WILL BE POSTING NEW ITEMS DAILY UPDATE!!!! DATE CHANGE due to weather we have pushed auction close date out another week. Preview is March 19,20,21 8am to 4pm each day! ONLINE BIDDING OPENS: 3/4/24 @ 1 pm PST. Online auction begins to soft close: 3/21/2024 @ 5 pm PST. A "soft close" means if any bid is placed within the last 2 minutes at the close of the auction, the bid will automatically extend the closing time an additional 3 min. Inventory includes, Mini excavator, tractors, vehicles, Antique collection of telegraph, phones, wood airplane prop, building supplies, tools and much more.
1) INTERNET ONLY AUCTION TERMS AND CONDITIONS: All items sold "as is where is" with any faults. ALL DESCRIPTIONS ARE BELEIVED TO BE CORRECT, THE AUCTIONEERS OR THE OWNER MAKE NO WARRANTIES OR GUARANTEES EXPRESSED OR IMPLIED, as to the authenticity of or defect in any lot and will not be held responsible for any advertising errors, discrepancies, or inaccuracies. All Buyers are to be responsible for all inspections of items at preview times or inspection. MOTORIZED LOTS SOLD "AS IS " CONDITION. MOST ITEMS ARE PRE-OWNED AND THERE IS NO WARRANTY OR GUARANTEE FROM WINNEMUCCA AUCTION COMPANY. WE WILL TRY TO MAKE NOTE OF ANY KNOWN CONDITION. MOST ITEMS DO NOT GO THRU A FUNCTIONALCHECK SYSTEM WHEN ENTERED INTO THE AUCTION. EVERY BIDDER SHOULD PREVIEW PRIOR TO BIDDING. ALL SALES ARE FINAL! YOU ARE WELCOME TO BRING ALONG AN EXPERT TO EVALUATE THE ITEM. 2) 10% buyer's premium on each item $5000.00 and under. Over $5000.00 Buyers premium capped at $500.00. Example ($5000.00 @10% = 500.00), ($7500.00 = $500.00) 3) All purchases to be paid at the conclusion of the auction. Payment may be made by cash or check. Debit and Credit Cards accepted with a 3% Convenience Fee. Any unpaid amounts will incur interest of 18% per diem. Your credit card on file is automatically charged, unless other payment arrangements are received within 2 days. Please reach out to Winnemucca Auction co. if payment issues arise. 4) If charges are declined by the credit card processor a non-sufficient funds charge of $25.00 will be charged each time processing is denied. The buyer will be notified of NSF transaction through e-mail and be given 24 hours to contact Winnemucca Auctions with an alternative payment method. 5) No credit card charge backs will be allowed. NO refunds will be given. 6) No Credit Card Processing fees will be refunded once a credit card payment has been processed. 7) The sale is "AS IS" and "Where IS" and without warranty of any nature whatsoever. Purchasers are deemed to have conducted their own inspection and should NOT rely on descriptive information provided or statements made. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. Winnemucca Auction Company does not assume responsibility for errors or omissions as all items are available for bidder preview and inspection. 8) Items MUST be picked up within three business days following the auction, or other acceptable arrangements must be made. Items left for over three business days without arrangements will incur storage fees. Please understand space is limited and we need room for new inventory! PLEASE NOTE if left items are left past the three business days there is not guarantee items will be in same condition or easily accessible. Items left over seven days will be considered abandoned property and no longer belong to buyer. Buyer will incur any cost of disposal. 9) Purchaser will pay all legal state sales tax (6.85%), unless exemption requirements are met prior to close of auction. (Dealers resale number) 10) LOAD OUT SERVICE & APPROVAL: Winnemucca Auction Company provides both staff and EQUIPMENT to load your auction items. We are here to ASSIST you. It is the customer's responsibility to bring their own tools, pallets, posts, stickers, or straps for hauling materials - we do not provide these. Please plan your trip accordingly for safe and legal hauling. If customers provide improper equipment or vehicles *** We reserve the right to deem a load unsafe and can discontinue load out completion. ***If more than one trip is required that should not be a problem. Call our office if you have further questions 775-442-0630,775-442-0631. 11) Fraudulent bidders / Unpaid invoices: By bidding on items, you are entering a legal and binding contract and authorize charges to the card on file if necessary. Winnemucca Auction Company LLC. reserves the right, and you acknowledge and agree to its exercise of this right, to notify third parties, including law enforcement authorities, credit bureaus, other auction companies and industry regulators and authorities, about bidders involved with or connected to fraudulent bidding or the failure to fully pay invoices in accordance with our terms and conditions. 12) Winnemucca Auctions reserves the right to bid on behalf of our sellers. The vast majority of items are sold to the highest bidder. Through our frequent seller program and special cases, some items have soft reserves. Our best effort is used to create a fair market for our buyers and sellers. 13) If payment is not honored for any reason (including but not limited to N.S.F., stop payment order, or the like) purchaser agrees to pay a $75 return fee. 14) If action is necessary to enforce the terms of this agreement, purchaser agrees to pay attorney fees and costs associated with collection or action. All buyer contracts will be subject to the Humbolt County legal jurisdiction and the laws in the State of Nevada.
