TERMS AND CONDITIONS: Registration at the auction finalizes each bidder's agreement to the terms and conditions of sale as stated in the Contract and its Addenda which are incorporated by reference into your bidding. DO NOT BID unless you have registered and received a Bidder's Number, Sale Day Notes and agreed to be bound by the terms of sale in the Contract as they are final upon you becoming a high bidder. Some of these items have been used, they do have wear and tear, they are not perfect, so please inspect all items and bid accordingly.
Purchases become the responsibility of, and shall be, and remain at the risk of the purchaser immediately upon acceptance of his/her bid. It shall be the responsibility of the purchaser to insure his/her purchases immediately.
No sale shall be invalidated by reason of any defect or inaccuracy in any of the lots by reason of their being incorrectly described in the listing or elsewhere and no liability shall be borne by the auctioneers in respect of any such fault or errors. This listing has been prepared only as a guide based on information from sources generally believed to be reliable and from the seller but the accuracy thereof cannot be guaranteed or warranted by the auctioneers. Bidder acknowledges that it is their responsibility to inspect all equipment and to make his own inquires.
Since the property sold is second-hand property, seller makes no warranty of any kind and sells the goods on an "AS IS" basis, further, seller makes no warranty of any kind whatever, expressed or implied: and all implied warranties or merchantability and fitness for a particular purpose are hereby disclaimed to the seller.
BUYERS PREMIUM: The buyer's premium is fifteen percent (15%); which will be added to the high bid. This will be added at checkout and be added to your final total.
SALES TAX: 6.75% Sales Tax will be added unless sales tax resale certificate is presented.
All properties are sold "AS IS, WHERE IS" with no financing, inspection or other contingencies to sale. All sales are final and binding. Red Suit Realty and Auction represent the Sellers only and will not inspect properties on bidder's behalf. Do not bid if you have not inspected the property(s)
Immediately at the end of the auction, each high bidder must settle their account. The credit card used to register for the auction will be charged. Cash, cashier's checks, money orders and good checks that have been pre approved are accepted. The balance of the purchase price and all closing costs are due prior to your departure from the property. No item will be released, until satisfactory funds have been received in the auctioneers escrow account. Satisfactory funds are described as: Cash, Official Bank Check, Personal or Company Checks which have been pre approved in advance accompanied by bank letter of guarantee of payment or the following Credit Cards: Visa, MasterCard, Discover and American Express.
Bidding starts at the Opening Bid(s) indicated and is open to the public. The Auctioneer will call the sale and control any increments of bidding. To make a bid, raise your hand or Bid Card to be recognized. Absentee bids may be accepted at the discretion of the Auctioneer. The Auctioneer reserves the right to enter bids on behalf of absentee bidders as specified in 21 NCAC 4B. Any mistakes during bidding as to who has the high bid and /or at what price may be called to the Auctioneer's attention and corrected. The Auctioneer is the sole arbiter and controller of the conduction of the auction and shall be the final and absolute authority without liability to any party.
Do not inspect properties and/or attend an auction except at your own risk. Auctioneer, Broker, and Seller, their agents and employees, expressly disclaim any "invitee" relationship and shall not be liable to any person for damages to their person or property while in, on or about these properties, nor shall they be liable for hidden defects, dangers or conditions. All persons shall be on the premises at their own risk and shall defend indemnify, and save harmless Auctioneer, Broker and Seller from any and all liability attendant thereto.
REMOVAL OF ITEMS: All items must be removed on the day of the auction (live auction only) or on a scheduled day that the auction company will be able to accommodate the removal. We will notify all attendees of the scheduled removal dates and times during the auction. You are required to move all your items yourself unless agreed to otherwise in writing. No item may be removed from the sale site unless settlement is made in full to the satisfaction of Red Suit Realty and Auction.
ITEMS POSTED FOR SALE: Auctioneer, Broker or Seller reserve the right to add or delete items for sale prior to or on sale date.
Red Suit Realty and Auction and Seller expressly disclaim any for errors, omissions or changes regarding any information provided for these sales. Potential purchasers are strongly urged to rely solely upon their own inspections and opinions in preparing to purchase property and are expressly advised to not rely on any representations made by the seller or their agents. Property information may change without notice and potential purchasers should investigate all data fully before relying upon it.

Online bidders who bid understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. The Auctioneers shall endeavor to describe in detail each item and any pertinent information about it. The Auctioneers will not be responsible for any error or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold "AS IS" and that they may not return any item purchased.
THESE ITEMS ARE BEING DESCRIBED FOR USE AS A GENERAL GUIDE. ALL BIDDERS MUST TAKE INTO CONSIDERATION THAT OPINIONS MAY VARY. BUYER BEWARE, MAKE YOUR OWN INSPECTION AND BID ACCORDINGLY. ALL SALES ARE FINAL AND ARE NOT SUBJECT TO THE BUYER GETTING THEIR OWN OPINION OF FACT AFTER THE SALE.
By bidding on any item, the bidder shows acceptance of the terms of the auction. The auction company reserves the right to refuse service to any person. Bidder agrees that everything is sold as is and that they may not return any item they purchase for any reason.
SHIPPING INSTRUCTIONS:
Shipping may be arranged with the auctioneers by contacting prior to the date of the end of the auction. Shipping arrangements and cost are the buyer's sole responsibility.
Our shipping is limited.
WE ARE NOT EQUIPTED TO SHIP LARGE OR HEAVY ITEMS SUCH AS FURNITURE, You will need to contact a professional shipper to make arrangements.
Red Suit Realty and Auction will charge a $8.00 per box handling fee and customary shipping charges at the discretion of Red Suil Realty and Auction.
You can utilize your own method of shipping or arrange pick up of your items prior to the end of the auction. Please contact the auctioneer to make arrangements. Red Suit Realty and Auction will begin packing and shipping items at the end of the auction and there will be a separate invoice for the total. Some may require additional handling and shipping fees. Large items such as furniture, appliances, etc. are the responsibility of the buyer to arrange crating and shipping.
Check out will be by appointment only up to 5 days after the end of the auction. NO EXCEPTIONS. Shipping is the sole responsibility of the buyer.
