3. CHECK-OUT DATES: Once purchase is paid for in full, assets can begin to be removed. Auction project manager will be available for check-out by winning bidder(s) from Wednesday, July 10, 2024 through Friday, July 12, 2024 from 9:00 am to 3:00 pm.
4. ALL ITEMS SOLD "AS IS, WHERE IS, NO WARRANTY EXPRESSED OR IMPLIED". SOLD BY MEANS OF ONLINE BIDDING ONLY.
5. Auctioneer makes no representation as to the operating condition of any equipment in this abandoned property public auction sale.
6. NO LABOR WILL BE PROVIDED NOR WILL MACHINERY BE AVAILABLE BY AUCTIONEER OR SELLER TO ASSIST SUCCESSFUL BUYERS WITH ASSET LOADING OR REMOVAL. BUYER WILL BE SOLELY RESPONSIBLE FOR ALL PERSONNEL AND EQUIPMENT NEEDED TO LOAD AND REMOVE ANY STONE, EQUIPMENT OR OTHER ASSET(S) PURCHASED AT THE AUCTION. Auctioneer does not provide packaging, crating or shipping services. Buyers are solely responsible for the packaging and all costs of removal of their purchases within the check-out days stated in terms and conditions above.
7. CURRENT PHONE NUMBER REQUIRED. Bidders must provide a valid telephone number which will be verified.
8. PAYMENT TERMS: Cash, cashier's check or wire transfer ONLY must be within 24 hours of close of sale. NO CREDIT CARDS will be accepted for payment. Full payment must be made prior to removal of any and all purchases. Wire transfers for balances due may be made to Asset Reliance, Inc. NOTE: ALL WIRE TRANSFERS REGARDLESS OF AMOUNT MUST ALSO INCLUDE A $15 FEE ADDED TO THE INVOICE AMOUNT. INVOICES WILL NOT BE CONSIDERED PAID IN FULL WITHOUT THE WIRE TRANSFER FEE INCLUDED. Contact Auctioneer for wire transfer instructions/information. In order to insure proper credit, it is important to include the name of the auction, your name and your buyer number in the wire transfer instructions.
a) In the event the purchaser fails to pay the purchase price within the time limits set forth in these stated terms and conditions (within 24 hours after close of sale) or fails to comply with any of the terms of the sale including removal of purchases time frames, the seller may resell any and all of the purchaser's merchandise in the possession of auctioneers to a back-up bidder if any or dispose of the item(s).
9. SALES TAX: Sales taxes will be added to the purchase price of all taxable items. Dealers who purchase for resale must pay the sales tax or provide valid resale number and completed reseller certificate (California Form bo3230.pdf). Dealers who purchase for resale must be buying items which are congruent by the nature of their specific resale business.
a) NOTE: Out-of-State buyers are NOT exempt from California sales tax unless the purchase is removed from auction site by common carrier and delivered directly to buyer's out of state address. Common carrier bill of lading copy must be provided to Auctioneer.
10. Items will be offered piece-by-piece/by lot.
11. All sales are final. Purchaser agrees to pay all costs of removal and purchaser does hereby indemnify and hold harmless auctioneers and seller for any and all damage, claim or liability for injuries to persons or property caused by the removal of items purchased. Bidders are strongly advised to inspect assets at the sale preview date on Monday, July 8, 2024.
12. Buyer and/or their truckers/riggers are solely responsible to provide all labor personnel, equipment and material needed to pick up and remove purchases and shall assume all responsibility for the removal of any item of property purchased at the sale and any and all risks associated with such removal including, without limitations, full financial responsibility for any damage or liability to persons or property resulting from any negligent act or omission of buyer or any of buyer's employees, agents and/or representatives during pick-up and removal.
13. Buyer's machinery movers/riggers authorized by buyer to perform work on the premises or to remove any purchases WILL BE REQUIRED TO PROVIDE PROOF OF LIABILITY INSURANCE AND WORKERS COMPENSATION COVERAGE BEFORE THE REMOVAL SHALL BE PERMITTED TO COMMENCE.
14. Quantities, descriptions and capacities are believed to be correct. However, there are no guarantees and the auctioneers or advertising media will not be held responsible for any written or verbal discrepancies or inaccuracies whatsoever. Buyer is encouraged to do their own due diligence and site inspection prior to sale of items being sold.
