Auction Terms & Conditions: This is an online only auction. By placing a bid in this auction, the bidder indicates they accept the terms and conditions of this auction. All items Sold "AS IS" with all faults disclosed or not, with no guarantees or warranties. Description of items are at the opinion of the company with no guarantees expressed or implied. By placing a bid, bidder indicates they accept the pictures and descriptions as given or have inspected the item to their and your satisfaction. Visual inspection of items is offered and highly encouraged prior to placing a bid. We highly recommend previewing items if allowed to determine value and your bid. No backpacks, large bags, etc. will be allowed during the preview. We reserve the right to limit the number of people previewing at our discretion. All descriptions are believed to be accurate but not warranted. Measurements are approximate. The listed item(s) condition is not an official grading of the item(s) condition but only an opinion. There may be defects not noted or fully visible in the photographs, when you are uncertain of the condition or wear of an item, please bid accordingly. We attempt to note damage in writing or photos of defects. We do not guarantee condition of any item/lot. By placing a bid it's your agreement to purchase the item AS IS in the condition it is in and may not be returned for any reason. By signing the invoice, you agree you have taken possession and inspected all items at time of pickup. Lots will close approximately every 10 - 60 seconds. The online auction will have a soft close, any bid in the last two minutes automatically extends the bidding time by an additional one minute per individual lot. This creates an authentic auction atmosphere and prevents individuals from placing a bid on an item in the last seconds and unfairly snipe the lot. Online timed auction lots with the highest closing bid will be the winning bid. The assets are sold only one time with non-retractable bids. When you bid on any item, you are entering into a binding contract. If your bid is the winning bid on any item, regardless of the price it is your responsibility to pay for the item at the time of pickup or by other arrangements. All property is sold "AS IS", and ALL SALES ARE FINAL. All Items are considered used condition which may contain nicks, dings, scratches or damage. You are responsible for determining condition prior to bidding. Modest Lamb Estate Sales and our client(s) reserve the right to reject any bid and/or bidder at our sole discretion and/or remove one or more lots from auction prior to the scheduled closing time. Modest Lamb Estate Sales shall be held harmless for any malfunction of software, internet outages, etc. used by their company during this auction. It is your responsibility to have good internet service at the location you choose to participate in the final closing of the auction lots. You will be required to pay at the time of pickup with cash, credit/debit (4% Credit/Debit Card Fee) or Venmo. NO CHECKS. All winning bids are subject to 15% Buyers Premium with a 4% Credit/Debit Card Fee. Iowa Sales Tax is 7% unless tax exempt. Please email modestlambestatesales@gmail.com the tax exempt form and bring a copy at time of pick up, so that we can retain on file per State Law. Buyer Premiums are applied towards the expenses for running this online auction, setup, cleanup, labor and advertisement. You must bring your own tools, help, and equipment to load and secure your items. Help will NOT be provided by the company to load or secure your purchases. Modest Lamb Estate Sales will organize your lots for pick up at a location determined by each auction. Please be patient as we prepare lots on a; first-come, first-served basis. To limit confusion or chance of error during pickup, do not help yourself to lots. Reasonable handling charges will be added to your invoice per lot for those who choose shipping and payable with auction invoice. Invoice must be paid prior to items being shipped. Declined credit/debit cards will be accessed a $35.00 fee. Credit card charge backs are not allowed and by accepting the terms of this auction you agree to not conduct a charge back of charged fees. ANY ITEMS NOT PICKED UP DURING THE SCHEDULED PICK-UP TIME(S) WILL BE CONSIDERED ABANDONED IMMEDIATELY AFTER THE FINAL PICK-UP TIME HAS EXPIRED. ITEMS BECOME PROPERTY OF THE AUCTION COMPANY AND MAY BE RESOLD OR DESTORYED. REASONALBE DISPOSAL/TRANSPORTATION FEES MAY BE CHARGED TO THE BIDDER UNDER THE BINDING CONTRACT AND ACCEPTANCE OF TERMS. YOU MAY NOT PICK AND CHOOSE FROM THE LOT; THE ENTIRE LOT MUST BE REMOVED. IF THE ENTIRE LOT IS NOT REMOVED A FEE OF $25.00 TO $50.00 WILL BE CHARGED. If the above time does not work for you, please email and we'll try to accommodate you. No guarantees as each client's space or time frame may not allow different terms than listed. Storage fees may apply with a minimum of $5.00 per day to $40.00 per day depends on size, space and number of items. Your agreement to 'Terms and Conditions' and bidding on this auction are evidence of a binding contract to all terms posted for this auction. Failure to comply with these terms will prohibit bidder from participating in future auctions conducted by Modest Lamb Estate Sales and maybe banned from HiBid auctions per the terms of HiBid. Not Responsible for Accidents, by entering property for preview or to pick up items. You and your party agree to hold harmless Modest Lamb Estate Sales, the owners, agents and/or their heirs of the noted property. By entering the property, you agree to be audio and video recorded at the sole discretion of Modest Lamb Estate Sales, its agents, the owners and/or agents of the owner. Bidders, who bid 'off site' and are not present at the online auction or preview, understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. The bidder is responsible for the determination of age, rarity, physical condition, value, genuineness, or any other physical characteristics and condition. Modest Lamb Estate Sales shall attempt to describe in detail each item and any important information regarding that item. Bidders understand and agree they are bidding over the internet and technical issues may occur that Modest Lamb Estate Sales has no control over and is not responsible if your bid fails to be recorded, this is especially important near closing times due to high volume. Modest Lamb Estate Sales strongly suggests you take advantage of our max bid feature, so you are covered in the most efficient way possible. Modest Lamb Estate Sales will not be responsible for any omissions, errors, or misprinting the description of any merchandise or auction items. Bidder agrees that everything is sold "AS IS, WHERE IS", and ALL SALES ARE FINAL. Please remember you may need to refresh your screen to find out if you have been outbid. To refresh your screen, you need to click on refresh for the whole page to refresh or use the refresh button on your browser. This is most pertinent at the end of the auction. This auction features extended bidding. Any lot that receives a bid within 1 minutes of its scheduled closing time will remain open for bids past its schedule close and will then enter extended bidding. The lot will remain open until there are no bids received on that lot in the extended bidding time. This only affects lots with last minute bids; other lots will continue to close at their scheduled times. When a max bid is placed, the current bid price does not automatically go to your max bid. Another bidder must bid to increase the current price, the computer will automatically inject your bid in the next increment, until it reaches your maximum bid amount. Modest Lamb Estate Sales reserves the right to pause, stop, restart or extend any auction due to technological issues that may occur during an auction. No discounts or refunds will be given if this occurs. Modest Lamb Estate Sales or its agents reserves the right to bid on item(s) with the intent to purchase just like anyone else may bid. Modest Lamb Estate Sales is not responsible for any glitch or technological issue that may arise with HiBid. Modest Lamb Estate Sales, its agents or the owners of the property being sold are not responsible for lots or personal property that might be broken or damaged during the loading, handling or shipping of your items. All risk of damage to items is assumed by the buyer once the auction has ended. If items are broken the customer is still responsible for paying for them and no refunds or returns will be given for any reason. We will be happy to help winning bidders who need shipping: You must contact Modest Lamb Estate Sales and make payment in full-including shipping costs prior to shipping your items. We will package your lots, print the designated shipping label, and verify if you would like insurance. If your shipping address is different from you HiBid account, you must indicate the change prior to printing the label. Please, contact Modest Lamb within 5 days of your invoice email with payment in full or you may forfeit your lots. Forfeited lots/items could be disposed of or resold. The unpaid bidder may also be banned from future Modest Lamb auctions.
