PROCEDURE: Will be offered as A 18.4 surveyed acres. Farm will be sold on per acre basis.
ACCEPTANCE OF BID PRICES: Successful bidders will sign a Contract for Sale of Real Estate immediately
following the auction. Contract price shall equal the high bid price per choice tract. This auction is subjet to sellers final approval.
DOWN PAYMENT: 10% down payment (non refundable) on the day of the auction. THIS AUCTION IS NOT
CONTINGENT UPON FINANCING.
CLOSING: Closing shall be on or before February 20th, 2023
POSSESSION/ TENANT RIGHTS: Seller shall deliver possession of the real estate at closing.
SURVEY: Seller will provide survey.
TAXES: 1. Seller shall pay all actual 2022 Real Estate Taxes and assessments payable in 2023 prior to or at the time of closing.
3. With such credit, Buyer shall pay all 2023 Real Estate Taxes and assessments payable in 2024, and all years thereafter.
4. Seller shall pay when due the Transfer Tax imposed by State and County law.
5. TOGETHER WITH AND SUBJECT TO A NON-EXCLUSIVE EASEMENT FOR INGRESS AND EGRESS FROM AN EXISTING LANE FROM COUNTY ROAD 1300 NORTH LOCATED UPON THE ABOVE-REFERENCED REAL ESTATE AND RUNNING NORTH TO SERVE PURCHASER AND ADJOINING PROPERTY OWNERS. SUCH EASEMENT SHALL RUN WITH THE LAND.
CONVEYANCE: Seller shall deliver at closing a recordable general Warranty Deed and Trustee‘s Deed with release of homestead, and two (2) Real Estate Transfer Declarations, sufficient to convey the premises in fee simpleabsolute to Buyer, subject to covenants, conditions, restrictions and easements apparent or of record, all applicable zoning laws and ordinances, and general real estate taxes.
MINERAL RIGHTS: Sale of the property shall include any mineral rights, if any owned, by Seller. Legal description specifically excludes mineral rights. If the buyer wishes a searchor commitment on such mineral rights, all costs shall be borne by Buyer.
