REGISTRATION: Please follow the prompts to register by clicking the online bidding link & obtaining a user name & password along with secured credit card registration for authentication then get ready to BID. The credit card on file will be validated by our software company. This means they will put a "hold" on your credit card for $1 and then reverse that charge within 5 business days. This ensures the card is valid and that you are bidding against only other valid bidders. This is a practice that is common to the on-line auction world. If you have bid in the past with another company that uses HIBID as their platform you will be able to use the same Username and Password as in the past. If you have forgotten your Username or Password you will need to reset them. There is no charge to register and bid, you only pay if you win an item.
PURCHASE TERMS: All items are sold in "AS IS" and "WHERE IS" condition with no warranties expressed or implied. Inspection is the sole responsibility of the buyer. ALL SALES ARE FINAL! All item descriptions are believed to be accurate to the best of our knowledge and ability; however they are not guaranteed. Auctioneer makes no warranty or guarantee of any kind with respect to condition, source, suitability for a particular purpose, etc. Auctioneer reserves the right to change, modify, delete any item or lot or description in the auction as may be necessary.
TERMS FOR GUNS: 10% Buyer's Premium and a 6% Ky. sales tax will be added to determine the final sales price. Buyers must be at least 18 to purchase Long Guns and at least 21 to purchase Handguns. ALL buyers must be able to pass a NICS background check that will be handled by Frye's Outdoor Sports. The transfer fee at Frye's will be $20.00 per gun. No handguns will be registered for out of state buyers. Buyers must pay for their purchase at the Access Office, and then pick up at Frye's Outdoor Sports.
BUYER'S PREMIUM: 10% buyer's premium will be added to all bids. If you choose to pay by credit card you will be charged a 3% fee for all card transactions. Preferred method of payment is cash or check.
SALES TAX: Ky. sales tax (6%) will be added to the sale price, where applicable. Dealers or other exempt parties must provide proper documentation at pickup.
SOFT CLOSE: Access Realty and Auction will be conducting a timed event and all bidding will close at a specified time. Our online auction will also have an auto extend feature. If a bid is placed in the final five minutes of an auction, the close of the auction will be automatically extended three minutes from the time the bid was placed. The auto extend feature remains until no further bids are recieved within a 3-minute time frame. You can manually bid each time or conveniently use the Maximum Bid feature and let the computer bid automatically for you in increments just over the next highest bidder or until it reaches your max bid.
PICK UP: Friday, Dec. 22nd, from 1:00-6:00 PM EST or on Saturday, Dec. 23rd from 1:00 -4:00 EST. Pick up for all items except for guns will take place at the Access Realty Office at 121 North Main Street, Monticello Ky. 42633. All guns will need to be picked up at Frye's Outdoor Sports, 270 Cumberland Drive. Pick up times for guns will be on Friday, 1:00 to 5:00 or Saturday, 1:00 to 3:00. Before going to Frye's to pickup guns, all purchasers will need to stop at Access Realty and PAY before going to Frye's. Check or Cash.
SERVER & SOFTWARE TECHNICAL ISSUES: In the unlikely event the bidding software or the bidding system shoud fail, the auction reserves the right to extend the bidding past the advertised closing date and time. Should this unlikely event happen, all registered bidders will be emailed accordingly with the new ending date and time. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor ACCESS REALTY SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Any dispute between Access Realty, its Agents or Represemtatives and the Buyer(s) will be tried in a court of jurisdiction in Wayne County, Kentucky. By bidding on the property, buyer agrees to all terms and conditions set forth.
BIDDER DEFAULT: Failure to complete a purchase is illegal and will result in one or more of the following: (1) prosecution (2) loss of bidding privileges for Access Realty LLC auctions. If a bidder at any time feels his/her username, password or bidder number has been compromised due to lack of security by the bidder, notify the auctioneer immediately. AGENCY: Access Realty and Auction, LLC Agents and Representatives are agents of the Seller. Buyer and or Bidder agrees to hold harmless and indemnify Access Realty and its Agents and its Representatives from any and all claims, damages, or suits including but not limited to awards, judgements, costs, fees, etc. Access Realty has the right to alter this agreement at any time. This will take place by updating this site. Please check and review these terms every time you use this site, you are agreeing to the terms as they are written at that time. Auction employees and/or auction company may bid on and purchase auction items.
