All lots are sold "AS IS, WHERE IS". All bids and sales are final. It is the buyers responsibility to check EVERYTHING over, call, email, view with questions.
Vehicles - Can schedule a viewing, we cannot not let anyone test drive the vehicles. We test drive every vehicle and post as much as we can find out about the vehicle, however, we are not mechanics. It is the bidders sole responsibility to inspect vehicles before bidding, look up vehicle history, title status, call or email with questions, and anything else with the V.I.N. in the descriptions. If we see a title with a stamp on it (salvage, rebuilt, etc) we will note it. For the winning bidder, a $500 nonrefundable credit card charge will be placed on the credit card if Rustic Road Sales Auction has not heard anything from the winning bidder about pick up by end of day Monday following the auction, and will be applied Tuesday following the auction. If the winning bidder does come and pick up the vehicle, the $500 charge is applied towards the purchase of the vehicle. If you do not want your credit card charged, please call or email us ahead of time for scheduling a pick up. All vehicles must be paid for in cash or wire transfer only, no exceptions.
Auctions end Wednesday night starting to close at 8 pm.
Open for pick up starting the day after the auction ends - Thursday 2-6 pm, Friday 10-6, Monday 10-6.
Any items/lots not picked up or paid for by end of day Monday (following the close of the sale), will be charged to credit card on file with HiBid on Tuesday Following the Auction.
Abandonment
Any won lots not picked up or had shipping arranged 14 days following the close of the auction is considered abandonment and is property of the auction to sell, donate, etc.
Bidder, whether acting as principal, agent, officer or director of a company or otherwise, in any capacity whatsoever, and the company he or she represents, both jointly and severally,agree:
(a) to indemnify and save harmless Auctioneers and its Consignors from any and all actions, causes of action, suits, damages, costs and losses of any nature, arising from the attendance or participation of Bidder, his or her agents or employees, at the auction sale and/or on the auction site whether before, during or after the auction sale; and
(b) to be responsible for the payment of the purchase price and taxes due on all Bidder's purchases.
(c) The Bidder agrees that the Auctioneer may require Photo ID to be presented matching the invoice name prior to releasing items.
There shall be no guarantees or warranties, expressed or implied, statutory or otherwise of any nature whatsoever in respect of the Lots offered at the auction. Each and every lot will be sold "as is where is." Specifically, but without limitation, Auctioneers make no representation or warranty that any of the Lots:
(a) conform to any standard in respect of safety, pollution or hazardous material or to any standard or requirement of any applicable authority, law or regulation.
(b) are fit for any particular purpose.
(c) are merchantable or financeable.
(d) are of any particular age, year of manufacture, model, make or condition. Bidder agrees he or she has satisfied him or herself and is not relying on Auctioneers, norare Auctioneers liable for any matter in respect of the above? Bidder further agrees to repay, at his or her cost, any Lot purchased at the auction to a safe operating condition and, without limitation, to a condition that meets any standard or the requirement of any applicable authority, law or regulation, including those concerningany use to which the lot may be put.
Bidder acknowledges that an auction site is a potentially dangerous place. Flammable, noxious, corrosive, and pressurized substances are present, heavy equipment is being operated, and electricity may be live. Every person at the auction site, at any time, shall be there at his orher own risk with notice of the condition of the premises and the activities there on, and Bidder shall so advise his or her agents and employees. No person shall have any claim against Auctioneers, their agents and employees, or Principals for any injuries sustained, nor for damages to or loss of property which may occur from any cause whatsoever.
Auctioneers may, at any time, at their sole discretion and without notice or liability to Bidder:
(a) withdraw or cancel the sale of any Lot.
(b) offer any Lots in groups or with privilege.
Food - Food and ingestables in the auction, be ware, food will usually not be expired. However, food may be expired. All bidders, agents, employees, and more please look closely. Auction, consignors, sellers, are not to be held liable, for any fault, suffering, harm, damages, or any matter that may arise from ingestible contents. This is an agreement to release the auction and seller free of any responsibility or financial action to a claim, lawsuit, or any legal matter brought about by damages.
