Auction Conducted Under and In Accordance with These Bidder Terms and Conditions: These Online Auction Terms and Conditions constitute a legal, valid, and binding contract between Metro Auctions LLC and each bidder. The Auction is conducted under and in accordance with these Bidder Terms and Conditions and applicable law. By registering to bid, each Bidder agrees to be bound by these Terms and Conditions.
1. Registration:
All prospective bidders must register to bid on hibid.com. You must agree to all auction terms and conditions before you are approved to bid.
2. Condition of Property:
All property is sold "AS IS," "WHERE IS," and "WITH ALL FAULTS." There are no guarantees or warranties of any kind. Items are free of monetary liens or claims, which will attach to the sale proceeds as they existed before the sale.
Refunds or chargebacks will not be granted due to item condition. By registering to bid, bidders acknowledge they have had the chance to review and inspect the assets, relying solely on their investigations. The Auction Company is not responsible for lease negotiations for the winning bidder.
All property is sold without contingencies and in its current condition.
3. Risk and Liability:
All persons inspecting or removing merchandise assume all risks or damage or loss to persons or property. The Auctioneer, Seller, Landlord, Trustee, and/or Agent shall be released from all liability. The Auctioneer shall not be liable for any defect in the condition of the merchandise on the premises of the sale.
4. Inspection:
All bidders are encouraged to inspect assets being sold during the preview time. Previews are BY APPOINTMENT ONLY by calling (914) 383-8313.
5. Payment Terms:
- We accept Cash, Zelle, Wire Transfers, and Cashier's Checks made payable to Metro Auctions LLC.
- All major credit and debit cards (Visa, Mastercard, Discover, and American Express) are accepted.
- Personal checks, company checks, or money orders are NOT accepted.
- Full payment is due on the scheduled removal day regardless of shipping, delivery, or storage arrangements. If no contact is made before the end of the scheduled removal day, the credit card on file will be charged. Partial charges may be made until the total balance is paid.
- Buyer's Premium: A 20% buyer's premium will be added to each purchase. If you bid $100.00 and are the winning bidder, you will be charged $120.00 plus applicable sales tax.
- Sales Tax: Applicable sales tax will be added to all purchases unless the purchaser provides a valid resale certificate and proper documentation. Tax-exempt bidders must email a copy of their state tax exemption form or certificate to info@metroauctionsllc.com.
6. No Credit Card Chargebacks:
- Bidders agree not to initiate a credit card chargeback under any circumstances.
- If a chargeback is initiated in violation of these Terms, the Bidder remains liable for all purchases and associated costs, including attorneys' fees and other expenses.
- Agreement to not initiate a chargeback is a condition of receiving a Bidder Number.
7. Full Payment Requirement:
- Full payment must be made by the date and time specified in the Terms of Sale, which is typically on the scheduled removal day.
- Items cannot be removed from the premises until the full balance is paid.
- Payments made after the specified time may incur late fees or result in forfeiture of the purchase, as outlined in the Terms of Sale.
8. Checkout/Removal Times:
- Any purchases not removed by the indicated date and time will be considered abandoned.
- Responsibility for removal lies with the Purchaser, including all financial and physical arrangements.
- Metro Auctions LLC will not handle shipping, packing, or moving. Buyers must arrange for their own transportation or third-party shipping in advance.
9. Auctioneer Rights:
- The Auctioneer reserves the right to group, break, or withdraw lots at their discretion.
- In case of a disputed lot, the Auctioneer's decision is final.
10. Return/Refund Policy:
- ALL SALES ARE FINAL. No refunds or exchanges.
11. Lot Pricing:
- Items may be sold as single lots or as grouped lots. For grouped lots, the total cost is calculated by multiplying the bid price by the number of items in the lot. For example, if a grouped lot contains 10 items and the bid price is $5, the total cost is $50.
12. Buyer's Premium:
- A 20% buyer's premium will be added to all purchases.
13. Auction Interruptions:
- The Auctioneer reserves the right to pause, cancel, or reopen the auction in case of system failures.
14. Extended Bidding (Anti-Sniping):
- To ensure fair bidding, if a bid is placed within the final moments of the auction (e.g., the last 10 seconds), the auction for that lot will automatically extend by an additional 2 minutes. This process ensures all interested parties have ample opportunity to respond with further bids. The auction will only close when no new bids are received during the extended period.
15. Shipping and Handling:
- Metro Auctions LLC will not handle shipping, packing, or moving. Buyers must arrange for third-party shipping or transport.
16. Suspension or Ban:
- Metro Auctions LLC reserves the right to suspend or permanently ban bidding privileges for any Bidder that breaches these Terms or engages in improper conduct.
