AUCTION TERMS & CONDITIONS
A buyer's premium of 13.75% for credit card purchases and 10% for cash or approved check purchases, will be added to each purchase. If you bid $100, at checkout your card will be charged $113.75 plus sales tax. If you elect to pay with cash or approved check, you must notify Wilson Realty & Auction Company before the close of the auction. 6% KY sales tax will apply to all purchases unless you have a current 2024 tax exemption resell certificate approved by and on file with our office. If your sales tax permit hasn't been preapproved, please be advised that it will not be accepted. No Sales Tax Refunds will be made. Send proof of tax exemption to wilsonauctioneers@outlook.com.
This auction is pick-up only, AND YOU NEED TO HAVE ANY ASSISTANCE FOR LOADING WITH YOU.. There will be a clerk on site for pickup.
There will be a preview date of Thursday, June 6 from 4 p.m. to 7 p.m. at 524 East 2nd Street, Perryville, KY 40468. Please look before you bid as all bids made are final and subject to these terms and conditions. Items are sold AS IS, where is, with no warranty expressed or implied by the auction company. We do our best to describe each item accurately, but it is up to the bidder to do a visual inspection and satisfy themselves as to the value and condition. All descriptions are believed accurate but not warantied.
Special Terms
TERMS AND CONDITIONS OF THE AUCTION BIDDING VIA INTERNET HiBid: By registering to bid or placing a bid you agree to be bound by all of these terms & conditions and any other announced terms and conditions of sale or rules of the site. All Internet bidders agree that bids placed on the Internet shall have the same legal effect as if they were in attendance at the auction in person. Wilson Realty and Auction Company may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Wilson Realty and Auction Company be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. ALL SALES ARE FINAL.
Wilson Realty and Auction Company is providing Internet pre-auction and live "timed" bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Wilson Realty and Auction Company or anyone else if the Internet service fails to work correctly before or during the live auction. Wilson Realty and Auction Company will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the HiBid feature and leave their maximum bid 24 hours before the auction begins. Wilson Realty and Auction Company reserves the right to withdraw or re-catalog items in this auction.
Wilson Realty and Auction Company may withdraw any item before or during the auction. The record of the auction made by Wilson Realty and Auction Company shall be conclusive. Everything MUST be paid for in full at the conclusion of the auction. Bidder agrees to indemnify Wilson Realty and Auction Company against any claim if sales tax is not collected on Bidders purchases. Bidder agrees that under no circumstances will he/she initiate a charge back on his/her credit card. Title to the merchandise transfers to Bidder only when Bidders payment has been honored.

Bidder agrees that this agreement shall be governed by the laws of the state of Kentucky and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Kentucky. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding Wilson Realty and Auction Company arbitration in Kentucky.
