You must be a registered user to bid on the items in this auction. Auctioneer may refuse to accept a Bidder Registration from any potential Bidder, may refuse to grant bidding privileges to any potential Bidder, and may revoke the Bidder Registration or bidding privileges of any Bidder. By registering to bid, YOU represent to Auctioneer that you are at least eighteen 18 years of age and that you are otherwise legally able to enter into a contract. By bidding you are stating that you are able to pay for your won auction items, the buyer’s premium & the shipping and handling. By bidding you constitute a legal, valid, binding, and enforceable contract between Auctioneer and each Bidder. Please view all items you intend to bid on and make your own determination of value and/or condition. You are responsible to preview each item from the pictures & descriptions. This is a soft close auction so please be aware that with the internet there are delays in transmission that could result in your bid not being received. Please do not wait until the last second to bid to help prevent this from happening. With that said, You may not retract a bid that has been acknowledged by Auctioneer or that has been submitted online. You agree not to withdraw or to attempt to withdraw any bid tendered by you. Gem State is not liable for any technical difficulties you may experience beyond our control. The Auctioneer, in its sole discretion, may void a sale, suspend bidding and re-sell any item/lots that were affected by any malfunction.
Payment is expected within 48 hours from the end of the auction. ALL NON PAY customers will be reported to the auctioneer community and banned from bidding in future auctions. ALL sales and ALL bids are final. ALL items are sold as is, whereis. Meaning our descriptions are believed to be accurate, the auctioneer nor seller make any warranty or guarantee, expressed, written or implied.
We have pictured and described each item to the best of our abilities. Final sales prices are determined through Public Auction, with competitive Online Bidding. Because we do not set the final sales prices. ALL SALES ARE FINAL. NO RETURNS WILL BE ACCEPTED!! Please call us or email if you have any questions.
All auctions in the United States are considered to with reserve unless they are advertised as absolute, this auction is not absolute, and some pieces may be sold with reserve. The auction company reserves the right to bid on behalf of the reserve price.
All items are photographed used a high powered macro lens. Items are placed in a professional lighting studio box to enhance the lighting and represent natural lighting from the outdoors. It is important to note that items will appear in photos as if you are viewing them under a loupe, and can look different (generally better) to the naked eye. Items are NOT edited or altered for pictures.
All Gold, Sterling Silver Diamonds are electronically tested prior to being sold. METALS: Gold & Sterling Silver are guaranteed 100% genuine.
DIAMONDS: Diamonds are tested on electronic Presidium Gem Testers and are guaranteed to be genuine. Opinions of size, color, clarity, cut and cutting style can vary greatly among experts and are not warrantied.
COINS & CURRENCY: Gem State Surplus guarantees the authenticity of coins and currency. Gem State Surplus makes no warranty as to the condition of coins or currency. Coin grading varies greatly based on the experience of grading standards of the individual or grading company, it should be used as a guideline. Gem State Surplus does not warranty any basis of grades.
APPRAISALS & OPINIONS OF VALUE: All values including appraisal prices and auction estimates are to be used as guidance and are not guaranteed by the auction company or the appraisal company. No appraisal or auction estimate should be used as a suggestion of resell value. Opinions of value and quality of stones can vary greatly among "experts" based on current market conditions, availability in the market place, geographical location, gemological equipment types, method of grading and the evaluators training. Such variances do not constitute any error on either evaluator. Gem State Surplus does not warranty any opinion of value, or grading evaluation.
NOTICE: For bidders who are new to our website and are unknown to our company, we will likely ask you for more information to verify your identity for purchases exceeding $1,000. In the event that we can not verify your shipping address with your identity, we will require wire transfer.
Checkout Date/Time:
There will be no in-person payments or pick ups accepted. Payment is expected within 24 hours of each auction. If we have NOT received payment within 24 hours we automatically charge the credit card you selected at registration.

Buyer’s Premium: 20% buyer’s premium will be charged on top of the hammer price of each item purchased. All items shipped within Idaho state will be additionally charged 6% sales tax.
Payment Options: We accept Mastercard, Visa, American Express, Discover, wire transfers, cashier’s checks, Paypal, certified checks and money orders as forms of payment. We accept credit card payments up to $2,500. Orders over $2,500 can be paid for by wire transfer
Shipping & Handling:
We are a 100% shipping auction! No item will be shipped until the invoice is paid in full. All items will be shipped within 7 business days from the time items have been paid for and funds have cleared. We will only be shipping to the verified shipping address that you registered with. Please note that the credit card that you place on file is the credit card that will be billed, and the address you provide is the shipping address where your items will be shipped. The auction software uses a credit card verification system that validates credit cards and matching addresses, the ship to addresses cannot be changed. NO EXCEPTIONS! Unfortunately, high fraud has prompted this rule to be in place. If an item gets shipped to the “wrong address” meaning an address that is NOT listed when registered, you are responsible! That risk is not on Gem State. With that said, please keep your registered information up to date.
Shipping & Handling Fees will be included on your invoice. We can offer combined shipping. We will ship with USPS, UPS & FedEx.
Shipping rates will vary per item and will be invoiced after auction based on size, weight & insurance.
Handling fee - $2 per item.
