1. You must be at least 18 years old to bid.
2. This serves as a legal agreement between you, the User/Owner, and SBM Surplus.
3. All Items on the auction sell subject to the SBM Surplus' acceptance or rejection of the high bid.
SBM has negotiated aggressively low minimums with all it's consigners, however, we reserve and maintain the right to use Blind or Posted reserves to ensure our auctions meet our consigners desired minimums.
Items sell as AS-IS, and are as described, at the time of sale.
We specialize in Never sold overstock and or clearance items. We will describe all items to such extent that we are aware be it working or non working condition. Provided information, pictures and descriptions of items are exactly the sum total of information that we know of and or can provide on said item.
Once you register, you confirm that you have read and understood all the terms of the online auctions.
4. Bidders will need to sign up with a HiBid Account and have a Valid Credit Card required for bidding approval.
Bidder must bid on items based upon all information provided. Items are as described or shown. No bids can be withdrawn after the auction for any reason. SBM Surplus shall have no liability for as a result of any errors in descriptions cataloging, mislabeling, or imperfections of any item. Items are as-is-where-is without any warranties or guarantees, either express or implied by SBM Surplus. If an item has a known factory warranty or guarantee it will be expressed in the listing, otherwise assume that the items warranty will be your responsibility to explore and or determine on your own.
SBM Surplus reserves the right to decline Bidders if necessary, Cancel, Postpone or Pause the auction, withdraw any lot at any time before the auction ends without liability.
5. By placing a bid, buyers acknowledge that they have bid based upon description or information provided. However, SBM Surplus sells upon reputation and our word. IF upon pickup you are not 100% satisfied with your item and or it is not exactly as described, you may request a refund. This policy is in-effect as a reasonable practice to offer bidders in-lieu of in-person previews.
Each Auction has its own ending time listed on SBM Surplus' HiBid Auction site(s). Auctions will end automatically ay the time specified unless extended bidding time is in effect. SBM Surplus is not liable for any software, or software malfunction discrepancies
6. EMAIL: Bidders who register for any auction, will be added to our mailing & Email list. By agreeing to our terms and conditions, bidders agree to opt-in to each list. Email or mail recipients may opt-out at any time.
7. Removal and Failure to Remove: All purchases must be removed from the auction site without damaging any property and within the time announced or posted. All costs, responsibilities, and risks of such removal shall be borne by the buyer, and, in any case, the buyer will use prudence and care in such removal. If ,for any reason, buyers fail to remove any of the buyer purchases within the time specified the buyer’s bid number will be terminated, and the buyer will not be allowed to sell/purchase on SBM Surplus' Auctions.
Item removal will be the responsibility of the buyer within time specified for that auction.
If you cannot pick up on the last day of removal, the card on file will be charged. Items paid by highest bidder, but not removed by the time allotted for that auction, will be considered forffeited or abandoned, and will be disposed of at the discretion of SBM Surplus Online Auctions. No refunds will be given for failure to pickup.
At the time of removal, the highest bidders are responsible for checking that all paid purchased items are in their possession. You will be required to have a staff member validate by signature that you have received ALL items you have won/purchased. If there is a discrepancy, it must be resolved within one day of pickup. Any paperwork or claims presented after your items picked up that do not include a two party signature will be immediately discredited as invalid.
8. Methods of Payments Include:
a. Credit Card only (no fee's for processing debit or credit cards will be accessed as additional cc processing fees are not legal for us or any business to charge)- However, please note that you must have a paid online and fully paid invoice upon arrival. We will not take or accept payment for auction items at pickup locations.
Iowa Sale Tax (of 7%) will be charged on all sales originating in Iowa and or at a SBM Surplus Iowa pickup location
9. Shipping:
a. Highest bidder will be responsible for shipping & Handling Costs
b. 7% Iowa Sales Tax will be charged
c. SBM Surplus will not be held responsible for any lost items in shipping as it is out of our control. All shipping providers offer insurance and signature options. It will be added to your shipping only by request. You are fully responsible for paying and dictating any or all options added or excluded on shipping terms. A shipping invoice will be provided and must be paid prior to shipping. It will be accessed in addition to your original online auction invoice. Shipping and Handling fees will be outlined on all shipping invoices and are agreed to upon payment.
