Auction Terms & Conditions
1. PAYMENT TERMS: Scheerer McCulloch requires cash or an irrevocable wire transfer, ACH or cashiers check within 48 hrs of auction ending, and PRIOR to scheduled pickup. Winning bidder is responsible for any wire transfer fees.
Winning bidder agrees to pay Scheerer McCulloch the full amount of the winning bid amount, the buyer's premium and sales tax, if applicable (unless a sales tax exemption form is provided to Scheerer McCulloch) within 48hrs. before the day of the scheduled pickup. Non-payment may result in a permanent ban from Bidspotter. Scheerer McCulloch reserves its rights and remedies to recoup its fees. If payment is not received within 48hrs of close of auction, card on file be charged a $50 inconvenience fee, and
2. ***CONDITION OF ITEMS: Scheerer McCulloch Auctioneers makes reasonable efforts to ensure that descriptions and other information are accurate. Bidders are strongly encouraged to verify any specifications and other information about equipment through consultation with independent experts. Any measurements provided are approximate and/or estimated. Neither SMA nor the equipment owners make any warranties or guarantees. Under no circumstances will SMA or the seller be held responsible for any errors, omissions, discrepancies or inaccuracies. Everything is sold on an “AS IS/WHERE IS” basis with no warranties or representations whatsoever, either express or implied. *NO SALE WILL BE VOIDED OR ADJUSTED TO ACCOUNT FOR INCORRECT DESCRIPTION, CATALOG ERROR, OR IMPERFECTION NOT NOTED. ALL ITEMS ARE SOLD AS-IS, WHERE-IS, WITH NO WARRANTIES EXPRESSED OR IMPLIED. IN SOME CASES, IT IS THE RESPONSIBILITY OF THE BIDDER TO INSPECT ALL ARTICLES AND SATISFY ALL INQUIRIES BEFORE BIDDING!*
3.***INDEMNIFICATION: Purchaser shall defend and indemnify and hold auctioneer and seller harmless from and against all claims and liabilities relating to the condition of, removal of, or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state, and local laws applicable to such articles, including OSHA requirements and Environmental Protection Agency requirements, or for proximate or consequential damages, costs or legal expenses arising there from.
4.***RESPONSIBILITY FOR ARTICLES: At the time each article is sold, ownership of and responsibility for that article is transferred immediately to winning bidder. After articles are removed from auction location or the announced removal period has ended, the auctioneer and the seller will have no obligation to the winning bidder and no responsibility for articles sold. Bidders are responsible for inspecting each article sold before it is removed from site.
5.***ACCEPTANCE OF TERMS AND CONDITIONS: Any and all bids made by any and all bidders are legally binding contracts to purchase articles for the price offered according to the terms and conditions listed herein. In the event that a winning bidder does not perform within the terms of this contract, the auctioneer may, in addition to all other remedies allowed by law, retain all monies received as deposit or otherwise as liquidated damages. Articles not paid for and removed within the announced payment and removal times may be resold at public or private sale without further notice, with no reserve; any deficiency, together with all expenses and charges of resale, including legal fees, will be charged to the defaulting purchaser.
6.***BIDDING on any item indicates your acceptance of these terms and all other terms announced at the time of sale.
7. It is the buyers’ responsibility to secure all safety equipment to meet all applicable government safety standards in using or removing items purchased.
8. ITEM REMOVAL/PICKUP: Removal shall be at the expense, liability, and risk of the purchaser. Buyer is responsible for all tools and labor required for the safe removal of their items. This includes the safe disconnection, dismantling, moving and removing of the items within the specified times and dates. Purchases will only be released upon presentation of a Paid Receipt and under the supervision of a SMA Auction Team Member. For their safety, minors will not be allowed in the area where items are being moved, dismantled, disconnected and removed.
9. ALL SALES ARE FINAL.
