***THERE WILL NOT BE ANY EXCEPTIONS MADE TO THE TERMS STATED BELOW. YOU ACKNOWLEDGE AND AGREE TO THESE TERMS UPON REGISTRATION FOR THE AUCTION***
INTERNET BUYERS PREMIUM OF 15% ON ALL MERCHANDISE.
The credit card used for registration will be charged following the auction. Exceptions may be made for alternate payment methods pending authorization by the auctioneer. If you are requesting an alternate payment option you must call ahead of time for approval or leave this information in "The Notes to The Auctioneer" at the time of registration. If alternative payment is approved, we accept cash, wire transfer or a separate credit card. Please note the 15% buyer's fee applies to all purchases regardless of payment method. A 6% State Sales tax will be applied to all sales unless you present a sales tax exemption form. The credit card that bidders select to use from their HiBid account at the time of registration will be authorized at that time.
We accept Visa, MasterCard & Discover ONLY. Credit card chargeback's will not be accepted. Auction Company reserves the right to request a different form of payment (wire transfer or check) for larger amounts.
Please note that the merchandise must be pickup up during specified pickup times on the specified date. There is no storage available. Buyers should bring their own moving personnel and equipment, if needed.
If you would like to have your items shipped, please notify the auction company within 24 hours of close of auction. Small items only are available for shipping. Methods of shipment are solely at the discretion of Superior Auction LLC and we will make every effort to find the best shipping rates available. Shipping cost is the sole responsibility of the buyer. If we determine that a third-party shipping service is in the best interest of the customer, we will be transporting the items to our local Pack & Ship Center. You will be contacted by the Pack & Ship facility and the shipping transaction and payment will be a separate transaction between you and them. Buyers are responsible for all packing, shipping and insurance costs.
If items are not picked up during the scheduled pick-up times and we are able to transport them, you will be charged $20.00 per lot for transportation back to our office. This only applies to smaller items; we cannot transport large items.
Transportation fees will not be charged if you are having your order shipped and have contacted us to make shipment arrangements. If you do not pick-up your items or if you fail to make arrangements for pick-up or shipping, your items will be disposed of or resold at our discretion. You forfeit your rights to these items, even though you have already been charged. No exceptions will be made! The buyer shall be responsible to Superior Auction LLC for any expenses of resale and collection and damages resulting from the resale.
By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. All property is sold 'AS IS, and ALL SALES ARE FINAL. It is the Bidder's responsibility to determine condition, age, authenticity, value or any other determinative factor. SUPERIOR AUCTION LLC may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall SUPERIOR AUCTION LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. We Highly Encourage Attending Or Scheduling Inspections Before Bidding. All auctions are considered with resereve unless advertised as absolute.
Superior Auction LLC. Online Auctions are timed events and all bidding will begin to close at specified times. Superior Auction LLC. Online Auctions feature a Soft Close. The Soft Close feature remains active until no further bids are received on an item within said items two-minute closing window. When a bid is placed in the final two minutes of an item closing, the auction bidding will automatically be extended two minutes from the time the bid was placed.
For Example: If an auction is scheduled to begin closing lots at 6:00PM and a bid is received at 5:59PM, the close time on that lot will automatically extend two minutes. Items will close every fifteen seconds there after unless there is still active bidding on said item, in which case that specific items closing time will be extended the two minutes until all active bidding has ended. For Example: The second item will schedule to close at 6:00:15, the third item closes at 6:00:30 and so on and so forth until all items have closed.
Bidder agrees that this agreement shall be governed by the laws of the state of Michigan and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Menominee County, Michigan. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between Superior Auction LLC and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Menominee County, Michigan.
Bidders who bid from offsite understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Superior Auction LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.
Superior Auction LLC is providing Internet bidding as a service to the bidder. The bidder acknowledges and understands that this service may or may not function correctly the days of the auction. Under no circumstances shall bidder have any kind of claim against Superior Auction LLC or anyone else if the Internet service fails to work correctly before or during the auction. Superior Auction LLC will not be responsible for any missed bids from any source. Superior Auction LLC reserves the right to withdraw or re-catalog items in this auction.
Buyers may be required to pay any applicable state and local sales tax unless you have a resale number on file with Superior Auction LLC PRIOR TO THE SALE-NO EXCEPTIONS. Sales tax applies to the entire transaction including the buyer fee.
In the event of failure of the online bidding system or other technical failure, Superior Auction LLC reserves the right to cancel and/or reopen the auction.
