By participating in our auction, you agree to the following terms and conditions designed to protect our bidders, sellers, and our auction house alike. We aim to keep things fair, fun, and straightforward for everyone involved!
All Sales Are Final, So Bid Like You Mean It!
All items are sold “as is, where is,” with no guarantees, warranties, or promises—either expressed or implied. Once the auctioneer says "SOLD," the item is all yours!
Inspect Before You Invest
It’s up to you, the buyer, to carefully inspect all items before placing a bid. Once you buy it, you own it, and all sales are final. No take-backs or refunds, folks!
Buyer’s Responsibility for Removal
The buyer is responsible for the removal of all purchased items at their own expense. We’re good at selling, not hauling, so please plan accordingly!
Bring Your Best Connection
While we do our best to provide a seamless online experience, we’re not liable for any lost or poor internet or telephone service that might limit your ability to participate in the auction. A strong connection is your best bet!
Payment Terms
All purchases must be paid in full (in U.S. funds) at the conclusion of the auction, before any items are removed from the auction site. Payment methods accepted: cash or credit card (with a 4% processing fee). Remember, if we can't reach you after two contact attempts, we'll automatically charge the credit card on file.
Pick-Up and Storage Policy
Items must be picked up within the designated time frame. Items not picked up will be moved to storage, and additional storage fees may apply. Items left unclaimed for over 30 days will be considered abandoned and may be resold or disposed of at our discretion.
Buyer's Premium
A 10% buyer’s premium will be added to the final bid amount. It’s how we keep the lights on and the gavel swinging!
Errors and Omissions Disclaimer
We do our best to accurately describe all items, but we are not responsible for errors or omissions in listings, whether online or in print.
No Responsibility for Packing and Transport
1889 Auctions is not liable for any damage caused during the packing, loading, or transport of items once purchased. Bring your muscle and packing materials, and handle with care!
Auctioneer’s Decision is Final
The auctioneer calls the shots, and all decisions are final. No arguments or debates, please—we’ve got more items to sell!
Identification Required
All onsite bidders must present a valid ID to register. We need to know who you are before you start waving that paddle!
Day-Of Announcements Rule
Any announcements made by the auctioneer on the day of the auction or at the time of sale will take precedence over all prior advertising or representations, printed or verbal. Keep your ears open!
Reserve Prices and Starting Bids
Some items may be subject to a reserve or minimum price. All bids start at $1, but if a reserve isn’t met, the seller will review the highest bid. The top bidder will be contacted within 24-48 hours of the auction’s end to confirm the sale.
Sales Tax
A sales tax of 6.2% will be collected.
By Registering, You Agree to These Terms
Whether registering online or onsite, all bidders agree to be bound by these terms and conditions. It’s all in the name of a fair and fun auction!
Non-Payment Penalties
If you’re the winning bidder and fail to make payment when due, you agree to reimburse the auctioneer or the owner for all collection and court costs, including attorney fees. Interest on the unpaid balance will accrue at 21% annually. All legal disputes will be settled in the appropriate South Dakota Court under South Dakota law.
