We will test each item to the best of our ability, however, this does not constitute any warranty or guarantee either express or implied. Bidder is responsible to read the description on each lot prior to bidding. Bids are to be considered a legally binding contract to pay for your purchase(s). By registering to bid, bidder agrees to accept all charges placed on the credit card that bidder authorized for use at time of registration, and bidder waives any and all rights concerning chargebacks or refunds for any items charged to the authorized credit card. We reserve the right to reject any bid at our sole discretion. Lilac City Resale and associated staff reserve the right to bid for the seller, financial institutions, or their own accounts. All registered bidders are automatically added to our email newsletter list. If you wish to unsubscribe you may do so at any time. AUCTION INFORMATION: This is an online only auction. Please see the auction date/time info section for specific dates and times regarding bidding, and the checkout date/time section for specific dates and times regarding pickup. We regret that no preview date/times are available at this time. The descriptions of items/lots appearing in this auction, and/or in advertising prior to this auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statement made by owner/seller or auctioneer concerning any item/lot shall be construed as a warranty or guarantee either express or implied. Items/lots are sold as is, where is, with all faults. PAYMENT: Upon completion of the auction, Lilac City Resale will automatically process payment to the credit card that was authorized by winning bidders at the time of registration. This payment will include the total of the winning bid amount(s), 10% buyer’s premium, and 8% NYS sales tax. We accept Visa, Mastercard, American Express, and Discover. Following the successful payment, winning bidders will receive an email containing a link to their receipt to the email provided during registration. In the event that a payment is declined, Lilac City Resale will provide an invoice to the winning bidder’s email that was used for registration that will include a link to securely submit payment. If a winning bidder does not receive an invoice or receipt, please check the spam/junk folder. If an invoice or receipt has still not been received within 24 hours of auction end, please contact Alyssa at lilaccityresale@gmail.com or (585) 549-6020. Non-receipt of an invoice and/or receipt does not absolve winning bidders from responsibility for payment and/or pickup of items. There will be NO REFUNDS OR CREDIT CARD CHARGEBACKS. A hard copy of the paid invoice will be provided to winning bidders upon pickup. Please ensure that the credit card used for registration is up to date. All payment method changes must be made prior to auction registration. If you need to adjust your payment method, you must login to your account on HiBid.com, click the dropdown menu on the top left next to your name, select payment methods, and update the necessary information. Please be sure to carefully enter your credit card number, and ensure that your address matches the billing address for your credit card. Each bidder agrees that such bidder will not, under any circumstances, initiate a credit card chargeback with respect to any purchases at the auction. Each bidder further agrees that if, in violation of these terms and conditions, a credit card chargeback is initiated, these buyer terms & conditions will be conclusive evidence of the bidder's (i) waiver of any rights to initiate a credit card chargeback, and (ii) agreement not to initiate a credit card chargeback; and each bidder acknowledges and agrees that the auctioneers presentation of these bidder terms and conditions to the bank, credit card company, or other financial institutions that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to, or for the account of the auctioneer. If, in violation of these bidder terms and conditions, a bidder initiates a credit card chargeback, such bidder, even if successful, will remain liable for all purchases made at the auction, and will be responsible for all costs and expenses, including attorney's fees, incurred by or on behalf of auctioneer and/or seller in challenging the credit card chargeback and in collecting payment. Each bidder acknowledges and agrees that the covenant not to initiate a credit card chargeback is a condition to the issuance of a bidder number to such bidder and is being made as an inducement for the auctioneer to accept such bidder's bidder registration, to issue a bidder number, and to permit the bidder to bid at the auction. Each bidder acknowledges and agrees that the auctioneer is relying on the covenant not to initiate a credit card chargeback in accepting such bidder's bidder registration, in issuing a bidder number, and in permitting the bidder to bid at the auction. All items are sold in as is condition with no warranties or guarantees, implied or expressed. By registering you agree to all these terms and conditions. SALES TAX: 8% New York State sales tax will be charged on all purchases and buyer's premiums regardless of where the winning bidder resides. TAX EXEMPT: NYS requires us to collect sales tax unless we have a tax exemption certificate (ST-120) on file, no matter where you reside. We must have this information on file no later than 4:00 PM EST on the date of auction close. If we do not have the appropriate form on file by this time, sales tax will be charged. Sales tax CANNOT be refunded. Please forward all ST-120s to lilaccityresale@gmail.com. Thank you for your cooperation! PICKUP: Winning bidders are expected to pick up their purchase(s) during the specified time frame(s) at the specified location as detailed in the checkout date/time section. Purchase(s) become the full responsibility of winning bidder, and winning bidder assumes all risk of loss and damage to property until removed from sale premises. These dates/times vary by auction. If purchase(s) are not picked up during the specified time frame, items will be considered forfeited without refund, no exceptions. If you are unable to pick up items during the specified pick up times, please refrain from bidding. We DO NOT transport or hold items. Assume you need to bring your own boxes, tools to break down large items for removal, and help needed to safely remove and load purchase(s). We do understand that emergencies occur, please communicate with Alyssa at lilaccityresale@gmail.com or (585) 549-6020 in the case that an emergency should arise that may prohibit pickup. Auctioneer, Lilac City Resale, associated staff, and property owner assume no risk of accident, personal injury or property damage during any preview or on-site auction pick up. By bidding on this auction, you are assuming all liability while on property of the auction. Any person who comes with you to the property assumes the same liability. ASSISTANCE: We will do our best to assist you with loading your items. It is your responsibility to bring a large enough vehicle to haul your winning items. If you require assistance removing and/or loading items during the pickup and damage occurs to your item during this process, Lilac City Resale and/or associated staff members are not responsible for refunding or replacing your item. If you do not agree to this term, please come ready to carry and/or load without assistance. SHIPPING: Shipping is offered only on the lots indicated. Please refer to each lot details to see if shipping is available for that lot. Shipping costs will be charged as an additional charge to the credit card on file following confirmation that you would like your items shipped. You will be provided with an additional settlement receipt and a tracking number for your package. If your item(s) exceed $100 in purchase value there will be additional insurance placed on the package to be included in shipping costs. We regret that we do NOT ship outside the United States at this time. There will be a $5 flat handling fee added to each shipped order. TECHNOLOGY DISCLOSURE: By bidding with us, you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. Lilac City Resale will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the site. During an internet auction we reserve the right to cancel and/or reopen the auction in the case of system failures.
