Terms and Conditions for ONLINE Auction of Rosalia, KS 315.06 Acres +/-
NOTE: This land is currently leased for hunting rights until June 1st 2024. No one is to enter property without prior notice to and prior approval from the auctioneer. Call Mike Landwehr (316) 259-7756 to schedule a showing.
1. Auction Format All bidding for this auction is internet only. The auction will use a timed-bidding format where the bidding will start closing at the designated date and time and will use a "soft close" format; bidding will continue, and lots will not close until no bids have been entered within a specified amount of time.
2. Buyer's Premium There is a 10% buyer's premium added to the final bid amount.
3. Earnest Money Deposit - Successful bidder will sign a purchase agreement, emailed to successful bidder from United Country Farm & Home Sales Representitive. Successful bidder will submit the NON-REFUNDABLE amount of ten percent (10%) of the high bid at auction, in the form of a personal check, a business check or cashier's check and made payable to Security 1st Title, located at 2127 North Collective Ln, Wichita, KS 67206. Earnest-deposit funds will be deposited into the title company's escrow account. Said Escrow Company shall also handle all closing matters. Balance shall be due and payable, in certified funds, at closing of escrow.
4. Close of Escrow to occur on or before March 20, 2024. Time is of the essence in this transaction.
5. Property is offered and is accepted by buyer(s) in current "as-is" condition with
any and all faults and with positively NO CONTINGENCIES.
6. Plats shown herein and the description of any improvements are
for informational purposes only, and no representations, warranties, or
guarantees are made concerning locations, dimensions, or tract size or nature,
quality or suitability for use of the tract for any improvements. All information
concerning property has been gained from Butler County courthouse records.
7. The property shall transfer by Deed that is acceptable by Title Company, subject
to the seller obtaining merchantable title free and clear of all liens. Buyer
will pay the cost of the owner's policy of title insurance and title agent's closing
fee, only, 50/50. No other closing costs or title insurance costs will be paid by
the seller.
8. Once bidding is declared closed by the auctioneer, there shall be no further
bidding.
9. Auctioneer and/or seller reserves the right to withdraw the property prior
to auction.
10. This is a "with reserve" auction. The seller reserves the right to accept or reject
the final bids at auction.
11. Bidder warrants and represents that they are at least 18 years of age and are fully authorized to bid.
12. The Real Estate is offered for sale to all persons without regard to race, color, religion, sex, handicap, familial status, or national origin.
13. United Country Farm & Home Sales listing brokerage.
Mike Landwehr is a seller's agent in this transaction and represents the seller,
not the buyer.
14. In the event of issues relating to the availability or functionality of the online bidding platform during the auction, United Country Farm & Home Sales may, in its sole discretion, elect to suspend, pause, or extend the scheduled closing time
of the auction.
15. Neither Seller nor United Country Farm & Home Sales, including its employees and agents, will be liable for any damage or injury to any property or person at or upon the Real Estate. Any person entering on the premises assumes any and all risks whatsoever for their safety and for any minors or guests accompanying them. Seller and United Country Farm & Home Sales expressly disclaim any "invitee" relationship and are not responsible for any defects or dangerous conditions on the Real Estate, whether obvious or hidden. Seller and United Country Farm & Home Sales are not responsible for any lost, stolen, or damaged property.
16. Bidder represents and warrants that they are bidding on their own behalf and not on behalf of or at the direction of Seller.
17. It is incumbent upon bidder to exercise bidder’s own due diligence, investigation and evaluation of suitability of use for the property prior to bidding.
18. Pre auction sales: As an agent for the seller, the auctioneer must present any and all bona fide written offers to the seller, which may create outside of the online platform. Therefore, all properties are subject to pre-auction sales.
19. Some items of personal property will be removed from the property before closing. (tractor weights, bale spike, deer blinds, deer feeders & tree stands)
Broker Participation Guidelines
A commission will be paid based on the following guidelines to a properly licensed real estate broker who submits their Broker Registration Form in conjunction with the guidelines outlined herein and whose client is the successful buyer of the property. Buyer must successfully close on the property and must pay the total contract sales price for the property. Ten Percent (10%) of total commissions paid will be paid to an approved cooperating brokerage.
No broker will be recognized on a prospect who has viewed the property or attended scheduled viewing date prior to the broker completing # 1 as listed above
To be entitled to any commission, the broker must:
Register their client by filling out a Buyer's Broker Registration Form completely, including the signature of their client on the form.

Attend auction, register with the client, and assist with any bidding and contract needs.