15. This auction is an absolute auction with no reserves or minimum prices required by seller.
16. Any announcements or corrections/additions posted the day of the auction sale online or after a buyer may have registered take precedence over catalog, website or other previously announced or posted documented information but do not alter in any way the basic terms and conditions of this sale.
17. Persons in attendance during inspection, sale or removal of merchandise assume all risks of damage or loss to persons, property or merchandise and shall exercise proper precautions at all times for the protection of persons and property and shall comply with all safety and health requirements as provided by any local, state and federal regulations and as directed by Auctioneer.
18. Neither Auctioneer, its agents, its employees or representatives shall be liable by reason of any defect in or about the condition of the premises on which the auction is held. Buyer specifically releases Auctioneer, its agents and representatives from all liability thereof.
19. At no time shall a buyer be in the facility without an Asset Reliance, Inc. employee during preview and/or check-out.
20. Auctioneer reserves the right to accept bids in any increment Auctioneer feels is in the best interest of his client, the Seller. The Auctioneer reserves the right to reject the bidding of any registered bidder not approved by Auctioneer for bidding.
21. The Auctioneer reserves the right to add or delete lots. Auction sales may be cancelled for reasons beyond Auctioneer's control. Auctioneer assumes no liability for expenses or time-loss incurred by buyers in the event of a third party forced cancellation of an auction sale.
VEHICLE TITLE & REGISTRATION DISCLOSURES:
22. Asset Reliance, Inc. is not a licensed auto dealer. Vehicles are sold under DMV dealer license requirement exemptions for vehicles sold via public auction by auctioneers. It will be the buyer's responsibility to pay any sales tax, registration fees, title transfer fees and registration costs on titled vehicles sold at the auction sale directly to California DMV before the vehicle can be legal to operate on California roadways or state highways.
Auctioneer has attempted to discover and disclose to buyers the presence of any past due DMV fees that are known to exist on vehicles offered for sale in the auction. However, under California vehicle code section 9562(b), the new purchaser may REQUEST past due fees and penalties be waived by DMV since they accrued through no fault or intent of the new owner prior to new owner's purchase of the vehicle. In no case does auctioneer assume any responsibility or liability for past due DMV fees on vehicles sold at this auction.
23. VEHICLE CONDITION AND HISTORY DISCLAIMER: All vehicles sold through Asset Relianc, Inc. as auctioneer are sold "as is, where is" without any warranty expressed or implied, including but not limited to any warranty of fitness for a particular purpose or merchantability. The term "vehicle(s)" shall mean all items for sale by Asset Reliance, Inc. including but not limited to cars, trucks, motorcycles, boats, jet skis, industrial equipment, trailers, RV's, etc. Asset Reliance, Inc. and its vehicle seller expressly disclaim the accuracy or completeness of any and all information provided to buyers regarding vehicles, whether provided in written, verbal or digital image ("Vehicle Information"). Vehicle information provided by Asset Reliance, Inc. and its vehicle sellers is for convenience only. Buyers shall not rely on vehicle information in deciding whether or how much to bid on a vehicle offered for sale by Asset Reliance, Inc. Vehicle information includes but is not limited to: year, make, model, condition, ACV, damage amount, damage type, drivability, accessories, mileage, odometer disclosures, vehicle identification number (e.g. "VIN", "HIN", and serial number), title, repair cost, repair history, title history, and total loss history. Asset Reliance, Inc. and its vehicle seller expressly disclaim any and all representations, warranties, and guarantees regarding vehicles sold by Asset Reliance, Inc. Certain jurisdictions permit vehicles to be sold with missing vin plates; as a result, Asset Reliance, Inc. does not guarantee that vehicles meet or can be modified to meet local emission and/or security requirements. It is the sole responsibility of the buyer to ascertain, confirm, research, inspect, and/or investigate vehicles and any and all vehicle information prior to bidding on vehicles.
All buyers agree that Asset Reliance, Inc. vehicles are sold "as is" and are not represented as being in a road worthy condition, mechanically sound, or maintained at any guaranteed level of quality.
REGISTRATION LAWS DISCLAIMER: Asset Reliance, Inc. does not guarantee that any vehicle sold can be legally registered in any state or country, and buyer accepts all risks associated with variations in vehicle title and registration laws between states, provinces, and countries that may negatively impact the marketability of vehicles purchased from Auctioneer. (For example, a vehicle legally purchased on a clean title by a buyer at an Asset Reliance, Inc. auction located in state "A" may be required to be sold on a salvage title if buyer transports and resells the vehicle in state "B".)
