always disabled. Please understand this as auction company cannot make any adjustments or refunds for any device purchased which is password protected, or otherwise encrypted with security measures or otherwise disabled. We caution buyers that with these items it is especially important for them to attend the preview day and check these devices to their satisfaction Prior to bidding. IF you purchase any lot which falls into this category without personal inspection or having discovered the auction after preview, you assume all risk associated with buying the device based solely upon the photo. In agreeing to these terms and conditions you expressly waive all rights of inspection by placing a bid on any given lot in this category. 22. SOFT CLOSING. ALL ITEMS IN THIS AUCTION END WITH A SOFT CLOSING. THIS MEANS THAT ANY BID PLACED IN THE LAST 2 MINUTES WILL AUTOMATICALLY EXTEND THE AUCTION BY 2 MINUTES. THIS CAN HAPPEN MULTIPLE TIMES. THE END OF AUCTION LOT WILL ONLY OCCUR WHEN NO ONE CONTINUES TO BID. 23. Due to space constraints, Some photos may have photos of other lots in them. Please pay attention to the lot number and description. Do not assume that all items seen in any given photo are inclusive to the lot. 24. Payment Terms: CASH. LOCAL Approved Checks shall be limited to the maximum amount of $1000.00. Unless you present a bank letter of credit written on ORIGINAL bank letterhead. REDUNDANCY VERIFICATION ON ANY CHECK MAY BE PERFORMED PRIOR TO RELEASE OF ITEMS. Checks must be approved by the cashier And the automated clearance system Before they will be accepted. Checks are accepted on a privileged case by case basis. If you have not done business with us before and wish to avoid potential issues Cash is King. SOME LOTS OF HIGHER VALUE ARE NOT ELIGIBLE TO BE SETTLED BY CHECK AND MUST BE SETTLED BY CASH OR WIRE ONLY. THESE LOTS ARE DESIGNATED IN THE LOT DESCRIPTION. CREDIT CARDS must be presented by the owner and they must present a matching government issued ID in order for the card to be accepted. Card transactions will have a 4% fee added to the total. Credit card purchases are limited to a maximum of $2500. A photo of Buyer and their ID will be taken with any check or card transaction. 25. We again remind you that this auction has a 15% BUYERS PREMIUM which shall be added to the hammer price. Please take this amount into consideration of your overall bid. There is no cap on the BP. 26. Seller Statements: Sometimes the Seller will have the auction company list specific details on a lot. This information is found in the description field of the lot. Auction Company is only relaying the SELLER'S statement of condition and does not warranty the description, nor attest to it's accuracy. This statement should be in no way considered a warranty. It is Not a statement from the auction company. It is merely the seller conveying information they deem pertinent. 27. Preview Day. (August 12 from 2-7PM) All of our online auctions have a preview day where you can come and inspect any item offered before placing a bid. If you do not attend preview day, Or discover the auction after preview day has taken place, and continue to place a bid based SOLELY on the photos, you are waiving your right to personal inspection and accept the item in its uninspected, as-is, where-is condition. No matter if you attend preview or not, ALL ITEMS ARE SOLD AS-IS AND WHERE-IS. THERE ARE NO WARRANTIES EXPRESSED OR IMPLIED. AUCTION COMPANY DOES NOT CHECK THE ITEMS OFFERED FOR COMPLETENESS OR FUNCTIONALITY. NO REFUNDS SHALL BE GIVEN FOR ITEMS WHICH DO NOT FUNCTION OR ARE OTHERWISE NOT WHAT YOU EXPECTED THEY WOULD BE.
