• This auction sale will be conducted within the framework of the rules listed below and other provisions that may be added by the auctioneer via e-mail.
• The Bidder(s) and Eclectic Mementos agree that the terms listed below shall govern each and every online auction sale.
• All registration information the Bidder provides to Eclectic Mementos shall be current, complete, and accurate. All bidders must be 18 years of age or older. The bidder agrees to not use any device, software, or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during any auction sale.
• All items sold "AS IS, WHERE IS" with all faults. No guarantees, warranties, refunds, or exchanges.
• The descriptions of item/lots appearing in the auction and in advertising prior to the auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by Owner/Seller or Auctioneer and employees concerning any item/lot shall be construed as a warranty, either expressed or implied. ITEM/LOTS ARE ALL SOLD AS IS - WHERE IS – HOW IS and WITH ALL FAULTS, known, apparent, or otherwise. Bidder acknowledges that all item/lots were available for inspection prior to the auction and, by these terms, Eclectic Mementos and Owner/Seller strongly encouraged Bidder to carefully inspect each item/lot in which Bidder had any interest to determine the item/lot’s nature, quality, condition, quantity, and size. All Bidders rely solely on their personal inspection and not on information listed on the Site or otherwise provided by Eclectic Mementos and employees or Owner/Seller. Bidder’s failure to inspect, or otherwise to be fully informed as to the nature, quality, condition, quantity, and size of any item/lot will not constitute grounds for any claim, adjustment, refund, termination of the contract for sale, or refusal to close the sale, against Eclectic Mementos or Owner/Seller.
• All descriptions believed accurate but not guaranteed. Pictures are also considered a part of the description, please look at all pictures.
• Bidder inspection is encouraged. There are no refunds or reverse bids, inspect before you bid, ask questions.
• By placing a bid, the bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. The buyer must acknowledge and agree not to retract their purchase offer.
• In the event of failure of the online bidding system or other technical failure, Eclectic Mementos reserves the right to cancel, extend and/or reopen the auction. Unless the auction is announced as absolute, Eclectic Mementos has the right to reject any and all bids. Eclectic Mementos further has the right to bid on behalf of the buyer, the seller, or on their own behalf.
• Eclectic Mementos reserves the right to reject any bid at our discretion.
• NC taxes will be charged unless otherwise stated. If you are exempt from paying sales tax you must provide the auction a copy of your state tax # and fill out a tax exemption form.
• Buyer's premium rate charged: 10%,
• Payment types Cash, Master Card, Visa, Discover, American Express, Wire Transfer. Full payment must be made before any items leave the premises. The bidder agrees not to pursue chargebacks on any credit card payments. All invoices totaling $500 or more can't be paid with a credit/debit card and must be paid by Wire Transfer or cash.
• Any item not picked up within 10 business days of conclusion of the auction at our warehouse will be forfeited, no matter of payment status. If an auction is at a private residence or another business, items must be picked up on the assigned pick-up days, no extensions. ***Shipping is mandatory on all lots at your expense in this auction.
• When Shipping is available on most lots, we will state NO shipping in the item description if not available for that item. Buyers will be responsible for setting up shipping for all non-shippable items.
• Eclectic Mementos is shipping in-house. You will have two separate charges on your Hibid card on file. Your auction invoice will be charged to your card on file immediately after the auction unless other arrangements have been made prior. You will have a 2nd charge to your card on file for shipping costs once packaged & weighed. We charge actual shipping costs based on weight plus a $5 handling fee. Please note we do use recycled packing materials to keep your shipping costs as low as possible. You, the buyer, are responsible for ALL shipping costs. We cannot give shipping estimates on items.
• Cards on file with HIBID will automatically be charged at the conclusion of the auction. Please be sure your card on file with HIBID will be able to be charged your full total and shipping and handling charges. If your card on file is declined, we will contact you for payment only once. If you do not respond you will be banned from further auctions.
• Local Pick-ups- Please bring your own boxes, paper for wrapping your winnings and HELP to load your items.
• Local pick-up customers- Eclectic Mementos nor the seller is responsible for any accidents or harm to you or others that come with you nor your physical property when picking up at our warehouse or the seller’s location. Bidder acknowledges responsibility for any personal injury and/or property damage caused by Bidder or his Agent, and further agrees to hold Auctioneers, Owners, its Officers, or Employees harmless for any personal injury to himself and/or his Agents and any property damage incurred on auction premises.
