Kurtz Auction & Realty Online Bidder Agreement
1. I acknowledge that I have viewed or received a copy of the Online Bidder Auction Infirmation packet, which includes information about the property, Auction Day Announcements (terms and conditions), and Real Estate Purchase Contract. A copy of the packet is available for review at kurtzauction.com within 24 hours of the auction, or a copy of the packet may be requested by emailing the auctionner-in-charge.
2. I have read the Online Bidder Auction Information packet and understand and agree to abide by the terms and conditions of the auction.
3. I understand that a monetary deposit is required to bid online. Kurtz Auction & Realty must receive and acknowledge the deposit before online bidding privileges are granted to the proposed bidder.
4. I currently have sufficient funds to meet the "Escrow Deposit" and will fund and complete the transaction as outlined in the Real Estate Purchase Contract.
5. I have examined the Real Estate Purchase Contract and understand that it is a legally binding contract that is not contingent upon financing, inspections, or anything that would prevent a successful closing.
6. I understand the property is being sold "As-Is" and it is my sole responsiblity to satisfy myself regarding and inspections, current condition, usability, etc., prior to bidding.
7. I understand that if I am the successful bidder, I agree to complete and sign the Real Estate Purchase Contract immediately upon conclusion of the auction and place a 10% escrow deposit as outlined in the Real Estate Purchase Contract.
8. I understand that my registration for the auction will not be accepted without providing my name, address, phone, and valid ID, completing a bidding deposit, and signing and returning a copy of this form. By doing so, I am agreeing to and accepting the terms and conditions of the auction set forth in the Online Bidder Auction Information packet and any announcements on the day of the auction that supersede advertising.
9. I hereto agree to sign electronically, and the electronic signature shall have the same force and effect as an original signature.
10. I release and hold harmless the Seller, Kurtz Auction & Realty, its employees, and agents from and against any all liability for any damage, injury, or loss of any kind arising or resulting from or in connection with the activities of the sale of the subject property.
Terms: 10% down at the auction with the balance due on or before August 23, 2024, Possession with deed. Property taxes will be prorated to date of closing.
On-Line Terms: 1% buyers premium added to the successful bid price. Pre-registration along with pre-bidding deposit to Kurtz Auction escrow account in order to bid. 10% down by Wed., July 10th, 2024 at 3 P.M. Balance due on or before Aug. 23rd, 2024, possession with deed.
